RE: Notice of Regulatory Requirement
Dear Mr. Bizzell
This letter confirms that on May 17, 2019, 1 was onsite at your property located at 625 Shadyview Beach
Road adjacent to the Neuse River located in North Harlowe, Craven County, North Carolina. The purpose of
the visit was to investigate unauthorized development by the placement, dumping, and staging of asphalt
rubble material within 65' of the normal water level, which is within the Coastal Shoreline Area of
Environmental Concern.
This correspondence also confirms that NC Coastal Area Management Act (CAMA) General Permit # 73183-
C was issued to you for the replacement of an existing rip rap revetment at 625 Shadyview Beach Road on
November 5, 2018. This authorization expires on September 20, 2019.
Information gathered by me indicates that you apparently propose to utilize this asphalt fill material to repair
the existing shoreline stabilization structure that was displaced and damaged as a result of Hurricane
Florence. 15A NCAC 07H .1105(d) states that, "rip rap revetments shall be constructed of granite, marl,
concrete without exposed rebar, or other suitable materials approved by the Division of Coastal
Management." Please be advised that asphalt is not an approved suitable material for use as shoreline
stabilization.
You are hereby advised that development authorized by State Permit #73183-C is suspended until the
unauthorized asphalt fill material is removed from the Coastal Shoreline Area of Environmental Concern
(AEC). You requested to remove the unauthorized asphalt fill material from the AEC prior to June 3, 2019.
NO WORK MAY PROCEED UNTIL THE FILL MATERIAL IS REMOVED. If you comply voluntarily, no further
action will be necessary beyond restoration of any damaged natural resources protected by the Act (CAMA),
and whatever project modifications are needed to bring your development into compliance with Act and the
issuance of a permit.

Failure to remove the unauthorized asphalt fill material from the AEC or use of this unsuitable fill material in
any AEC after receipt of this Notice may constitute a violation of the Act and you may be subject to civil and/or
criminal penalties as provided by North Carolina General Statute (NCGS) 113A-126. Please notify me once
the unauthorized asphalt fill material has been removed from the AEC so that a site inspection can be made
to determine compliance with the NC Coastal Resources Commission's rules. Once compliance with this
request has been verified, development authorized be State Permit #73183-C may resume.
