Hoar 101 Toms Circle Chocowinity, NC 27817 Dear Ms. Hoar: NORTH CAROLINA Environmental Quality October 18, 2018 Re: Objection to the Issuance of CAMA General Permit No. 67361A for a Breakwater Development Project, 27180 West Dory Road, Dare County This letter is in response to your objection as an adjacent riparian property owner to a permit request from Bradley Bui for the construction of a breakwater at 27180 West Dory Road, Salvo, Dare County. I was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to construct a breakwater along his shoreline. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .2100 (copy enclosed). You have notified the Division of Coastal Management of your objections to this proposed development by letter dated October 1, 2018. Your objections to this proposed development related to your desire for more time to evaluate the development proposal. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. The breakwater will be positioned 15 feet from your shared property line. After having given careful consideration to your objections to this proposed development, we have determined that it is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been Q Q15. I am objecting to this proposal at this time as well as "do not" wish to waive the 15' setback requirement for the mere purpose of preserving my right to have more time to look into the impacts, if any, this project may cause to my property, currently or long term. As per your conversation with my daughter, Lisa, you had mentioned that it was okay to send this to you via email as well as the originals in the mail via U.S. Postal Service — even though the Waiver Form mentions Certified Mail — Return Receipt Requested or Hand Delivered. If this has changed, please let me know. Thank you for emailing the information on marsh sill. I will look it over and let you know of any questions. I do appreciate it. After speaking with several folks and learning more about this proposed project, I would like to change my objection to "I have no objection" to the development of the adjacent property waiver that I previously submitted. However, I still stand by my objection to "I DO NOT wish to waive the 15' setback requirement". I would like to ensure that we have access to the water without any obstruction from the wall.
