Division of Costal Management 400 Commerce Avenue Morehead City, NC 28557 Subject: CAMA General Permit Replacement of Bridge No. 14 on SR 1971 (Durham Creek Rd) over Branch of Durham Creek in Beaufort County, NC State Project 17.BP.2.R.95 (Formerly STIP No. B-4709) Dear Mr. Lane, The North Carolina Department of Transportation Highway Division 2 is submitting the attached CAMA General Permit application for the replacement of bridge no. 14 on SR 1971 (Durham Creek Rd) over Branch of Durham Creek. TGS Engineers has been contracted by NCDOT for the design and permitting of this bridge replacement project. The proposed project will replace the aging existing structure over Branch of Durham Creek at the same location. Traffic will be maintained using an off -site detour during construction, with the proposed bridge being built using top -down construction. The proposed bridge maintains the existing clearance over Brach of Durham Creek. No direct discharge into Branch of Durham is proposed for this project. The project is in the Tar -Pamlico River Basin. Impacts to wetlands and surface waters, as well as riparian buffer impacts, have been minimized to the maximum extent practicable for this proposed project. NCDOT request that the proposed work be authorized under a Coastal Area Management Act General Permit. Adjacent riparian landowner forms signed by all the adjacent property owners has been included in this application. Per Michael Aman, PE, the Division 2 Bridge Program Manager, authorization to debit the $800 Permit Application Fee from State Project Number 17BP.2.R.95 is hereby given. NCDOT No Archaeological Survey Required Form RECEIVED FEB 19 2020 DCM-MHD CITY State Project 17BP.2.R.95 CAMA General Permit Application February 12, 2020 1.0 Project Narrative Purpose and Need The purpose of the project is to address a fifty -three -year -old bridge with deteriorating timber substructure and low posted weight limit. Project Description Replacement of Bridge No. 060014 on SR 1791 (Durham Creek Rd) over Branch of Durham Creek in Beaufort County, NC. The proposed 90' long by 30' wide two -span bridge would replace the existing 61' long by 30' wide two -span bridge at the same location. The proposed grade will be about 1.5' above existing grade at the crossing. Bridge No. 060014 is within the Tar -Pamlico River Basin and shall adhere to the Tar -Pamlico Buffer Rules. The proposed bridge will have no direct discharge into Branch of Durham Creek. Stormwater runoff from the south approach of the proposed bridge flows to two traffic bearing grated inlets on both sides of the roadway where it will be diffused with a rip -rap pad at the outlet of the proposed pipe. The proposed deck runoff will outlet outside of buffers, treated by a grass Swale before discharging into the wetland. Equipment to be used includes cranes, excavators, dump trucks, and paving equipment. Wetland Delineations The wetlands at the project site were originally delineated by Carolina Ecosystems, Inc. for the July 2015 Natural Resources Technical Report (NRTR). The wetland delineation was updated in November 2019 following the October 30" site visit with NCDCM, NCDEQ, and NCDOT. A CAMA wetland was delineated in the northwest quadrant by NCDCM, the 404 wetlands in the northwest and southwest quadrants were redelineated by NCDOT and verified by USACE. Summary of Impacts Proposed impacts to jurisdictional areas total <0.01 acre (83 sf) of permanent 404 wetland impacts and 0.08 acre (3374 sf) of temporary wetland impacts (hand clearing). No permanent impacts to the CAMA wetland are proposed. Also, there are no permanent or temporary surface water impacts for the project. Proposed impacts to riparian buffers include 0.05 acre (2305 sf) in zone 1 and 0.03 acre (1305 sf) in zone 2. Project Schedule State project 17BP.2.R.95 is scheduled to be let in April 2020. To gain maximum clearance potential, Tideland EMC is relocating one pole, replacing one pole, and converting the creek crossing to vertical construction, with a minimum clearance of 30 ft above the normal water surface elevation (NWSEL) of the creek. No communication utilities will be attached to the power poles. Centrylink is abandoning all underground cables in conflict with the proposed bridge construction and re -boring new cable to their existing poles to clear the conflicts. The existing poles and overhead crossing of the creek are to remain in service and has a minimum clearance of 15 ft above the normal water surface elevation (NWSEL) of the creek. For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. Reclamation measures and implementation shall comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971. d. If the project occurs in waters or watersheds