ARTICLE I:
GENERAL PROVISIONS
SECTION 1. STATUTORY AUTHORIZATION:
In pursurant to North Carolina Legislature G.S. 143-215-51
et seq., G.S. 160A-381-392 and G.S. 160A-174-194 the City
Council of the City of Elizabeth City.doe5 ordain the fol-
lowing Flood Plain Ordinance to be effective on March 3, 1975
SECTION 2. PURPOSE AND DECLARATION:
(A) The purpose of this Flood Plain Ordinance is to help
control and minimize the extent of floods within the
designated General Flood Plain District by providing
•
regulations that control artificial obstructions in
floodways, prevent obstructions of water flow which
increase flood heights and damage, and protect those
uses vulnerable to floods so as to:.
(1) Promote the public health, safety and general
welfare of citizens in flood hazards areas.
(2) Protect individuals from buying lands which are
unsuited for intended purposes because of flood
hazards.
(3) Provide for public awareness of flooding potentials.
(4) Control development which will, when acting along
or in combination with similar development, create
an additional burden to the public in flood hazard
relief, investment and disruptions.
(5) Help maintain a stable tax base by preserving

property value for future development within the
Flood Plain Area.
(B) It is hereby declared that within the jurisdiction of
'
Elizabeth City there exists a General Flood Plain Dis-
trict consisting of Knobbs Creek, Charles Creek, Pas-
quotank River and Knobbs Creek Tributary. Within this
district a Floodway District exists, where artificial
obstructions will not be allowed except by Special Per-
mit from the Board of Zoning Adjustment. Within both
the Floodway District and the Floodway Fringe District
•
all uses not allowed as permitted uses, nonconforming
uses, or permissible as Special Permit uses shall be
prohibited.
SECTION 3. DEFINITIONS:
(A) Regulatory Flood: A flood which is representative of
large floods known to have occurred in the area and
reasonably characteristic of what can be expected to
occur on a particular stream. The Regulatory Flood is a
flood of large magnitude that may be expected to occur on
an average of once every one hundred years as is deter-
mined by an analysis of floods in the general region.
(B) Floodcyay: The channel of a stream and those portions of
adjoining land which are necessary to carry and discharge
a Regulatory Flood.
(C) Flood Plain: An area adjoining a river, stream, water
course, lake, or other body of standing water that can be
covered by a Regulatory Flood.
(D) General Flood Plain District: An area consisting of the
Floodway District, but within the General Flood Plain Dis-
trict.
(E) Floodway Fringe District: An area outside the Floodway
District, but within the General Flood Plain District.
(F) Floodway District: That portion of the channel and ad-
joining land of a stream required to provide passage for
a Regulatory Flood without increasing the elevation of
that flood at any point by more than one foot.
(G) Regulatory Flood Protection Elevation: The minimum ele-
vation below which no damageable portion of a structure
may be constructed or to which uses regulated by this
ordinance are required to be elevated or flood proofed.
(H) Stream: A water course that collects surface run off
from an area of one square mile or greater.
(I) Artificial Obstruction: Any obstruction which is not
a natural obstruction, including any which, while not a
significant obstruction in itself, is capable of accumu-
lating debris and thereby reducing the flood carrying
capacity of the stream.
(J) Structures: Anything constructed or erected on the
ground or attached to the ground, including but not
limited to permanent or temporary buildings, factories,
shed, cabins, mobile homes, and other similar uses.

• (K) Natural Obstruction: Any rock, tree, gravel, or
analogous natural matter that is an obstruction and
has been located within the floodway by a non -human
cause.
(L) Standard Project FZood: A flood greater than the
Regulatory Flood that may be expected to occur from the
most severe combination of meterological conditions
considered reasonably characteristic of the Elizabeth
City Area. A standard Project Flood is intended as the
practical expression of the upper limit of flood heights
that are expected to occur.
(M) Special Permits: Permits issued by the Board of Zoning
Adjustment to users in the General Flood Plain District
before certain activities or uses such as filling,
storage, construction or alternative methods of flood
protecting are allowed.
(N) Variance: An allowance or ruling by the Board of Zoning
Adjustment giving authorization for an owner or user
within the General Flood Plain District to vary from the
terms of this Ordinance in certain cases as defined by
Article VI Section 4 (D).
(0) Nonconforming Uses: Any building or use legally existing
. before the passing of this Ordinance which fails to com-
ply with the provisions of this Ordinance.
(P) Buffer Zone: A fifty (50) foot area extending inland
from the Floodway District Boundary and within the Flood -
way Fringe District where structures, fill or storage are
allowed only by Special Permit.

