The Division will need the following documentation in order to move forward with permitting of the pier, platforms and walkway on the parcels owned by BB Land Holding LLC and Bermuda Bay Owners Association II: 1) Agent authorization form (copy attached), completed and signed by the Registered Agent of BB Landing, LLC, designating a representative of Bermuda Bay Owners Association II as their authorized agent for the construction of the pier/walkway project, 2) If another person or company, such as the contractor--LSI Marine, will be meeting the Coastal Management representative to obtain and sign the permit on behalf of BB Landing and Bermuda Bay Owners Association, then we will also need an agent authorization form completed and signed confirming that designation as well. 3) It is understood that the walkway crossing the marsh will be limited to 6' in width, and will total approximately 269' in length --with the walkway starting on Parcel #008164244 (owned by BB Landing Holding LLC, and listed as 0 Baileys Bay Road on Dare County tax records), crossing over Parcel #008164804 (owned by Bermuda Bay Owners Association II, and listed as 0 Ocean Bay Blvd on Dare County tax records), and continuing over and in front of Parcel #008164001 (owned by BB Land Holding LLC, and also listed as 0 Ocean Bay Blvd on Dare County tax records). The last drawing that was submitted does not reflect all of the dimensions of the total structure proposed, and was 'not -to -scale'. Submit a to -scaled drawing of the total structure, or verify the dimensions of all sections proposed (i.e. the length of the walkway/pier that connects to the T-head platform, the dimensions of the T-head platform, the dimensions of the steps, lower landing, and floating dock). Condition 07H.1205(p) states that, "Piers and docking facilities shall in no case extend more than 1/4 the width of a natural water body, human -made canal or basin." Onsite measurements should be taken and verified that the location of the pier/platform, as well as the floating dock, shall meet this requirement. Measurements to determine the width of the canal are made from the waterward edge of the coastal wetland vegetation that borders the water body. 4) Proof of riparian notifications must be submitted. The applicant shall provide confirmation that a written statement has been obtained signed by the adjacent riparian property owners indicating that they have no objections to the proposed work; or confirmation that the adjacent riparian property owners have been notified by certified mail/return receipt requested of the proposed work. Purpose and Need of Proiect: The proposed project is to construct a wooden pier/boardwalk to access the waterway for non - motorized recreational purposes. Article II (F) of the Conservation Easement dated 3 April 2007 recorded at book 1725, page 50 of the Dare County Register of Deeds ("the Conservation Easement") allows a boardwalk to be constructed no more than four feet (4') wide. In order to make the proposed boardwalk handicapped accessible for persons with disabilities and to allow for kayaks to be transported across the boardwalk, the Proposer is proposing to construct a pier/boardwalk of six feet (6') in width. B. Proposed Impacts to the Conservation Easement (square feet): Attached is the CAD file in .DWG format for the proposed pier/boardwalk and other renderings of the project. Based on the current layout of the pier/boardwalk, there are 72 linear feet of crossing of the conservation area by the pier construction. The conservation area, itself, is comprised of a total of 134,604 square feet. As a result, 288 square feet of shading in the current easement, or .0023961 of the total square footage of the conservation area at 4 feet wide. If Proposer is allowed to increase the width to 6 feet wide, the shading moves to 432 square feet, or .00320941 of the total square footage of the conservation area. Therefore, the impact to the Conservation Area (over and above what is already allowed in Article II, Section F of the Conservation Easement), is 144 square feet. "Please note there is a small portion of the pier/boardwalk which will also encroach onto a portion of Parcel C, Subdivision of Sunset Bay which property is currently owned by BB Land Holding, LLC. Proposer is currently in the process of negotiating a separate easement over "Parcel C" for the portion of the pier/boardwalk that will cross "Parcel C." C. Proposed Impacts to Mitigation Assets: None. D. Avoidance and Minimization Efforts: Temporary access to the wetlands will be needed to construct the pier/boardwalk. A small excavator which is 6' wide will be used and sit on temporary support pilings (or mats) which are 24" wide x 10' long and placed perpendicular to the pier/boardwalk being constructed. The temporary support mats are made of timber and will be moved as work on the boardwalk/pier progresses. The mats are used so as not to leave tracks in the wetlands themselves by the excavator. The mats leave less impact on the wetlands because is prevents the excavator from sinking into the wetlands. The project will take one (1) month and any disturbed vegetation will recover in the same growing period. The expectation is that little to no actual vegetation would be lost during the project. Actual permanent disturbance of the marsh is by pilings that are .25 square feet each. There are 16 pilings required for construction under either scenario. Total disturbance is therefore is 4 square feet or .00002972of the conservation area. The amount of pilings do not change whether the width of the pier is 4' or 6'. E. The matting referenced in (D) above should result in a very minor footprint from the construction process.
