This policy doesn't refer to applications that require a waived riparian setback notification. I have also attached the rules ("meat & taters") from 07H for development within our Areas of Environmental Concern (AECs). Go to pages 10 & 11 for Piers & Docking Facilities, specifically page 11 Letter I : "The minimum setback provided in the rule may be waived by the written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants." Without a waived notification I cannot permit anything within 15' of that property's riparian corridor. If a waived notification cannot be obtained, then the property owner may apply for an Exemption to repair only half of that structure this year, then apply for a second Exemption next year to repair the other half. Let me know how the property owner would like to proceed.
