I have been retained on behalf of Ms. Reading to raise these objections and as well provide alternative construction options to Mr. Chapman in lieu of the ones proposed as follows: 1. Objection 1: The description of the proposed "boathouse" states that Mr. Chapman proposes to build a boathouse/lift for a 24' pontoon boat, but is ambiguous in his disclosure as to whether he is actually building a boathouse. Mr. Chapman presently does not own a pontoon boat let alone one 24' long. Pursuant to N.C.A.C. 15A-07H.0208(6)(E) the total square footage of a boathouse enclosing a lift shall not exceed 400 square feet except as to accommodate the actual documented need for a larger boat. Mr. Chapman does not own a boat requiring a boathouse or lift of this size and therefore his proposal must be rejected. 2. Objection IA: The board must reject and deny the application of Mr. Chapman for the installation of ANY boathouse pursuant to N.C.A.C. 15A-07H.0208(6)(D) because pursuant to the chapter, no permit shall be issued allowing the construction of a boathouse without 75' of linear frontage of shoreline. Mr. Chapman's proposed location for the construction of this boathouse only provides him with approximately 49.56' of liner frontage and must be denied. 3. Objection 2: The description of the proposed boathouse dimensions sets out a length and width of said boathouse but does not state a height, or any other descriptive criteria of the proposed structure and therefore its impact upon the use, enjoyment, and rights of the Respondent cannot be adequately judged, and is once again ambiguous. If Mr. Chapman is permitted to build his pier given his purported dimensions, the actual width of his pier at the head will be 20.5' which violates N.C.A.C. Objection 3: The scale of the hand -made drawings provided by Mr. Chapman are severely misleading and do not adequately illustrate the close proximity that presently exists between the Respondent's property and Mr. Chapman's. A properly scaled drawing is attached hereto showing the distances and dimensions of what Mr. Chapman intends to construct and its actual impact of encroachment on the Respondent's use and enjoyment of her own property. (See Exhibit "A") 5. Objection 4: The Respondent regularly navigates sailboats requiring at least 3.5' of water depth, under wind power only, through the adjacent canal depicted that serves as a natural boundary between the two properties. The proposed pier and boathouse will reduce the largest outlet of the canal to a mere 18 yards with only 9.1 yards of navigable water. The Respondent utilizes the deep water of the canal for the purpose of berthing her sail boat to shield it from foul weather and it would be an unreasonable encroachment on the use and enjoyment of her property to restrict her ability to utilize this waterway so that Mr. Chapman can build such a large structure in this location. Pursuant to N.C.A.C. 15A-07H.0208(G)(ii) the proposed pier and boathouse extends into the channel and navigable waterway, and must be denied. In summation, the proposed building plan produced by Mr. Chapman violates North Carolina General Statutes governing the Conservation of Marine and Wildlife Resources, pursuant to N.C.G.S. § 113A-107, 108, 113, and 124 delegated into N.C.A.C. Section 15A-07H.0208(6)(A)(D)-(E), (G)(ii)-(iii). Therefore, Mr. Chapman's application for this permit must be denied pursuant to the referenced statutes and delegated code sections. As an alternative plan, Mr. Chapman could easily remove the planned boathouse, and relocate his proposed pier to the south-eastern corner of that bulkhead and shorten the pier to 38' x Wand angled at approximately 220 degrees from that corner to reduce encroachment. He could then construct a boat lift only, as he does not have enough linier shore frontage for a boathouse, that would create no interference with the navigable waterway, or riparian rights of other landowners. Before any permit is issued, this agency should conduct an onsite survey to determine the impact and encroachment that the petitioner's proposed plan will have on the adjacent lateral property and the detriment it will cause to her use and enjoyment of her own riparian rights. The newly proposed plan seeks to make only a slight/minor modification of the previous application submitted in June of 2019 already noted for objection. The proposal submitted by the Applicant seeks maximize his own use axed enjoyment of his water frontage at the detrimental loss of the adjacent property owner's right to use and enjoyment. There is less than 50' of waterway separating the two (2) properties herein and will result in the loss of Ms. Readings! use and enjoyment of her own shoreline and frontage so