Bodenhamer (widower) , party of the second part (`Bodenhamer") ; WITNESSETH:Oft THAT WHEREAS, Bodenhamer is the owner of Lots 3-5, Block 15, Section B & . C, Ocean Isle Beach, as shown in Map Book 6 at Page 1 of the Brunswick County Registry; and WHEREAS, in order to protect his property, Bodenhamer desires to construct and install a vinyl bulkhead along a portion of the eastern right of way line of Concord Street where said street abuts the Atlantic Intracoastal Waterway, said portion being the 35 foot most northern portion of said right of way; and WHEREAS, Town is willing to permit the construction and installation of said vinyl bulkhead along the terms and conditions hereinafter set out; NOW, THEREFORE, for valuable consideration, including the mutual promises and covenants contained herein, the parties hereto agree as follows: 1. Bodenhamer shall comply with all federal, state and local laws, regulations and ordinances in the construction and installation of said bulkhead. 3. Bodenhamer agrees to keep, repair and maintain said bulkhead in good condition at all times and in compliance with all federal, state and local laws, regulations and ordinances. 4. Bodenhamer acknowledges that Town has no responsibility whatsoever for the construction, installation or maintenance of said bulkhead. 5. Bodenhamer shall indemnify and hold the Town, its agents, officials and employees, harmless against any and all claims, demands, causes of action, or other liability, including attorney fees, on account of personal injuries or death or on account of property damages arising out of or relating to the installation, construction or maintenance of said bulkhead.
