Dear Mr. Klass:
This letter is in reference to the new construction of a pedestrian walkway at Dutchman Creek, in
the Oak Island jurisdiction. You have sketched your proposed construction details for the CAMA
required vessel passage area constituting a 15' span near center of bridge. I have reviewed and amended
the sketches (see attached):
1) This design will meet the intent of the NC Building Code, 2018 version. Girder and joist sizing
uses a live load of 60 PSF, per Chapter 16 of the Code.
2) An 8' embedment (minimum) should be adequate for the calculated 3.0 ton capacity per pile that
is required. If, during driving, you encounter soft material that would render this capacity
questionable, you will need to drive to refusal with a spliced piling. Contact me for further
guidance and a splice design if needed.
3) The bolted connections require heavier bolts (1" diameter) to handle the greater potential load
Our recommendations are based on the information provided, and we cannot be liable for any issues that
may arise as a result of incorrect or incomplete information. Assuming the information provided is
complete and accurate, this design shall serve to provide adequate capacity in the walkway.

'State of North Carolina, party of the first part, and the United States of America, party
of the second part, Witnesseth that:
( WHEREAS, in the River and Harbor Act, approved July 3, 1930, provision was made
for the construction of an Intra-Coastal Waterway from the Oape rear Aiver at Southport
to and beyond the North Oarolina-South Carolina state line in accordance with report sub-
mitted in Hausa Document No. 41, Seventy-first Congress, First Session, subject to the
condition that local Interests shall furnish without cost to the United States of America,
a right-of-way for said waterway of width not less than one thousand feet where the land
does not exceed eight feet in elevation above mean low water, with increased widths approx-
imately in proportion to the quantity of excavation required as the elevation of the land
increases until a maximum of one thousand seven hundred and fifty feet is reached where the
ground elevation is thirty feet or more above mean low water; and
WHEREAS?, the party of the first part is desirous that said waterway be constructed '
and is willing to furnish without cost to the United States of America, a right-of-way for
said waterway as hereinb afore specif�ad, for such use and purpose; and
® WHEREAS, the State of North arolina is the owner of and in the possession of the
following described tract or tracts of land situated in Brunswick County, State of North
Carolina,
NOW THEREF04E, the said partyy of the first part for and in consideration of the
premises, and the sum of One Dollar (a1.00), the receipt whereof is hereby acknowledged,
has granted, bargained and sold, and does hereby grant, bargain, sell and convey unto the
party of the second part, and its assigns, a perpetual right-of-way for said waterway as {
hereinbefore specified, over and through the hereinafter described tract or tracts of land,
together with the right to enter upon, excavate out away and remove any or all of said land
as may be required at any -time for the construction and maintenance of the said Intra-
Coastal Waterway, or any enlargement thereof, and to perpetually maintain the portion so
excavated and the channel thereby created, as a part of the public bavigable waters of the
United States; and the further perpetual right and easement to enter upon, occupy and use
any portion of said tract of land not so excavated and converted into public navigable
water as aforesaid, for the deposit of dredged material, and for such other purposes as may
be needful in the preservation and maintenance of the said Intra-Coastal Waterway, in and
to the following described tract or tracts of land situated in Brunswick County, North
Carolina
IIt is the purpose and intent of this description to cover all the rights, title
and interest that the State of North Carolina may have in the following described section
of the sight -of -way of the proposed Intra-Coastal Waterway.
The section of the right-of-way as described herein is in Brunswick County, State