that the Applicant can have hs'�s pier and boathouse. Although the pre.6ent proposal does make some slight adjustments to the original one submitted, an onsite study for impact needs to be conducted as well as proper soundings of the navigable waterways before any permit is granted. It is again suggested that if the Applicant wishes to lave his pier and boathouse, and avoid litigation in this matter that he would move; the location of his pier and boathouse to the far end of his bulkhead away from the; property owned by Ms. Reading where there will be minimal to no impact on her riparian rights. As I mentioned in my previous email we have shifted the base of the pier three feet to the left and angled it as you recommended. This should open the area for entering and departing the canal a bit more than in the drawing you provided after our on site meeting. I have attached the response from Mr. Chaney to this a mail. He had no objections. I mailed the documents to Ms. Reading via certified mail with a return receipt request. I am not sure when I will receive the return receipt. I took the angle pier drawing that you provided last week and made an adjustment that would put the pier an additional three feet to the left when you are facing the river. He said he would try to get to it but stated that he was inundated with work. Which, I assume is a good thing. I have attached a picture of a boat house that Mr. White built for a friend of mine earlier this year. Ours will be similar but with a pontoon boat vice a speedboat. hope this will be of some use. The first page was filled in when it was delivered. was not surprised by her reaction yesterday since she told me last weekend she was going do something along these lines but I have no idea what her concern is regarding this matter. One neighbor signed the form without any reservations. However, when I took the form to my second neighbor, without even bothering to look at the document, she informed me that she would not sign anything. She further stated she had a lawyer. After I got her to reluctantly take the document she stated she had 15 days to sign the form. Is this normal? Any guidance would be appreciated. Dear Ms. Reading: This letter is in response to your objection as an adjacent riparian property owner to a permit request from Ronald Chapman for a docking facility at 206 Evergreen Dr., Perquimans County. I conducted a site visit on October 4, 2019 to evaluate the permit applicant's request. The permit applicant has requested a permit to construct a 48'x6' pier with a 27.5'xl4.5' boathouse. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H.1200. You have notified the Division of Coastal Management of your objections to this proposed development through a letter from The East Carolina Law Group received via fax on July 23, 2019 as well as a previous letter received from the Law Group on June 12, 2019. Your objections to this proposed development related to the following: 1) The applicant not owning a boat requiring a boathouse of the proposed size. 2) The length of the applicant's shoreline being less than 75' in relation to the proposed boathouse as per 15 NCAC 07H.1205(1). 3) The provided scale drawings not accurately illustrating the proximity of the boathouse to your property. 4) Potential navigational impacts in regard to your sailboat requiring a water depth of 3.5'. 5) Pier width being greater than 6'. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. Regarding objection #1, CAMA General Permit rules do not require that an applicant must first acquire a vessel prior to permit issuance. The proposed dimensions of the boathouse (398.75 ft2) are less than the maximum allowable area of 400 ft2 as per 15 NCAC 07H.1205(1). . Regarding objection #3, the applicant originally provided a drawing on an aerial photo at a 1"=60' scale, which is accurate for permitting purposes. A second notification was sent using an aerial photo at 1"=30' showing the proposed docking facility angled away from your property, a copy of which is attached. Regarding objection #4, water depths were evaluated by staff and found to be sufficient (>3.5' in depth at Normal Water Level) for ingress/egress into the basin/canal. The applicant has angled the proposed pier and boathouse such that there is adequate room to navigate. Regarding Objection #5, the proposed pier is 6' in width, as per 15A NCAC 07H.1205(d). The proposed boathouse is not considered part of the pier. After having given careful consideration to your objections to this proposed development, we have determined that it is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued General Permit No. 73867-A on October 4, 2019 (copy attached) for the proposed development.