classified as Primary Nursery Areas (PNAs), SA, WS-1, WS-1 I, High Quality Waters (HQW), or Outstanding Resource Waters (ORW), then the sedimentation and erosion control designs shall comply with the requirements set forth in 15A NCAC 04B .0124, Design Standards in Sensitive Watershed. Stormwater shall be directed across the bridge and pre-treated through site -appropriate means (grassed swales, pre -formed scour holes, vegetated buffers, etc.) where possible before entering the stream. To meet the requirements of NCDOT's NPDES permit NCS0000250, please refer to the most recent version of the North Carolina Department of Transportation Stornwater Best Management Practices Toolbox manual for approved measures. [15A NCAC 02H .0507(d)(2) and 15A NCAC 02H .0506(b)(5)] 14. All bridge construction shall be performed from the existing bridge, temporary work bridges, temporary causeways, or floating or sunken barges. If work conditions require barges, they shall be floated into position and then sunk. The barges shall not be sunk and then dragged into position. Under no circumstances should barges be dragged along the bottom of the surface water. [15A NCAC 02H .0506(b)(3)] 15. Bridge piles and bents shall be constructed using driven piles (hammer or vibratory) or drilled shaft construction methods. More specifically, jetting or other methods of pile driving are prohibited without prior written approval from the NCDWR first. [15A NCAC 02H.0506(b)(2)] 16. The use of rip -rap above the Normal High Water Mark shall be minimized. Any rip -rap placed for stream stabilization shall be placed in stream channels in such a manner that it does not impede aquatic life passage. [15A NCAC 02H.0506(b)(2)] 17. No drill slurry or water that has been in contact with uncured concrete shall be allowed to enter surface waters. This water shall be captured, treated, and disposed of properly. [ 15A NCAC 02H .0506(b)(3) 18. A turbidity curtain will be installed in the stream if driving or drilling activities occur within the stream channel, on the stream bank, or within 5 feet of the top of bank, or during the removal of bents from an old bridge. This condition can be waived with prior approval from the NCDWR. [I5A NCAC 02H .0506(b)(3) 19. Pursuant to 15A NCAC 2B.0259(6), sediment and erosion control devices shall not be placed in Zone I of any Tar -Pamlico Buffer without prior approval by the NCDWR. At this time, the NCDWR has approved no sediment and erosion control devices in Zone 1, outside of the approved project impacts, anywhere on this project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers provided that Zone I is not compromised and that discharge is released as diffuse flow. 20. All riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored to the preconstruction contours and revegetated. Maintained buffers shall be permanently revegetated with non - woody species by the end of the growing season following completion of construction. For the purpose of this condition, maintained buffer areas are defined as areas within the transportation corridor that will be subject to regular NCDOT maintenance activities including mowing. The area with non -maintained buffers shall be permanently revegetated with native woody species before the next growing season following completion of construction. (I5A NCAC 213.0259) 21. All stormwater runoff shall be directed as sheetflow through stream buffers at non -erosive velocities, unless otherwise approved by this certification. (15A NCAC 213.0259) 22. New roadside ditches that do not control for nitrogen and attenuate flow before discharging through the riparian buffer are prohibited [I5A NCAC 2B.0259(6)] 23, NCDOT shall be in compliance with the NCS00250 issued to the NCDOT, including the applicable requirements of the NCG01000. 24. The archaeological Area of Potential Effects (APE) for the project is defined as a 1,200 foot (365.76 m) long corridor running 600 feet (182.88 m) north and 600 feet south along Durham Creek Road from the center of Bridge No. 14. The corridor is approximately 200 feet (60.96 m) wide extending 100 feet (30.48 m) on either side of the road from its present center. SUMMARY OF CULTURAL RESOURCES REVIEW Brief description of review activities, results of review, and conclusions: Bridge No. 14 is located between the Pamlico River to the north and the community of Edward to the south in the southern portion of Beaufort County, North Carolina. The project area is plotted in the northwestern corner of the Aurora USGS 7.5' topographic quadrangle (Figure 1). A map review and site file search was conducted at the Office of State Archaeology (OSA) on February 9, 2015. No previously recorded archaeological sites have been identified within the APE, but