I am quite concerned about the navigational hindrance resulting from the proposed change in the positioning of the dock at 6069 Martin's Point Road. We would agree to the proposed dock being centered on the property but object to the revised proposal to put it on our side. Our neighbor to the north also has their dock on our side - as you can see clearly on Google Maps. This will result in unusual congestion for us - 3 docks in the tightest area possible. At the least it is a navigation issue, where the most amount of boat traffic is anyway - with all the water skiing, wake boarding, water tubing etc.- given our location on the creek. We are looking for a win -win for all parties and think that a centered dock at 6069 Martin's Point Road would be a fair resolution. We object to the proposal to change the currently permitted plan. DAVIS Director Jack Daugherty 11300 Ridermark Row Columbia, MD 21044 NORTH CAROLINA Environmental Quality January 22, 2020 Re: Objection to the Issuance of a Modification to CAMA General Permit No. 75695-A for a T-Head Pier, Drop Down Platform, and Boatlift Development Project, at 6069 Martins Point Road, Dare County, and on Jean Guite Creek Dear Mr. Daugherty: This letter is in response to your objection as an adjacent riparian property owner to a modification request on a docking facility authorized through CAMA General Permit No. 75695- A at 6069 Martins Point Road, Dare County. I conducted a site visit on January 21, 2020 to evaluate the permit applicant's request. CAMA General Permit No. 75695-A was issued on December 10, 2019 for the construction of a 75' pier with a 16' x 10' platform, a 4' wide drop down platform around the south side of the platform and a 12' x 12' boat lift adjacent to the drop -down platform. The applicant, through their agent, Northeastern Marine, requested to modify CAMA General Permit No. 75695-A to relocate the docking facility to a more northward location and construct the drop -down platform and boatlift on the north side of the main platform. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H.1200. You have notified the Division of Coastal Management of your objections to this proposed development by email. Your objections to this proposed development related to possible interference with navigation to and from your docking facility. The Division has reviewed your objection, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. 15A NCAC 07H .1205 (q) states "Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum setback of 15 feet between any part of the pier and docking facility and the adjacent property lines extended into the water at the points that they intersect the shoreline. After having given careful consideration to your objections to this proposed development, we have determined that it is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued a modification to the existing General Permit No. 75695-A on January 22, 2020 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date.