ARTICLE II•
ESTABLISHMENT OF FLOOD PLAIN DISTRICTS
SECTION 1. FINDING OF FACT:
(A) Flood Losses ResuZtinq From Periodic Inundation:
The flood hazard areas of Elizabeth City, North Carolina
are subject to periodic inundation from the Pasquotank
River, Charles Creek, Knobbs Creek, resulting from two
sources: (1) Run off from rainfall over local stream's
drainage basins and (2) Abnormal wind tides in the
Pasquotank River. Of the two, wind tides pose the more
serious problem, adding to the streams' basin flooding.
(B) Methods Used To Analuze FZoodwaus:
The delineation of floodway areas covered by this ordi-
nance is based upon hydraulic demands on the main tribu-
tary streams when river stages are not under the influence
of wind tides as determined by the U.S. Army Corps of
Engineers, Wilmington District, North Carolina. Other
survey information, reports and records supplied by them
provide additional basis for this Ordinance. .
SECTION 2. OFFICIAL FLOOD PLAIN ZONING MAP AND ZONING DISTRICTS:
(A) Establishment of Official Flood PZain Zoni7,kq Map Set:
The Official Flood.Plain Zoning Map Set consisting of 14
- plates) prepared by the U.S. Army Corps of Engineers
,together with all explanatory matters thereof, is hereby
adopted for reference and declared to be part of this
Ordinance. The Official -Flood Plain Zoning Map Set shall
be maintained in the office of City Clerk and Code Admini-
stration Officer for Elizabeth City. The Official Map
Set will reflect any changes or substitutions deemed
necessary by the Board of Zoning Adjustment in conjunction
with other resource information and the U.S. Army Corps
of Engineers.
(B) Application of Ordinance
This Ordinance shall apply to all' lands within the juris-
diction of Elizabeth City including the Extraterritorial
Zoning Jurisdiction Boundary as shown on the Official
• Flood Plain Zoning Map Set and located within the boundaries

of the General Flood Plain District. •
(C) Official Flood Plain Zoning Map Set and District Designations:
The Official Flood Plain Zoning Map Set shall show the
mapped flood hazard areas within the jurisdiction of this
Ordinance and these areas are here by designated as, the
General Flood Plain District. The Official Flood Plain
Zoning Map Set shall show the boundary limits of the Flood -
way which shall be designated the Floodway District. The
boundary limits of a Regulatory Flood shall be shown and
the area between this boundary and the Floodway District
Boundary and shall be designated the Floodway Fringe Dis-
trict. The Control Elevations necessary for the floodway
to pass a Regulatory Flood without an increase in water
level of more than one foot shall at various locations be
shown throughout the General Flood Plain District and be
designated the Regulatory Flood Protection Elevation.
Figure I and II on page 8 illustrate these mapped desig-
nations.
(D) Regulatory Flood Protection Elevation:
The Regulatory Flood Protection Elevation at any location
throughout the General Flood Plain District shall be that
of the nearest Control Elevation point shown on the Offi-
cial Flood Plain Zoning Map Set. (See-rigure 1, page 7).
(E) Rules for District Boundary Interpretation: •
The boundaries of the Floodway District and Floodway Fringe
District shall be determined by scaling distances on the
Official Flood Plain Zoning Map Set. Where interpretation
is needed as to the exact location of the boundaries of
the Floodway Fringe (for example, where there appears to
be a conflict between a mapped boundary and actual field
condition) the Board of Zoning Adjustment shall make the
necessary interpretation. The person contesting the lo-
cation of the district boundary shall present his case
to the Code Administration Officer, who shall pass the
case on to the Planning Commission for recommendations
to the Board of Zoning Adjustment, if he can not resolve
the case. The person contesting the boundary location
shall then be given a reasonable opportunity to present
his case to the Board of Zoning Adjustment and to submit
his own technical evidence by a licensed surveyor if he
so desires.
(F) Rules For Regulatory Flood Protection Elevation Interpretation:
If there is a problem of determining the Regulatory
Flood Protection Elevation for a particulan location,
then at the request of an applicant and after payment by
the applicant of a fee of twenty five (25) dollars to
cover the cost of field work, the City Engineer may
determine the Regulatory Flood Protection Elevation for •

a given location. If there is a disput over the ele-
vation the applicant may take the case before the Board
of Zoning Adjustment and be given the opportunity to
present his own technical evidence.
(G) Warning and DiscZaimer of Liability
The degree of flood protection required by this Ordinance
is considered reasonable for regulatory purposes and is
based on engineering and scientific methods of study
taking into account a Regulatory Flood. A Standard Pro-
ject Flood may occur or flood heights may be increased by
man-made or natural causes, such as wave action, tidal
storms and bridge openings restricted by debris. This
Ordinance does not imply that areas outside the General
Flood Plain District boundaries or land uses permitted
within such district will be free from flooding or flood
damages. This Ordinance shall not create liability on
the part of Elizabeth City or any officer or employee
thereof for any flood damages that result from reliance
on this Ordinance or any administrative decision lawfully
made thereunder.
(H) Seyerability.
If any section, clause, provision or portion of this
Ordinance is judged unconstitutional or invalid by a
Court of competent jurisdiction, the remainder of this
• Ordinance shall not be affected.
(I) Amendments:
The regulation, restrictions, and boundaries set forth
in this Ordinance may from time to time be amended,
supplemented, changed or repealed by the City Council;
however, no such action may be taken until after a review
by the Planning Commission and a public hearing has been
held at which time interested parties and citizens shall
have an opportunity to be heard. At least 15 days notice
of the time and place of such hearing shall be published
in a newspaper of general circulation in the City of
Elizabeth City.