two sites (31 BF171 and 31 BF178) are reported within a mile of the bridge. According to the North Carolina State Historic Preservation Office online data base (HPOWEB 2014), there are no known historic architectural resources within the APE that may yield intact archaeological deposits. Topographic maps, USDA soil survey maps, aerial photographs (NC One Map), and historic maps (North Carolina maps website) were examined for information on environmental and cultural variables that may have contributed to prehistoric or historic settlement within the project limits and to assess the level of ground disturbance. Bridge No. 14 and Durham Creek Road cross Tan Swamp roughly north to south (Figure 2). The swamp drains to the east and is a tributary to Durham Creek. These waterways are part of the Tar -Pamlico drainage basin. The APE is situated along the Tan Swamp floodplain with moderately steep side slopes at either end. The area is mostly forested with secondary growth. Although ground disturbance appears minimal, there are reports of a heavy disturbance from former occupation in the southeast quadrant. According to the USDA soil survey map, the APE encompasses only two soil types (Figure 3). The floodplain is made up of Dorovan mucky peat (Do). This series is very poorly drained, nearly level, and waterlogged. Persistent wetness and flooding make this series undesirable for settlement activitie&E1VED subsurface testing is required for this series. The side slopes are composed of Winton fine sandy oam (WeD). This series is moderately well drained with a slope of 12 to 25 percent. Typically, slope of 15 percent or more is not tested since it is unlikely to yield significant archaeological deposits. The two previously known archaeological sites (31 BF 171 and 31 BF 178) reported within a mile of the bridge are 20th century African -American cemeteries. They were recorded in 1989 by East Carolina University during the Texas -Gulf Survey. The National Register's eligibility for these two sites has yet to be assessed. Although no surveys have been conducted in the project area, it was reviewed by OSA (ER 09-2687) in 2009 (Attachment 1). This review was for construction of a docking facility. Due to reported ground disturbance and unlikeliness of encountering a significant site, an archaeological survey was not recommended. A historic map review was also conducted. Most early maps from the 18th and 19th centuries provide only general details concerning the region illustrating just major roads, settlements, and drainages such as John Lawson's 1709 map of North Carolina, which identifies Durham Creek but little else within the vicinity (Figure 3). However, the U.S. Coast and Geodetic Survey of 1874 produced a highly detail map of the Pamlico River and surrounding area (Figure 4). This map depicts a road/trail following the same alignment as Durham Creek Road with a crossing over the swamp. No structures or farms are plotted in the vicinity as the area is shown as forest. The 1908 Beaufort County Geological map and the later 1914 Post Office Map illustrate the same road with households along it, but all are well away from the project area (Figure 5). By the 19030s, the bridge begins to appear on printed material such as on the 1938 North Carolina State Highway map for Beaufort County (Figure 6). Subsequent 20th century maps provide no further or useful information on development. This includes no structure in the area reviewed by OSA. In general, the historic maps suggest that no former structures with new or important information were once located within the APE, and no significant deposits should be encountered. Brief Explanation of why the available information provides a reliable basis for reasonably predicting that there are no unidentified historic properties in the APE. The defined archaeological APE for the proposed replacement of Bridge No. 14 is located along the Tan Swamp floodplain and the neighboring side slopes. It is unlikely intact and significant archaeological deposits will be present in this area. This is primarily due to persistently wet soils in the floodplain and slope of 15 percent or more leading rip to the ridges. The historic maps also suggest no significant archaeological deposits from former historic structures are within or near the project limits. Finally, OSA has previously reviewed the current APE for another development project, and recommended no archaeological survey. As long as impacts to the subsurface occur within the defined APE, no further archaeological work is recommended for the replacement of Bridge No. 14 in Beaufort County. If construction should affect subsurface areas beyond the defined APE, further archaeological consultation might be necessary.
