It is my understanding that they are working on a permit application. My wife had signed the waiver to the 15' setback requirement. This was in error and as owner of the property I do not waive the 15' setback requirement. As I expressed on the phone, my concern is that when 10 people own something no one is responsible for anything unless it is a well operated organization. I am also concerned that the end result will be a lot of boats tied up to the pier sitting in the mud at low tide. If I need to provide any additional information in this regard please let me know. I had a phone conversation with Chris with the New Hanover County Planning Department. He told me they were lifting their objection to the dock. I am writing to again request that you (CAMA) properly advise the applicant of the rules regarding using the dock for permanent or semi -permanent dockage of boats. We have discussed that it is their plan to have at least two boats permanently docked there and my expectation is that more would end up tied to the dock at some level. Based on our prior conversations this is not permitted usage. Forgive my persistence, but if they don't read the rules or don't care what the rules say, we will have on -going problems that might have been avoided if they were directly and clearly advised on the front-end of what the rules are. If you do not make it clear on the front-end this will end up being a point of conflict between me, CAMA, and Barren Inlet. I work quite a bit with attorneys in a number of areas for my clients. The legal system is inefficient, expensive and flawed. Please work on the front-end of this permitting process to set the proper expectations of usage by the applicant so we can avoid problems down the road. That will require some effort on your part as my experience with them so far is that they do not want to listen to what they do not want to hear. If you don't make is quite clear in writing through an affidavit or some type of verbal and written communications, they will not "hear" what the permitted usage is supposed to be. They will only hear what they want to hear. There have recently been two different boats permanently moored in the mud at times and that will only increase. Division of Coastal Management on 4/6/17, 4/7/17, 4/28/17, 5/25/17, and 5/26/17., regarding your concerns about the proposed development by Barren Inlet Road Association at the terminus of Barren Inlet Road, adjacent to Howe Creek, in Wilmington, New Hanover County, North Carolina. The project consists of constructing a new private pier facility. Based on a site visit by staff with our office, review of the drawings provided by the applicant, and a signed waiver from New Hanover County, the construction of the new private pier facility has been determined to comply with the current Rules of the Coastal Resources Commission (07H.1200)-General Permit for construction of piers, docks, and boat houses in the Estuarine Shoreline AEC, and as such, a permit has been issued to authorize the development. I have enclosed a copy of the permit, as well as the relevant statutes. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for a Contested Case Hearing. The hearing request must be filed with the Director of the Division of Coastal Management, in writing and must be received within twenty (20) days of the disputed permit decision. This email is a little long with a number of questions so please wait to process it when you have some quality time. If I do not hear back in a reasonable time frame I may seek a court injunction to stop construction pending an appeal for the numerous reasons listed below. They were going to start their pier today but the truck got bogged down in the mud in the drive and could not get to the water. Their drive has water running down it most of the time and of course, it is quite muddy, and they blamed it on me today! That's laughable. It just the normal runoff but it's always convenient to blame someone else. All this activity today was apparently without a New Hanover County Building Permit. I realize this is not your jurisdiction but it illustrates in my opinion, what we are dealing with. There was a bit of drama today and apparently either with you or with the County planner, or with both of you, I have not been painted in a very positive light (I'm being polite). That is not appreciated as you might guess. Please do not use me as an excuse or whipping boy for you and Chris O'Keefe to properly enforce your rules and do your job. I have some questions for you. 1. Once the dock is built, can they leave 1 boat overnight to rest in the mud at % tide (the approximate level the boat would be in the mud) and below? If no, you do not need to answer the following questions for me. a. If the above question is yes, how many nights can they leave the boat there? 2, 3, 4, a certain period, as long as they want? How many times can they do this in a 30 day period of time? 2. Can they leave two boats in the mud overnight? If so, for how long? 3. Can they leave three boats in the mud overnight? If so, for how long? 4. If yes to #3, how many boats can they leave there overnight and for how long? All these questions may seem trivial and nit picking but this thing could end up being a mini -marina before it's over with. I can positively assure you that they do not plan to use it as a place just to launch kayaks and canoes or to occasionally stroll out on at sunset. Yes, they may occasionally use it for those purposes but that is not why they are building it. Several of them want a place to dock their boats -permanently if they can get away with it. If that's permitted, and I think you have communicated otherwise, just let me know and I will quietly fade away. I know the rules are not specific enough as written to answer these detailed questions (unless the answer to question #1 is no). So this will go back to your administrative enforcement policy. They will push your rules as far as they can get away with. At what point does the calculation of the length of their pier begin? Currently they have stakes put there by themselves and not by a surveyor, that are not at high water. I have attached a picture for your benefit and this was not at high water or an unusually high tide. At this point they have not paid for a surveyor and if they properly set the pier back the 15', it would almost be by accident. That would also apply to the length and the angle of the pier from the land. (See Scan0143) Without a survey one r They apparently do not have a New Hanover County building permit. They are trampling Sec 404 wetlands to build this pier. They hope to start the pier out from the normal high water mark They are currently marking the end of the pier past the riparian length They have not had a surveyor properly mark the setbacks (Is CAMA really this slack that they allow these types of abuses?) Two final items. You personally have been very pleasant and helpful to work with. Thank you for that. But as I mentioned above, I hope you and the county planner will not use me as your whipping boy or the excuse to do your job. I was almost concerned for my safety today. Not completely, but there was a member whose anger was explosive towards me and these days, you just never know. And while I pleasantly surprised at the two polite and reasonable members I met today and enjoyed talking with them, a few of these members are not nice people. Please get back with me at your convenience for the answers to my questions. If CAMA and New Hanover County are going to be this slack about things I may have to involve the Army Corp of Engineers and the wetland issue and appeal the decision, filing an injunction against CAMA to stop the process.
