This is truly why i purchased this property- to be able to have a view of the canal from my backyard and to have the beautiful long view looking westward towards a sunset. l am already boxed in being towards the end of the canal Also concerned that if 1 go to build a dock for my boat in the future- am I and anyone else to the east of 405,Scoter Road going to be able to easily navigate out of the canal with the positioning of this proposed development of a boat house. This letter is in response to your objection as an adjacent riparian property owner to a permit request from Daniel Humphrey for the covered Boathouse with 2 covered platforms at 405 Scoter Rd., Currituck County. I conducted a site visit on August 29, 2019 to evaluate the permit applicant's request. . The permit applicant has requested a permit to construct a 12'x24' boathouse with (2) 6'x24' platforms. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H.1200. You notified the Division of Coastal Management of your objections to this proposed development by electronic mail through Mr. Humphrey's consultant "Beach Bulkheads". Your objection to this proposed development related to the size and location of the boathouse and platforms on the canal in regards to navigation. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. 15A NCAC 07H.1205(E), which states "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 800 square feet". 15A NCAC 07H.1205(P), which states "Piers and docking facilities shall in no case extend more than 1/4 the width of a natural water body, human -made canal or basin. Measurements to determine widths of the water body, human -made canals, or basins shall be made from the waterward edge of any coastal wetland vegetation which borders the water body." Therefore, the Division of Coastal Management issued General Permit No. 75601-A on September 27, 2019 (copy attached) for the proposed development. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date.
