You need phone numbers and an email address. As to Mr. Plunkett this is the guy that started the whole letter flap. I have sent him several letters for the pier and then several letters for the breakwater with no response. Then after the letter flap the owner then send him one for each again and so did I. Cynthia had me facebook stalking the guy until I had enough. I know more about him than some of my friends. He had some weird heart condition and became disabled and after recovery went on to win a few disabled sailing regattas. Just call me google creep. No more letters I'm Done and I was way way pissed the guy wanted to add on to the damn thing at the end knowing this was where I was headed again. The concrete panels are 5' x 8' then we wrap a 6" timber around the outside. They are all up high and the new platform total with the 6" timber surround would be 187 square feet. See attached. I'm all about making a second attempt or trying to dig up a phone number to help when no one picks up the letter but in this case I'm not wasting another 7.00 in fee's and my time to do it. So set a date and write the permit. The two extra panels (80 s.f. additional) are the least of anyone's worries with this one. Finally was issued a permit with a letter from DEQ. Of course the owner went straight to a lawyer after getting the letter because of how it was written. At that point I sent another letter and the owner sent another one as well - 4 total. - No response. See Cynthia's form letter attached At that point I wrote this letter to Braxton to express my concerns with the letter and inter office guidance. See attached Platform addition During Construction the owner again wanted to make a change to the permit to add additional space to the platform on the end of the pier. Sent a letter - no response This is where we are now. At some point it doesn't take a rocket scientist to tell that after 5 or 6 letters and god knows how much wasted time that he isn't going to pick them up. I already know more about this guy than I do some of my family members from stalking him on the internet. I'll be happy to do what ever the rules state but there has to be a finish line to the process. Due diligence is way too broad a term unless defined. Ron said they were working on a replacement for the letter to help guide folks with a list of things to do should an adjacent property owner not pick up the letter as is this case. I'd say its time. Check off the box's and your done. Maybe have a more rigorous list for major permits where the impact of objections carries way more weight. Remember these are for permittable items that should a neighbor object would most likely still get permitted. Stalking folks on the internet in hopes of finding some contact information is not the answer. Some good will eventually come from this but right now I have a client that needs a permit to finish his project. Your most recent certified mail is for a modification request to a GP that Cynthia had issued (i.e. extending the pier out further with additional platform). To my knowledge, this is the first attempt to notify the riparian property owner of this modification. You have to show due diligence in the notification process for this modification request. Your earlier email stated either issue the permit (modification) or deny it. For clarification, we do not 'deny' general permits (GP). If a project cannot be issued through the GP, we elevate those projects to a major permit. After documenting the attempt to notify through certified mail tracking and the correct address was used through the tax records I come to find out that no longer is a valid attempt to notify as the rules in the CAMA act specify good enough to issue a permit. In one case the representative found a phone number from a previous permit application along with an email address. I did both and finally was able to speak with the neighbor by phone. He told me he traveled a lot and was all good and would send in the notification in a day or so when got back home. He never did. In this situation the representative went ahead with the permit process but issued a form letter to the customer that basically scared the hell out them and they took it to their lawyer. Needless to say I was not prepared for the phone call nor was I able to give advice due to the legal nature of the letter. This cant happen. There has to be a finish line to the notification process. The form letter for all intents and purposes says that until you reach the neighbor you have legal exposure from the neighbor and an unlimited pool of 3rd party unnamed potential claimants. I cant do business this way. There has to be rules that make sense. Another problem is the rules do not state any of this so I cant forward any of this on to the customer and frankly it looks like someone is just making it up as they go along at the administrative level as the rules don't back any of this up. So I guess now as a contractor I'm supposed to be a process server as well, maybe part detective and social media stalker too? How do I allow for this in my overhead costs? Yeah I can sell that. I want to take a moment to go over your guidance and my comments to each Item one. Its common knowledge but maybe it needs to be spelled out in the rules. We use the tax records for the correct address as its all we have that is public record. We send out the notification via certified mail return receipt requested so you can track it as required by law for the 10 day provision. The notice shall instruct adjacent property owners to provide any comments on the pr posed development in writing for consideration by permitting officials to the Division of Coastal Management within f0 days of receipt of the notice and indicate that no respon— will be interpreted as no ot�Lection I like the idea of notifying the registered agent as well in the case of corporations and LLC's and will incorporate that into our process. Probably should be part of the rules as it is public record as well. Item two. Multiple deliveries by USPS. In some cases in rural areas the post man will try a couple of times. In larger areas they just leave a note saying they have a certified package at the post office and it outlines different options for redelivery or they can stop by and pick it up. Staff incorrectly assumes that I as the sender can schedule redelivery and this is incorrect. Those options listed on the tracking site are for the recipient only. Personal information that we do not possess is required to redeliver. The only way to redeliver from my end it to do it all over again and send a second certified letter. Maybe make a second attempt necessary and part of the rules. Item three. This is where it just gets stupid. I'm supposed to get the representative to get up with someone in your office to stalk them on Lexis Nexis? Seriously? Ask to post a notice on site and publish it? Not a bad idea just not in the rules. Where does it end? If these are going to become requirements someone probably needs to get the law amended to reflect that because at this point it doesn't end as per the letter that goes out once someone like me has had enough and demands a permit. Item four. The letter. First paragraph really reads. "Your contractor is lazy and doesn't follow the rules". Second paragraph really reads. "Not really that lazy, just a little. Also we were sued recently and here is our disclaimer and by the way you might have to tear it all out if some unknown to us third parry decides to make a stink. You cant sent letters like this to an owner making good faith efforts to comply with state law. Bottom line is the new guidance presents more problems than it solves. There is no clear cut path to completion of the notification process and it presents an undue hardship to business requiring permitting under the CAMA act. The letter is just scary and has no place in my eyes under the law. You either qualify for a permit or you don't period. Sure anyone can get sued at anytime for anything its part of living in America but it is not the agency's responsibility to educate the citizens on possible litigation. You either grant the permit or tell them why they don't qualify for one. The letter is like a half of a permit. The half that does not matter in court so in reality you are not granting a permit just an opportunity to get sued and loose all your money spent on improvements. I cant sell that. Would you move forward with a pier on your property after getting that in the mail? In closing I would like to say that I love our local staff. We are lucky to have them and in the long run we are lucky to have CAMA dealing with all of the other agencies for obtaining general permits. It makes it a lot easier than in other states to do business and we appreciate that greatly but we have a problem here that needs to be addressed. Almost any objection that is received for a project that meets the guidelines for a general permit fails to stop the project because it actually does meet the guidelines established under the CAMA act. In my experience rarely does an objection have merit with general permits other than creating something for staff to have to explain to the neighbor. Most objections come down to one neighbor just doesn't like the other neighbor. I just don't see the risk or need for the letter and inevitable lawyer intervention due to the letters contents. What we need as business owners is a clear and concise path to obtain a permit. I can see a different more stringent notification path being necessary for major permits but general permit guidelines are outlined in the law word for word. Are more/different types of notification attempts necessary? At this point not by law but maybe there should be but there has to be a finish line that doesn't end up with a scary letter to the owner. Any help you could provide to straighten this mess out would be greatly appreciated. Lots of waterfront land owners just don't pick up certified mail so I don't see the problem going away anytime soon.