FLOOD PLAIN DISTRICT REGULATIONS
SECTION 1. PROVISIONS APPLYING TO THE GENERAL FLOOD PLAIN DISTRICT:
(A) Permitted Uses:
The following uses may be made of the General Flood Plain
District as a matter of right without a Special Permit
provided they are not prohibited by any other ordinance,
do not have any special requirements or restrictions placed
on them within the Floodway District or Floodway Fringe
District of this Ordinance, and are compatible with uses
in the adjoining zoning district.
(1) General farming, pasture, outdoor plant nurseries,
horticulture, forestry, wildlife sanctuary, game
farm, and other similar agricultural, wildlife and
related uses.
• (2) Loading areas, parking areas, rotary aircraft ports,
and other similar industrial -commercial uses.
(3) Lawns, gardens, parking, play areas, and other
similar uses..
(4) Golf courses, tennis courts, driving ranges, archery
ranges, picnic grounds, parks, swimming pools, hiking
or horseback riding trails, open space and other
similar private and public recreational uses.
(5) Streets, bridges, overhead utility lines, railway
lines, and rights -of -way, creek and storm drainage
facilities, sewage or waste treatment plant outlets,
water supply intake structures, and other similar
public utility uses.
(6) Temporary facilities (not to exceed 90 days), such
as displays, circuses, carnivals, or similar tran-
sient amusement enterprises. (Temporary Certificate
of Zoning Compliance to be issued by Code Adminis-
tration Officer.)
(7) Boat docks, ramps, piers, or similar structures.
(B) Other Uses Permitted:
Other uses permitted by the Elizabeth City Zoning Ordi-
nance are allowed provided they meet the special require-
ments and restrictions for the Floodway District and
Floodway Fringe District, and provided they are not

prohibited by any other ordinance and are compatible
with uses in adjoining Zoning Districts
(C) Uses Permitted With Restrictions:
A fifty (50) foot Buffer Zone extending inland from the
Floodway District Boundary along a stream or river bank
and within the Floodway Fringe District adjoining the
Floodway District is established where structures, fill
or storage will be permitted only by Special Permit as
indicated in Article III, Section 2 (B) and Article V.
(D) Uses Not Permitted:
No use shall be constructed or created which will
adversely effect the capacity of channels or natural
drainage or any tributary to the main stream, floodway,
drainage ditch or any other drainage facility or system.
SECTION 2. PROVISIONS APPLYING TO THE FLOODWAY DISTRICT OF THE GENERAL
FLOOD PLAIN DISTRICT:
(A) All Uses listed in Section l (A) of Article III are
permitted by right provided they do not require structures,
fill or storage of materials.
(B) Special Permit Uses:
No artificial obstruction including structures (temporary
or permanent), fill, storage of material and equipment or •
other use will be permitted in the Floodway District if
when acting alone or in combination with existing or rea-
sonably anticipated uses, impairs the efficiency or the
capacity of the floodway or increases flood heights. Uses
involving structures, fill, storage or any other obstruc-
tion may be permitted only upon application to the Code
Administration Officer for a Special Permit, and the
issuance of a Special Permit by the Board of Zoning Adjust-
ment. In issuing Special Permits, the Board shall consider
the effects of the proposed use in creating danger to life
and property by (1) water which may be backed up or diverted
by such obstruction; (2) the danger that the obstruction
will be swept down stream to the injury of others; and
(3) the injury or damage at the site of the obstruction
itself. Special Permit uses shall be subject to the regu-
lations in Article V and the following standards:
(1) Any proposed fill which encroaches upon the floodway
must be shown to have some beneficial purpose and pro-
vide sufficient preservation of flow capacity. In
addition, the amount to fill cannot be greater than is
necessary to achieve the designated purpose. The pro-
posed fill must be delineated by a registered engineer's
plan submitted by the owner which shows the beneficial
uses to which the filled land will be put, the final
dimensions of the proposed land fill or other material •

