Skvarla, III Governor Director Secretary BUFFER AUTHORIZATION CERTIFICATE FOR SHORELINE STABILIZATION A riparian buffer authorization is required for shoreline stabilization activities within the Tar-Pamlico & Neuse River basins per Division of Water Quality (DWQ) regulations 15A NCAC 02B.0259 & 0233. The Division of Coastal Management (DCM) through a Memorandum of Understanding with the Division of Water Quality (DWQ) has reviewed your project proposal and has determined that the project as proposed complies with the aforementioned regulations. Those activities covered by your Coastal Area Management Act (CAMA) permit have received Buffer Authorization as long as the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to comply with this Buffer Authorization may subject the property owner&the party (contractor) performing the construction &/or land clearing to a civil penalty by DWQ of up to $25,000 per day per violation. 1. Impacts: Impacts to woody vegetation from clearing and filling in Zone 1 (begins at the most landward of either the waters edge or the coastal wetland line and extends 30 feet landward) shall be minimized to what must be impacted for the sound installation of the shoreline stabilization project. Unnecessary clearing and filling in the buffer is a violation of the riparian buffer rules. 2. Clearing & Grading: Clearing and grading of Zone 2 (begins at the landward edge of Zone 1 and extends 20 feet landward) is allowed provided that it is re-vegetated immediately and Zone 1 is not compromised, which includes maintaining diffused (non-channelized) flow of storm water runoff through the buffer. 3. Construction Corridors: Construction corridors are allowed for shoreline stabilization projects, but they must be satisfactorily restored as described in condition 5 below. 4. Potential Overwash: For vertical shoreline stabilization projects (bulkheads) only; sites where wave overwash is expected to be severe, the first ten (10) feet landward (unless specifically authorized otherwise by DCM) from the structure may be maintained as a stable lawn in order to provide for structural stability. 5. Temporary Stabilization: Immediately post-construction, bare soils must be stabilized as quickly as possible by providing a temporary ground cover. Newly seeded areas should be protected with mulch and/or erosion matting. This ground cover is a temporary measure used to address erosion until site restoration can be accomplished. 6. Site Restoration: At minimum, pre-project site conditions must be re-established. A site that was wooded prior to this shoreline stabilization project must be restored with woody vegetation at a stem density of 320 stems per acre. Non wooded sites may be re-vegetated with woody vegetation. Restoration must be completed by the first subsequent planting season (November 1 through March 30) after completion of the bulkhead. • Pre-project site conditions: 4✓C12.ANIPS 7. Project Drawing: The drawing on the CAMA General Permit is considered the project drawing of your property indicating the location of the shoreline stabilization structure and any associated clearing, grading, and construction corridors. I (d) This permit shall not be applicable to proposed construction where the Division of Coastal Management has determined, based on an initial review of the application,that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved questions concerning the proposed activity's impact on adjoining properties or on water quality; air quality; coastal wetlands;cultural or historic sites;wildlife; fisheries resources;or public trust rights. (e) This permit shall not eliminate the need to obtain any other required state,local,or federal authorization. (f) Development carried out under this permit shall be consistent with all local requirements,AEC Guidelines,and local land use plans current at the time of authorization. History Note. February I, 2009. 15A NCAC 07H .2405 SPECIFIC CONDITIONS (a) This general permit shall only be applicable along shorelines possessing wetlands, which exhibit an identifiable escarpment. (b) The structure shall be constructed of granite.marl,riprap,concrete without exposed rebar,or other suitable equivalent materials approved by the Division of Coastal Management. (c)The height of the erosion escarpment shall not exceed three feet. (d)The riprap shall be placed immediately waterward of the erosion escarpment. (e)The riprap revetment shall be positioned so as not to exceed a maximum of six feet waterward of the erosion escarpment at any point along its alignment with a slope no flatter than three feet horizontal per one foot vertical and no steeper than one and one half feet horizontal per one foot vertical. (f)The riprap shall be positioned so as not to exceed a maximum of six inches above the elevation of the adjacent wetland substrate or escarpment. (g)Where the Division of Coastal Management determines that insufficient wetland vegetation exists along the permittee's shoreline to provide adequate shoreline stabilization,the permittee shall be required to plant appropriate wetland vegetation landward of the riprap revetment as directed by the Division of Coastal Management. (h)Construction authorized by this general permit will be limited to a maximum length of 500 feet. (i)No backfill or any other fill of wetlands,submerged aquatic vegetation,estuarine waters,public trust areas,or highground areas is authorized by this general permit. (j) No excavation of the shallow water bottom.any wetlands,or high ground is authorized by this general permit. (k) Riprap material used for revetment construction shall be free from loose dirt or any pollutant and be of a size sufficient to prevent its movement from the site by wave action or currents. (l) If the crossing of wetlands with mechanized or non-mechanized construction equipment is necessary, temporary construction mats shall be utilized for the area(s)to be crossed.The temporary mats shall be removed immediately upon completion of construction of the riprap structure. (m)The permittee shall maintain the structure in good condition and in conformance with the terms and conditions of this permit or the remaining riprap revetment shall be removed within 90 days of notification from the Division of Coastal Management.
