Thank you for your thorough email. You are correct in that you are eligible for an emergency permit with no fee
to replace the dock back to its pre -storm dimensions. Heather Styron (copied on this email) is the field
representative for your area and she is much more knowledgeable about notification of riparian property owners
and what to do if the work cannot be completed within the time limits of the General Permit.

Yesterday I found this page about CAMA permitting for rebuilding Florence storm damaged docs (which seems to apply
to our shared community dock here at Bluewater Banks):

So I called the number listed in the document for our area and left a message in the general inbox and then realized that
the number I called was the same as what I have recorded for your work number!
We had already started planning for an eventual rebuild of our community pier because the old one was very tired
already and then the hurricane has forced our hand. As one of the officers for Bluewater Banks, I'm tasked with trying
to help coordinate some of the details of a rebuild and was hoping to get some guidance as to how to correctly navigate
CAMA requirements for our project. Is that something you might be able to help me with, or if not, maybe direct me to
someone else? Thanks!
Here are some of the issues I'm looking to get educated about and guidance for:
I am 99% sure that somewhere there is a permit for our original dock which was built around the time the
neighborhood was first developed by Bluewater Builders. While 1 know how to find some types of real estate
documents via online public searches, I can't seem to figure out how to locate a permit document associated
with this lot. As I understand it (before I moved in here) the original pier was 400 ft long which is about the
current length of the single family residence pier adjacent to ours on our East side and also the point where we
can pretty reliably get into 3-4ft of water. During previous storms the end of the dock was damaged and the
HOA couldn't afford to rebuild it at the time and so decided to repair it just out to its most current distance
(something like 240ft) with hopes of extending it again later. Given that it has been at its current length for
several years, are we still allowed to rebuild out to the original length again per the original permit, or do we
have to do anything special to get permission to do that again at this point?
Our current dock is a typical all wooden dock. We've seen that the few concrete (hog -slat style) residential
docks in our area all fared very well through Florence while at the same time adjacent wood piers around them
all took heavy damage. Although that option is 30-40% more expensive, we think it may be more cost effective
over the long run and more environmentally friendly (less treated wood decking floating around after storms,
less wasted wood needed for re -decking, less clean up needed for and impact to nearby wetlands from washed
up debris). Is it allowed for us to switch to this more resilient construction technique under the emergency
general permit process or would we have to start over with entirely new permitting?
One of our challenges has been to find contractors that can do the work in a timely way (without charging a
huge premium right now since they're all pretty busy). If we were to get the emergency CAMA permit but be
unable to get work completed before the 9/20/19 deadline what are the consequences of that? Is it anything
more significant than just that we'd have to come in and pay the currently waived $200 fee to continue the
permit as a regular permit? Right now for example, we are "in line" with someone who is telling us November
for a rebuild which is a little late - but we're also negotiating with someone else who believes they can do it
sooner. I'm hoping the earlier option works out, but that's not a done deal yet.
Given our project has no dredging involved, just removing aged and damaged piles and then rebuilding in place
of the existing dock, that we don't need to worry about notification of adjacent riparian property owners for this
case correct?
While we don't yet know for certain which builder we will be using, we do have a project scope and description
document that we are using as part of getting bid responses from builder candidates. Do you think I should
come in with that and apply for the permit based on what the planned scope of our project would be, or, do we
need to have very detailed final construction specifics before I do that?
There is the possibility that we may use one crew to do the tear out and haul away of what's left of the existing
dock to remove old pilings and damaged stringers and decking and then use someone else to do the rebuild. As
long as there's no consequences to having that space stand empty for a little while between doing the rest of
that cleanup and when we can get a builder to replace it, we would probably move ahead to do that work soon
to remove it and any hazards that leaving it as -is (even though it's clearly closed) might present. That would also
make it so that when the builder gets going they can just go right into construction (improving our chances of
getting it done sooner). If there are timing rules about how long we have to replace it after a tear out though,
I'd like to be aware of them so we don't accidentally run afoul of them.
The location of the project is Bluewater Banks subdivision, at our marina lot location which is 371 Bay Run. Although
that address is not marked anywhere from the street it's easy to identify, as the last open lot on the sound side of Bay
Run.
I'm guessing it will be easier for you (or anyone else) to have a phone call with me about this so if that's what you
prefer, I'm available today until 2pm (after which I'm coaching volleyball for the afternoon) and also pretty much open
all day tomorrow as well as Friday morning until about 10:30am when I head off to Apex for a statewide playoffs
competition with my high school players.