• and the anticipated effect on the floodway water
handling characteristics and capacity. Such fill
or other material shall be protected against erosion
by rip -rap, vegetation cover, or bulkheading.
(2) Structures shall not be designed for human habita-
tion and shall have.a low flood damage potential.
The structure(s) if permitted, shall be constructed
and placed on a building site so as to offer minimum
obstruction to the flow of flood waters. In addi-
tion, the following standards` shall apply:
(a) Whenever possible, structures shall be con-
structed with the longitudinal axis parallel
to the direction of flood flow.
(b) So far as practical structures shall be placed
approximately on the same flood flow lines as
those of adjoining structures.
(c) Structures shall be firmly anchored to prevent
flotation which may result in damage to other
structures, restriction of bridge openings
and other narrow sections of the stream or
river.
(d) Service facilities such as electrical and
heating equipment.shall be constructed at or
above the Regulatory Flood Protection Elevation
for the particular area or shall be flood
• proofed as described in Article V, Section 2.
(3) Storage of material or equipment:
a The storage or processing of materials that
in time of flooding are buoyant, flammable,
explosive or could be injurious to human,
animal or plantlife is prohibited.
(b) Storage of other materials or equipment may
be allowed upon issuance of a Special Permit
if not subject to major damage by floods and
provided the materials or equipment are firmly
anchored to prevent flotation or readily re-
movable from the area within the time available
after flood warning.
SECTION 3. PROVISIONS APPLYING TO THE FLOODWAY FRINGE DISTRICT OF THE
GENERAL FLOOD PLAIN DISTRICT:
(A) Permitted Uses:
Uses listed in Section 1 of Article III as permitted
uses are allowed.
(B) Uses Permitted With Restrictions:
All uses permitted by the Elizabeth City Zoning Ordinance
shall be permitted within the Floodway Fringe District
• provided they are not prohibited by any other ordinance
and they meet the following standards: •
(1) No damageable,portion.of a structure shall be below
the Regulatory Flood Protection.Elevation.
(2) All structures must be firmly anchored.
(3) All fill for the elevation of structures or other-
wise shall require a Special Permit as indicated
in Article IIJ, Section 2 (B,1) unless approved by
the Code Administration Officer.
(4) All residences and all other structures, except
those as defined in Article 111, Section 3, Sub-
section B (7), shall be constructed on fill or ele-
vated on piling or other substructure with the bottom
portion of the first floor framing at or above the
Regulatory Flood Protection Elevation. Basements
shall be flood proofed to above the regulatory flood
protection elevation with access either above the
Regulatory Flood Protection Elevation or properly
flood proofed.
(5) If the first floor framing or structure is to be
placed directly on fill, without substructure, then
this fill shall be to an elevation no lower than
the Regulatory Flood Protection Elevation. All fill
shall extend at least 15 feet beyond the limits of
any structure or building erected thereon. Except
where supported by bulkheads, or similar structures,
side slopes of fill shall be no steeper than 2 hori-
zontal to 1 vertical and shall be protected against •
erosion by rip -rap or vegetation cover.
(6) New or replacement water supply systems and/or
sanitary sewage systems for uses within the Floodway
Fringe District shall be designed to minimize or
eliminate infiltration of flood waters into the
systems into the floodwaters, and on -site waste
disposal systems shall be located so as to avoid
impairment or contamination during flooding:
(7) Uses not subject to substantial flood damage, not
causing flood damage to other lands nor hazardous
to public health may be allowed and at an elevation
below the Regulatory Flood Protection Elevation
subject to issuance of a Zoning Permit or Certi-
ficate of Zoning Compliance by the Code Admini-
stration Officer.
(8) Service facilities such as electrical and heating
equipment shall be constructed at or above the
Regulatory Flood Protection Elevation for the
particular area or be adequately flood proofed
as described by Article V, Section 2 (A).

• (C) Special Permit Uses:
The Board of Zoning Adjustment shall decide on Special
Permits for uses that cannot comply with Section 3 (B).
(1) All proposed fill within the Floodway Fringe
District shall require a Special Permit unless
approved by the Code Administration Officer. If
a Special Permit is required then it shall conform
to the requirements of Article III, Section 2 (B,l)
and Article V.
(2) A fifty (50) foot Buffer Zone adjoining the Flood -
way District Boundary is established where struc-
tures, fill or storage will be permitted only by
Special Permit.
(3) Structures including residences shall ordinarily
be elevated by fill or substructures as provided
in Section 3, Article III, but in special circum-
stances may be granted a Special Permit to be
flood proofed to the Regulatory Flood Protection
Elevation as provided in Section 2 (A,5) of Article V.
SECTION 4. SPECIAL RESTRICTIONS APPLICABLE TO NAVIGABLE WATERS, STREAM
BANKS AND THE FLOODWAY DISTRICT:
(A) Uses Or Work Subject To SpeciaZ Permit Requirement:
A Special Permit issued by the Board of Zoning Adjust-
ment may be required for the following work or uses:
(1) Erection, construction or alteration of any flood
or erosion control works and structures in navi-
gable water or the Floodway District.
(2) Removal, alteration or construction of natural or
other river bank protective barriers and bulkheads.
(3) Grading, filling, excavating, dredging and bulk -
heading of any land or water subject to applicable
local, State and Federal regulations.
(B) Procedure For Determining SpeciaZ Permit Applicability:
In order to determine the applicability of requiring a
Special Permit the developer or land owner must make
application for any proposed work as defined in Article
III, Section 4 (A) above in the form of a plan and infor-
mation submitted to the Code Administration Officer and
Planning Commission. This plan and information shall
consist of the following:_
(1) The location of the contemplated structure or work
in conjunction with adjoining lands, waters and
channels.
(2) The specification details and cost of the proposed
work.
(3) If necessary other studies such as topographic,
engineering or geologic to show the strength and
distribution of existing and proposed soils or
• protective barriers.

(4) Rationale or criteria. •
All plans and specifications except for residential piers,
bulkheads, and seawalls shall be prepared by an engineer.
(C) Determination of Special Permit Requirement:
(1) The Planning Commission and Code Administration
Officer shall determine the applicability of requir-.
ing a Special Permit based upon:
a) Effect on flood protection by the altering or
constructing of a protective barrier.
b) Ability of and assurance from the land owner
to construct a protective barrier which will
afford an equal or greater degree of wind, wave
and flood protection as the existing barrier.
c) Potential effect of the proposed work, structure,
removal or construction to seriously disturb
damage or cause river or upland erosion or
interfere with natural drainage.
(2) If the Planning Commission and Code Administration
Officer determine that a Special Permit is not re-
quired and the proposed activity is in compliance
with this Ordinance, the Elizabeth City Zoning
Ordinance, or any applicable State or Federal Regu-
lations, then the Code Administration Officer shall
issue a Certificate of Zoning Compliance. However,
if the work is not executed in accordance with the •
approved plan or.not executed within a reasonable
time, the work may be subject to approval or denied
by the Board of Zoning Adjustment.
(3) If the Planning Commission determines a Special
Permit is required, then the case shall be recom-
mended to the Board of Zoning Adjustment for passing
on a Special Permit or Variance. The Board of
Zoning Adjustment may approve Special Permits or
allow a Variance subject to conditions set forth in
Article V, and Article VI Section 4 (D). The
Board of Zoning Adjustment may require the developer
to post a bond to assure that the proposed work or
protective measures are carried out as planned.
(D) Other Necessary State and Federal Requirements:
The applicant must also obtain all necessary State and
Federal approvals where applicable before construction of
the proposed work. The U.S. Army Corps of Engineers have
complete jurisdiction over navigable waters and banks
thereof up to the mean high water level. A permit must
be issued from them for construction, alteration, removal
or other related use involving navigable waters and associ-
ated,banks.

