Private dock and boat access is the main use of this tract, along with CAMA public water access and an NCDOT
stormwater structure. The NCDOT stormwater drop inlet is within the existing R/W, however the drainage pipe connected to
the drop inlet extends outside of the right of way into Banks Channel under a privately owned dock.

There is a drop inlet grate with an 18" RCP connected to the drop inlet box extending out into Banks Channel .
5. Activities and Impacts

The purpose of the project is to stabilize the shoreline adjacent to the edge of the existing curb of US 76 Waynick Blvd and to
protect the utilities that have become exposed as a result of accelerated erosion from Hurricane Florence. The function of
both the storm water structures and privately owned dock willl not be changed. They will continue to function as they do now.
c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The proposed rip rap will consist of Class B marl or granite and will be placed at a 2:1 slope in an area measuring
approximately 80' in length by 8' in width. An area measuring approximately 80' in length by 4' in width between the edge of
the existing road curb and the proposed riprap will be backfilled and vegetated. This area allows for the maintenance of the
existing property owners fence as well as the existing parking meters. Equipment necessary for the placement of the
additional riprap includes an excavator, backhoe, and dump truck. All work will be conducted above the NHW level and
equipment will be stored on high ground within the R/W.

Propose placement of Class B riprap in an area measuring approximately 80' x 8' at a 2:1 slope. Propose backfill in an
area measuring approximately 80' x 4'.

Following up to our phone conversation. The North Carolina Department of Transportation Division
3 office is proposing to place riprap at 326 Waynick Boulevard to stabilize the shoreline adjacent to
Banks Channel that was eroded during Hurricane Florence exposing the existing roadway and
utilities. As part of the process to obtain an Emergency CAMA permit for the proposed riprap, we are
required to notify Carolina Yacht Club as the adjacent property owner located at 324 Waynick
Boulevard. The area of proposed riprap measures approximately 80' in length by 8' in width. If
possible, please respond to this email as soon as possible with confirmation that you have received
this notification and whether or not you have any objection to the proposed work.
I have attached photos of the existing damage and proposed area of work. If you can zoom in at on
the last photo, you can see some of the erosion landward of your bulkhead's wingwall. I apologize as
I thought I had a better one of the damage on your property. You will want to contact Brooks
Surgan, the local field representative for the Division of Coastal Management, for any proposed
repairs to your property. He can be reached at (910)-796-7270.

THAT WHEREAS, the Department desires to enter certain lands of the owners located in
Wrightsville Beach Township, New Hanover County, described as follows:
Temporary Construction Easement to expire when construction is completed as follows:
An area having a maximum width of 5 feet outside the existing right of way and approximately 10 feet in
length, located north and east of the most south eastern corner of the property fronting Waynick Blvd (US
76) along the ICWW, The length of the work area is approximately 22 feet north of this property comer.
Work includes:
Removal of the 4 foot 18" RCP stub out from drainage structure. Replacement with 20 feet of 18"
Aluminum pipe. Construct independent cradle structure 13 feet from the face of the existing structure, in
front of first set of dock pilings. Cradle to be constructed with 12 foot or 16 foot 46 wooden timbers and
cross braces to secure aluminum pipe in place, not to be attached to dock structure. The timbers will be
driven down approximately 8 feet into the bed. Fill in and armor the existing embankment. Remove
separated pipe sections from in front of and around dock structure.

The right of entry described herein shall be presumed to begin as of the day and year of the entry
of this agreement as first above written. The parties hereto agree that the right of entry granted shall not
be deemed a trespass on the owners' property. The OWNERS DO HEREBY EXPRESSLY WAIVE any
and all claims arising from any entry made pursuant to this agreement and being in the nature of a
trespass, taking, or an inverse condemnation. This waiver applies to the Department, its employees,
officials, contractors, agents,assigns, and/or licensees, as well as to utility companies and all others
deemed necessary by the Department to enter the property for the purposes set forth herein.
IT IS FURTHER AGREED THAT, the right of entry described herein shall extend for the PERIOD
BEGINNING WITH THE DATE OF THIS AGREEMENT AND CONTINUING THEREAFTER UNTIL THE
DEPARTMENT'S ACCEPTANCE OF THE COMPLETED HIGHWAY PROJECT.
