IssuinpjDate 126ratiopi Date STATE OF NORTH CAROLINA LEASE AGREEMENT COUNTY OF CARTERET THIfk LEASE AGREEMENT, made and entered into this the_ da of ryu,�, , 1992, by and between the STATE OF NORTH CARMINA, party of the first part and the COUNTY OF CARTERET, a municipal corporation, party of the second part; W I T N E S S E T H: THAT WHEREAS, the Department of Administration desired to dispose of the property herein described lease, for the purpose herein specified; and WHEREAS, the execution of this agreement for and on behalf of the State of North Carolina has been duly approved by the Gov- ernor and Council of State, at a meeting held in the City of Raleigh, North Carolina, on the 7th day of January, 1992; and WHEREAS, the parties hereto have mutually agreed to the terms and conditions of this lease, as herein set forth. NOW, THEREFORE, the party of the first part, for and in con- sideration of the sum of ONE DOLLAR ($1.00), and other good and valuable consideration, receipt of which is hereby acknowledged, and in further consideration of the premises, and the terms and conditions hereinafter set forth, does hereby demise and lease to the party of the second part, and the party of the second part does hereby rent from the party of the first part, that certain area of land owned by the party of the first part. Being that tract or parcel of land known as The Harkers Island Fishing Pier site, situate, lying and being in Carteret County, North Caro- lina, and particularly described as follows: Located at Harkers island, Carteret County, North Caro- lina, more particularly described as follows= Beginning at a set iron pipe 30 ft. east of the centerline of State Road 1335, said pipe being located N 41' 21' E, 105.07 feet from a railroad spike in the centerline of State Road 1335 at the northern bridge abutment of the southern most of two brides across the Straits leading unto Harkers Island; thence from said beginning point S 65' 00' E, 45.09 feet to a point in the high water mark of the Straits; thence with the high water mark of the Straits the following three courses and distances: N 45° 28' 42" E, 73.23 feet; N 43° 4B' 36" E, 90.02 feet; S 860 15' 05" E, 25.98 feet to a point on the landward side of the needle marsh grass adjoining the Straits; thence with said marsh the following twelve courses and distances: N 520 12' 47," E, 40.32 feet; N 160 45' 05 part then said improvements shall, along with the premises, revert to the party of the first part. The improvements allowed under the lease agreement are a parking area of approximately 11,150 square feet with parking spaces for no more than fifteen cars. A sediment retention basin will be constructed at the northeast end of the parking area. A 6' x 165' wooden pier with, a 6' x 100' T platform will be constructed into the waters of the Straits. 9. it is distinctly understood and agreed that the party of the second part shall take the premises "as is, where is". That the party of the second part at the end of the lease term agrees to return the land to the party of the first part in as nearly as possible the same condition except for improvements as when received, and that the party of the second part shall not remove any improvements to said premises unless the party of the first part approves. 5. It is understood and agreed that the party of the first part makes no warranties as to title, seisin, encumbrances, pos- session, or use except as provided for in this agreement. 6. The State of North Carolina shall not be responsible for damages to property or injuries to persons which may arise from or be incident to the exercise of the privileges herein granted, or for damages to the property of the party of the sec- ond part, or for damages to the property or injuries to the per- son of the party of the second part's officers, agents, servants, or employees or others who may be on the premises at their invi- tation or the invitation of any one of them, arising from or incident to any governmental activities on the premises, and the party of the second part shall hold the State of North Carolina harmless from any and all such claims. 7. in the event the demised premises or a substantial part thereof, should be damaged by fire or other casualty, the Lessee may terminate this lease agreement or may repair the damage as it determines. 8. The State's interest in the real property conveyed herein shall not be subordinated to any form -of debt, mortgage, or deed of trust without the prior written approval of the party of the first part. 9. The part of the second part shall comply with all fed- eral laws and regulations and with all applicable laws, ordi- nances, and regulations of the State, county and municipality wherein the premises are located and existing and as promulgated throughout the term of the lease with regard to construction, operations, sanitation, licenses or permits to do business and all other matters. I indicated to you that the Board of Commissioners of Carteret County does wish to renew this lease. We would like to request that the State of North Carolina extend the lease to Carteret County for an additional ten (10) year period as allowed under the present lease. If granted the county will continue to maintain and use this property as a public recreational fishing pier site and parking area. Autharlration for County Manager to Approve Change Orders FROM: Russell Overman SUBJECT: Taylor Extended Care Change Order DATE: April S. 2013 The installation of the sprinkler system at Taylor Extended Care is progressing. However as pmjocls like this mow forward we literally uncover unknowns that are not planned for. Vile need for you to approve a change cider for the Sunland. Fire Protection, Inc. contras In the smould of $19,244.00. This is due to a couple of changes Jn scope of the project as wall as assigning budgeted work to Sunland that we originally Inteanded to contract out to others. Unfortunately there maybe others due to sail conditions at the site but we will not know until we receive the moulle of soil testing. In addition we nead for you to approve tha attached budget amendment which takes care of the unfunded pardon of the change order as well as budgeting $15,000 in contingency fund$ that could be needed before the project Is competed. At this time we do not know of any need for these funds. Because of the feet track this project has to take I am also recommending that you give the county manager approval authority for change orders at least to $10,000 which is the amount of contracting authority you have given the manager.