• (E) Special Regulations AppZyinq To Abandoned Boats In The
FZoodway District:
•

Any Boat which could create or has created an obstruction
to water flow in the floodway district will not be per-
mitted to be abandoned or left to become potential
sunken obstructions. Any existing abandoned boat or
wreck may be required to be removed at the owner's
expense.

0 ARTICLE IV.
NONCONFORMING USES
SECTION 1. NONCONFORMING USES WITHIN THE GENERAL FLOOD PLAIN DISTRICT:
(A) Continuation of Existing Uses:
All nonconforming uses, as defined in Article 1, Section
3, may be continued subject to the following conditions:
(1) No such use shall be reconstructed, expanded,
changed, enlarged, or altered in any way which
increases its nonconformity to this Ordinance.
(2) Nonconforming buildings or uses may not be enlarged
unless such enlargement is accomplished in con-
formance with the provisions of this Ordinance.
(B) Flood Hazard Nuisances:
Uses or adjuncts thereof which are or have become signi-
ficantly damageable by floods, could significantly
accelerate flooding potential or could contribute signi-
ficantly to flood damage to other property shall not be
entitled to continue as nonconforming uses and may be
required to be removed or conform to the regulations of
this Ordinance.
(C) Increase of Flood Damage Potentials:
Any alteration, addition, or repair to a nonconforming
structure which would substantially increase its flood
damage potential shall be in accord with the requirements
of Section 2, Article V, Article III, Section 2,
Section 3 and other applicable provision of this Ordinance.
(D) List of Nonconforminq Uses Which Are Protected:
The Code Administration Officer shall prepare a list of
_ those nonconforming uses which have been flood proofed
or otherwise adequately protected in conformity with
this Ordinance. He may issue a certificate of Zoning
Compliance to the owner stating that such uses, as a
result of these corrective measures, are in conformity
with the provisions of this Ordinance.
(E) SpeciaZ Permit Uses:
Except as provided in Subsection B of Section 1, Article
IV any use which has been permitted by a Special Permit
. shall be considered a conforming use.

SECTION 2. SPECIAL RESTRICTIONS ON NONCONFORMING USES WITHIN FLOODWAY
FRINGE DISTRICT AND FLOODWAY DISTRICT:
(A) Discontinued Uses Within The FZoodwa Frin e District:
If a use is discontinued for twelve 12 consecutive
months within the Floodway Fringe District, any future
use of the building or site may be subject to the
approval or denial by the Board of Zoning Adjustment.
Future use will be limited to a use permitted by the
Elizabeth City Zoning Ordinance or this Ordinance,
which ever is more applicable. If the Code Administration
Officer is furnished proof by the applicant and is
satisfied that the future use will not be subject to
flood damage or cause damage to other property in times
of flooding, then the use will be allowed and will not
require the Board of Zoning Adjustment approval.
(B) Discontinued Uses Within The Floodway District:
If a use is discontinued for a period of six (6) conse-
cutive months within the Floodway District, any future
use or building shall conform to this Ordinance and re-
quirements of Article III, Section 2.
(C) Repair of Structures In The General Flood Plain District:
•
Nothing in this Article shall prevent the repair or recon-
struction of a building or structure existing and in use
on the effective date of this Ordinance and located •
totally or partially within the General Flood Plain
District, provided that:
(1) The bulk of the building or structure below the
Regulatory Flood Protection Elevation in the Flood -
way District is not increased.
(2) Such repair or reconstruction meets all of the
requirements of this Ordinance.
ARTICLE V:
SPECIAL PERMITS
SECTION 1. APPLICATION REQUIREMENTS:
(A) Procedure:
All uses listed in this Ordinance as requiring a
Special Permit will be allowed only upon application to
the Code Administration Officer and issuance of a
Special Permit by the Board of Zoning Adjustment. Upon
receipt of an application the Code Administration
Officer shall present the application along with any
required information to the Planning Commission for
recommendations to the Board of Zoning Adjustment.
The Board of Zoning Adjustment shall make the final
decision on an application.
• (B) Requirements:
The applicant shall submit to the Code Administration
Officer the following information prepared by a regis-
tered engineer or licensed surveyor:
(1) Plans (7 copies) drawn to scale showing the nature,
location, dimensions, and elevation of the lot,
existing and proposed structures, fill, storage
of materials, flood proofing measures and the re-
lationship of the above to the location of the
stream channel, Floodway District, Regulatory
Flood Protection Elevation and surrounding uses.
Additional copies may be requested as needed.
0
(C) AdditionaL Requirements:
Where special circumstances necessitate more detailed
information, the applicant shall furnish such of the
following additional information as is deemed necessary
by the Planning Commission, Code Administration Officer
or Board of Zoning Adjustment for the evaluation of
the effects of the proposed use upon flood flows:
(1) A typical cross section showing the channel of
stream, elevation of land areas adjoining each
side of the channel, cross -sectional areas to be
occupied by the proposed development, and high
water information.

