Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. DAVIS Director November 16, 2018 NORTH CAROLINA Environmental Quality RE: EXEMPTED PROJECT - MAINTENANCE AND REPAIR Town of Oriental c/o Diane Miller, Town Manager PO Box 472 Oriental, NC 28571 Dear Ms. Miller: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a CAMA development permit under the Coastal Area Management Act. After reviewing the information you have submitted, I have determined that the activity the Town of Oriental proposes is exempt from needing a CAMA development permit as long as it remains consistent with the information submitted in your email correspondence on 11/15/2018, and meets the conditions specified below. If Town's plans should change and the project will no longer meet these conditions, please contact the Division of Coastal Management before proceeding. Proposed Repair: At the Freemason Street end of the existing bulkhead the work involves capping the existing double seawall, filling with gravel and cement cap and match profile and elevation. At the Vandemere Street end, work involves replacing an existing combination of dilapidated wooden wall and failing sheet piling with proposed vinyl sheeting and capping with cement cap which would taper to elevation with the road. Note: See CAMA General Permit No. 73154-C issued to the Town of Oriental on 1111412018 for other authorized work under 7H.2500. Permit expires on September 19, 2019. Maintenance and Repair: G.S. 113-103(5)(13)(5) and U .0210(2)(c) - Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible. The repairs to the existing shoreline protection are limited to 50% or less of the linear footage of the existing structure. This exemption expires on September 19, 2019. Good Afternoon Roy, See attached. While the permit issued is something we absolutely DO need to address, it is not the exigent wall issue. See attached. At the Freemason end, we are capping the existing double seawall filled with gravel with a cement cap to match, but come down to grade where the fishing pier WAS. At the Vandemere end, we are replacing an existing combination of old wooden wall and rusted failing sheet piling with new vinyl sheet piling and capping it as well with a similar cement cap that comes to grade with the road. These structures are failing to reinforce and protect the road (which also needs to be replaced) and I can't do that until I am sure that the wall will hold the road and the equipment. In short- while I do need to add granite as diagrammed, this is not the permit need first. Large photo files, please let me know you have received. Thank you! D.
