Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Lewis, 24 Euclid Ave., Westwood, NJ 07675 Authorizing development in Dare Permit Number 24-18 County at adj. to Pamlico Sound, at 39020 Windy Lane, in Avon , as requested in the permittee's application dated 2/7/18, including attached workplan drawings (2), Sheet 1 dated 1/18/18 and Sheet 2 dated 12/5/17. This permit, issued on April 17, 2018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Breakwater 1) The alignment of the authorized breakwater shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 2) The breakwater alignments authorized under this permit shall approximate the -I ft. contour at normal high-water level at the time of construction. 3) The breakwater shall be constructed with an equal gap between each sheathing board totaling at least one inch of open area for every linear foot of breakwater. The breakwater sections may be staggered and overlap as long as the proposed 10-foot separation between sections is maintained. Overlapping sections shall not overlap more than 10 feet. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Lewis Permit No. 2418 Page 2 of 3 ADDITIONAL CONDITIONS 4) The permitted breakwater shall be constructed of treated wood, plastic lumber, metal or vinyl sheet piles or other suitable materials approved by Department personnel. 5) Each breakwater section shall be marked at each end with yellow reflectors extending at least three feet above normal high water. 6) No backfill of the breakwater or any other filling of wetlands, estuarine waters, public trust areas or high ground is authorized by this permit. 7) Offshore breakwater sections shall be setback 15 feet from the adjoining property lines and the riparian access dividing line. 8) In accordance with commitments made by the permittee, the Estuarine Waters located between the breakwater sections and the existing Coastal Wetlands shall be planted with native Coastal Wetland species, all expressly and specifically detailed in the attached narrative and workplan drawings. This Coastal Wetland planting area should be replanted as necessary and as conditions allow. Pier and Water Access 9) This permit authorizes only the pier, platform and 2 stairs, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this structure without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 10) Any portion of the permitted access pier built over Coastal Wetlands or the restoration area shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darlmess or inclement weather. 12) This permit does not authorize any formalized boat slips. 13) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. ,ey H. Lewis ADDITIONAL CONDITIONS General Permit No. 24-18 Page 3 of 3 16) Any mitigative measures or environmental commitments specifically made by the applicant for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2018-00161). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 18-0024. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project.