(2) Plan (surface view) showing elevations or contours •
of the ground; size, location and spatial arrange-
ment of all proposed and existing structures on
the site; location and elevation of streets, water
supply, sanitary facilities, photographs showing
existing land uses and vegetation upstream and
downstream, soil type, and other pertinent infor-
mation.
(3) Profile showing the slope of the bottom of the
channel or flow line of the stream.
(4) Specifications for building construction and
materials, flood proofing, filling, dredging,
grading, channel improvement, storage or materials,
water supply, and sanitary facilities.
(5) Additional information as may be required.
(D) Evaluation:
1 The Code Administration Officer, Planning Commission
or Board of Zoning Adjustment may request expert
technical assistance in evaluating the proposed
project in relation to flood heights and velocities,
the seriousness of flood damage to the use, the
adequacy of the plans for protection, flood hazard
potential, effect on the floodway capability to dis-
charge waters in times of a flood or high water and
other technical matters. Sufficient time (but not
more than 90 days) shall be granted to the Code •
Administration Officer and Planning Commission for
detailed evaluation and recommendations to the
Board of Adjustment.
(2) Based upon the evaluation by the Code Administration
Officer, recommendation of Planning Commission and
analysis by a designated engineer or expert, the
Board of Zoning Adjustment shall determine the
specific flood hazard at the site and shall evaluate
the suitability of the proposed use in relation to
the flood hazard. A decision will be made as to
the acceptance or denial of the use, and a Special
Permit shall be issued if the proposed use is
accepted.
SECTION 2: CONDITIONS ATTACHED TO. SPECIAL PERMITS:
(A) SpeeiaZ Conditions:
Upon consideration of the factors listed above and the
purposes of this Ordinance, the Board of Zoning Adjust-
ment may attach such conditions to the granting of a
Special Permit as it deems necessary to further the pur-
poses of this Ordinance. Among guch conditions without
limitation because of specific enumeration which may be
included are:

• (1) Modification of waste disposal and water supply
facilities.
(2) Limitations on periods of use and operation.
(3) Imposition of operational controls, sureties, and
deed restrictions.
(4) Requirements for construction of channel,modi-
fications, dikes, levees, and other protective
measures.
(5) Flood proofing measures such as the following shall
be designed consistent with the flood pro-
tection elevation for the particular area, flood
velocities, durations, rate of rise, hydrostatic
and hydrodynamic forces, and other factors associ-
ated with a Regulatory Flood. The Board of Zoning
Adjustment shall require that the applicant sub-
mit a plan or document certified by a registered
professional engineer that the flood proofing
measures are consistent with the Regulatory Flood
Protection Elevation and associated flood factors
for the particular area. The following flood
proofing measures may be required without limi-
tation because of specific enumeration:]
(a) Anchorage to resist flotation and lateral
movement.
(b) Reinforcement of walls to resist water pres-
sures.
• (c) Installation of watertight doors, bulkheads,
and shutters, or similar methods of construc-
tion.
(d) Use of paints, membranes, or mortars to re-
duce seepage of water through walls.
(e) Addition of mass or weight to structures to
resist flotation.
(f) Installation of pumps to lower water levels
in structures.
(g) Construction of water supply and waste -treat-
ment systems so as to prevent the entrance
of flood waters.
(h) Installation of pumping facilities or com-
parable practices for subsurface drainage
systems as buildings to relieve external
foundation wall and basement flood pressures.
(i) Construction to resist rupture or collapse
caused by water pressure or floating debris.
(j) Installation of valves or controls on sani-
tary and storm drains which will permit the
drains to be closed to prevent back-up of
sewage and storm waters into the buildings
or structures. Gravity draining of basements
may be eliminated by mechanical devices.
• 1 Recommendations for special flood proofing methods can be found in
Flood Proofing Regulations, through the office of the Chief of Engineers,
U.S. Army, Washington, D.C., and on file with the Code Administration
Officer. These methods have also been adopted by the State Building Codes.
(1) Location of all electrical equipment, circuits,
and installed electrical applicances in a •
manner which will assure they are not subject
to flooding and to provide protection from
inundation by a Regulatory Flood.
(1) Location of any structural storage facilities
for chemicals, explosives, buoyant materials,
flammable liquids, or other toxic materials,
which could be hazardous to public health,
safety, and welfare in a manner which will
assure that the facilities are situated at
elevation above the height assoicated with
the Regulatory Flood Protection Elevation or
are adequately flood proofed to present flo-
tation of storage containers, or damage to stor-
age containers which could result in the escape
of toxic materials into flood waters.

