Re: Objection to the Issuance of CAMA General Permit No. 71511A for
a pier and platform Development Project, at 250 Mother Vineyard,
Dare County
Dear Ms. Phillips:
This letter is in response to your objection as an adjacent riparian property owner to a
permit request from Millstone Marine, the contractor for Kerry Dowd for the
construction of a pier and platform at 250 Mother Vineyard, Dare County. I was on site
on July 28th to evaluate the permit applicant's request.
The permit applicant has requested a permit to construct a 20 foot pier with a 10 foot
by 10 foot platform along with a 10 foot by 6 foot lower platform. Under the Coastal
Area Management Act (CAMA), the Coastal Resources Commission (CRC) has
established Rules for General Permits for this type of development that are found in 15A
NCAC 07H .1200 (copy enclosed).
You have notified the Division of Coastal Management of your objections to this
proposed development by sending a written letter. Your objections to this proposed
development related to the proximity of the proposed pier to the 15 foot riparian
setback to your property line. The pier will be located approximately 155 feet from
your property line and well away from the riparian corridor. The Division has reviewed
your objections, along with all aspects of this development proposal for consistency
with the aforementioned Rules, which describe the CRCs standards and guidelines for
this type of development. Our review of the proposed development has found it to be
consistent with these Rules.
After reviewing the permit proposal and the exact placement of the proposed pier, the
pier will be built outside of the 15 foot setback that is required under CAMA rules in 15A

at 250 Mother Vineyard Road.
The permit was written to assure the pier would be placed outside of the 15 foot
riparian setback as required by rule if there is no waiver from the adjacent riparian
property owner.
After having given careful consideration to your objections to this proposed
development, we have determined that it is consistent with the Rules of the CRC and
the State's Coastal Management Program, and that all pre -requisites have been
satisfied. Therefore, the Division of Coastal Management issued General Permit No.
71511A on July 2, 2018 (copy enclosed) for the proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request
Form with the Director of the Division of Coastal Management within 20 days of the
permit issuance date. If you choose to pursue an appeal, please contact this office so
that we can provide you with the appropriate forms and addresses.

Please accept this letter as "notification in writing" to object to the new pier construction for the Dowd
easement property adjacent to my property. The information that was provided to me by Millstone
Marine Construction appears to fail to provide the required 15 foot setback as outlined by CAMA:
"Piers and docking facilities must not interfere with access to any riparian property
and shall have a setback of at least 15 feet between any part of the pier and the
adjacent property owners' areas of riparian access. The dividing line for areas of
riparian access shall be established by drawing a line along the channel or deep
water in front of the properties, then drawing a line perpendicular to the line of the
channel so that it intersects with the shore at the point the upland property line
meets the water's edge (see Figure 4.10). The 15-foot setback requirement may be
waived by a written agreement of the adjacent riparian property owners or when
owners apply for a CAMA permit together."
