)ur conversation, this is the opinion of the USACE Wilmington District Navigation Branch. Our setback policy do
allow for replace of pilings within the setback. We consider any hardened structure such a pilings to be the
tprint" of the dock. If the dock is attached to the pilings (usually raised above the water) then that is now also
ie "footprint" where a floating dock attached to the pilings is not really considered part of the "footprint" beca
movable. That being said, we have no issue with them replacing the actual floating dock and any part of the
-ture outside of the setback. If they remove any part of the "footprint" (in this case any of the pilings inside thl
ack) we would not allow them to put them back. If they want to put in pilings along the setback link to anchor
Jng dock to we would not have an issue with that as long as they were not inside the setback. Let me know if y
i anything else. Thanks.