ARTICLE VI:
,ADMINISTRATION AND ENFORCEMENT
SECTION 1. REGULATORY MEASURES AND ALLOWANCES
(A) Certificate of Zoning CompZiance:
A certificate of Zoning Compliance issued by the Code
Administration Officer shall be secured prior to the
use of any building, structure, or land; and prior to
the change or extension of a nonconforming use with-
in the scope of this Ordinance.
(1) Application for Certificate of Compliance and/or
Building Permit shall be made to the Code Admini-
stration Officer on forms furnished by him and
shall require the following where applicable:
plans drawn to scale showing the nature, location,
• dimensions and any existing or proposed elevations
of a lot, structures, fill, storage of materials
and the location of the foregoing in relation to
the Floodway District or Floodway Fringe District,
and the Regulatory Flood Protection Elevation.
Any existing or proposed elevations shall be tied
to the City Datum, United States Geological Survey
Benchmark or Corps of Engineers Elevation Datum.
(2) It shall be unlawful to use or occupy or to permit
the use or occupancy of any building or premises,
or both, or part thereof hereafter created, erected,
changed, converted, or wholly or partly altered
or enlarged in its use or structure until a Cer-
tificate of Zoning Compliance has been issued by
the Code Administration Officer stating that the
use of the building or land conforms to the re-
quirements of the Flood Plain Ordinance. No non-
conforming structure or use shall be used after
substantial alterationuntil a Certificate of
Zoning Compliance has been issued by the Code
Administration Officer. The Certificate of Zoning
Compliance shall state specifically the particulars,
if any, in which the nonconforming structure or
use differs from the provisions of this Ordinance.
(B) SpeciaZ Permits
• A Special Permit for certain uses as designated in
Article III may be granted within the Floodway District
W
and Floodway Fringe District by the Board of Zoning •
Adjustment as provided for in Article V of this
Ordinance.
(C) Variances:
The Board of Zoning Adjustment may authorize upon appeal
in specific cases such Variance from the terms of this
Ordinance as designated in Section 4 (D) of this article.
(D) Construction and Use:
Construction and Use as provided in the Certificate of
Compliance, Building Permit or Special Permit issued
on the basis of approved plans or applications authorize
only the use, arrangement, and construction set forth
in such approved plans or applications; and no other
use, arrangement, or construction. Use, arrangement, or
construction at variance with that authorized shall be
deemed a violation of this Ordinance. The applicant may
be required to submit certification by a registered
professional Engineer or Architect that the finished fill
and building flood elevation, flood proofing, or other
flood protection measures were accomplished in compliance
with the provisions of this Ordinance.
SECTION 2. DUTIES OF THE CODE ADMINISTRATION OFFICER
(A) Designation and Res onsibitities: •
1 The Code Administration Officer as designated by the
City of Elizabeth City shall -administer and enforce
this Ordinance. If he finds a violation of the pro-
visions of this Ordinance, he shall notify the person
responsible for such violation, indicating the nature
of the violation, and ordering the action necessary
to correct it.
(2) The Code Administration Officer will also be respon-
sible for receiving applications for Variances,
Appeals and Special Permits. Upon review of the
application he shall review the application and any
required information. After review, the application
shall be presented to the Planning Commission for
review and recommendations to the Board of Zoning
Adjustment.
(3) The Code Administration Officer shall be authorized
to issue a Certificate of Zoning Compliance for
those uses which conform to this Ordinance.
SECTION 3. DUTIES OF THE PLANNING COMMISSION
(A) Powers of the Planning Conrnission:-
The Planning Commission as established by the City Council
of Elizabeth City shall review with the Code Administration
Officer and make recommendations to the Board of Zoning •
Adjustment concerning the following applications:

(1) Application for Special Permit.
(2) Appeals in regards to Floodway District of Flood -
way Fringe District boundary interpretation and
Regulatory Flood Protection Elevation.
(3) Application for Variance to the regulations con-
tained within this Ordinance.
(B) The Planning Board shall forward the application for an
Appeal, Variance or Special Permit along with a recom-
mendation to the Board of Zoning Adjustment.
SECTION 4. DUTIES OF THE BOARD OF ZONING ADJUSTMENT
(A) Powers of the Board of Zoning Adjustment:
The Board of Zoning Adjustment as authorized by the
City Council of Elizabeth City in the Zoning Ordinance
for Elizabeth City, North Carolina shall hear and decide
upon:
(1) Appeals in regards to the enforcement or admini-
stration of this Ordinance.
(2) Application for a Special Permit required by this
Ordinance.
(3) Application for a Variance or special exception to
this Ordinance.
(B) Appeals:
• An Appeal over a decision by the Code Amini.stration
Officer can be filed with the Board of Zoning Adjustment.
Any decision of the Board of Zoning Adjustment may be
appealed by any person or persons, to the Superior Court
of Pasquotank County, North Carolina, with the right of
jury trial at the election of the party seeking review.
The time and manner of election of a jury trial shall
be governed by G.S. IA.-1, Rule 38 (b) of the Rules
of Civil Procedure.
(C) Speciat Permits:
A Special Permit may be granted within the Floodway
District and Floodway Fringe District by the Board of
Zoning Adjustment as provided for in Article V of this
Ordinance provided sufficient evidence is presented that
the structure will be protected by flood proofing or
other means to the Regulatory Flood Protection Elevation.
The Board of Zoning Adjustment shall give consideration
to the criteria listed in Article V and reasonable con-
ditions may be attached to a Special Permit as outlined
in Article V, Section 2. No other Special Permit shall
be permitted pursuant to this Ordinance.
(D) Variances:
The Board of Adjustment shall authorize upon appeal in
specific cases such Variance from the terms of this
is Ordinance as will not be contrary to the public interest,

