Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that I) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Send all suspicious email as an attachment to Heather, I am one of the board members of the Bogue View Court HOA. I understand that you have been speaking with Tim Gilmore about a permit for the replacement of our neighborhood pier and have been waiting on a waiver from one or both of the adjoining property owners. I had been working on that part of the project. It took some time and negotiating, but below is the email I received from the Fogleman family this evening agreeing to waive the 15' setback on their side. I have also attached the updated drawing, which the Foglemans referred to, in case you haven't received it already. Please let me know what else we need to send you, if anything, in order to obtain the necessary permit and I will coordinate with the other board members to get it to you.