where owing to special conditions a literal enforcement •
of the provisions of the Ordinance will result in unneces-
sary hardship and so that the spirit of this Ordinance
shall be observed and substantial justice done. No
Variance shall have the effect of allowing in any district
uses prohibited in that district, permit a lower degree
of flood protection elevation for the particular areas,
or permit standards lower.than those required by State
Law. Specific plans and other information may be requested
from the applicant as required by Article V, Section 1
(B,C)•
(E) Fee
A fee of fifteen (15) dollars shall be paid to Elizabeth
City, North Carolina, for each application for a Special
Permit, Appeal or Variance to cover the necessary admini-
stration costs and advertising for a public hearing.
SECTI01i 5. PUBLIC HEARING AND DECISIONS BY THE BOARD OF ZONING ADJUSTMENT
(A) Public Hearing:
Upon the filing with the Board of Zoning Adjustment
of an Appeal from a decision of the Code Administration
Officer, an application for a Special Permit or an
application for a Variance, the Board of Zoning
Adjustment shall hold a public hearing. The Board .
of Zoning Adjustment shall fix a reasonable time for
the hearing and give a public notice thereof, as
well as due notice to parties of interest. At the
hearing, any part may appear in person or by attor-
ney and present written and oral evidence for the
record. The written transcript, if presented to
the Board of Zoning Adjustment by the applicant,
shall be a part of the record.
(B) Decision
The Board of Zoning Adjustment shall arrive at a decision
on such Appeal, Special Permit, or Variance within 90
days of receiving the application and necessary infor-
mation. In passing upon an Appeal, the Board of Zoning
Adjustment may, so long as such action is in conformity
with the provisions of this Ordinance, reverse or affirm,
wholly or in part or modify the order, requirements, de-
cision, or determination appealed from, and it shall
make its decision, in writing, setting forth the find-
ings of fact and the reasons for its decision. In grant-
ing a Special Permit or Variance, the Board of Zoning
Adjustment may prescribe appropriate conditions and safe-
guards, in addition to those specified in Section 2 of
Article V which are in conformity with.the purposes of
this Ordinance. Violations of such conditions and safe-
guards, when made a part of the terms under wh-ich the •

• Special Permit or Variance is granted, shall be deemed
a violation of this Ordinance punishable under Section 7.
SECTION 6. MATTERS TO BE CONSIDERED IN PASSING UPON. APPLICATION
(A) Factors to Consider:
In passing upon Appeals, Special Permit or Variances
the Planning Commission and Board of Zoning Adjustment
may consider the following factors although not limited
to such factors:
(1) The project as proposed does not represent danger
to life and property due to increased flood heights
or velocities caused by encroachments.
(2) The project as proposed does not represent the
danger that materials may be swept on to other
lands or downstream to the injury of others.
(3) The proposed water supply and sanitation systems
and the ability.of these systems to prevent disease,
contamination and unsanitary conditions has been
reviewed by the District Health Department.
(4) The susceptibility of the proposed facility and
its contents to flood damage and the effect of
such damage on the individual owner has been
adequately reviewed by the Code Administration
Officer.
• (5) The importance of the services provided by the
proposed facility to the community.
(6) The requirements of the facility for a water-
front location.
(7) The availability of alternative locations not
subject to flooding for the proposed use.
(8) The compatibility of the proposed use with
existing development and development anticipated
in the foreseeable future.
(9) The relationship of the proposed use to the Com-
prehensive Plan and any Flood Plain Management
for the area.
(10) The safety access to the property in times of
flood for ordinary and emergency vehicles.
(11) The expected heights, velocity, duration, rate
of rise and sediment transport of the flood waters
expected at the site.
.(12) Such other factors which are relevant to the pur-
poses of this Ordinance.
SECTION 7. PENALTIES AND GREATER RESTRICTIONS
(A) Violation and Penalties:
Any violation of this Ordinance, or of the provisions
of any permit issued under the authority of this Ordi-
nance, shall constitute a misdemeanor. Punishment shall
be at the discretion of the courts. Any enlargement,
construction or replacement which violates this Ordi-
nance shall constitute a separate violation of this

Ordinance for each ten days that such failure continues
after written notice from the Code Administration Officer. •
(B) Abrogation and Greater Restrictions:
No permit for .the construction of any structure to be
located within the Floodway District shall be granted;
unless the applicant has first met the necessary requFre-
ments of this Ordinance. It is not intended by this Ordi-
nance to repeal, abrogate or impare any existing ease-
ments, covenants, or deed restrictions. However, where
this Ordinance imposes greater restrictions, the provi-
sions of this Ordinance shall prevail.
(C) City Council Action:
In addition or in lieu of other remedies, the Elizabeth
City Council may institute any appropriate action or
preceeding to restrain or prevent any violation of this
Ordinance and shall require any person, firm or corpo-
ration which has committed any such violation to remove
a violating obstruction or restore the conditions exis-
ting before placement of the obstruction.
