71456A for a Docking Facility and Breakwater/Sill
Development Project, at 244 Tower Lane In Kill Devil Hills,
Dare County
Dear Mr. Fatoorechie:
This letter is in response to your objection as a riparian property owner to a
permit request from Dana and Duncan Aydlett for the construction of a
docking facility and breakwater/sill in the Carlyle -on -the -Sound subdivision
located at 244 Tower Lane in Kill Devil Hills, Dare County. Yvonne Carver,
Field Representative of the Division of Coastal Management staff, and I were
recently on site to evaluate the applicants' request.
The permit applicants have requested a permit to construct a 40'x4' pier
extension, 8'x8' L-platform, 11'x11' boatlift, and 52 feet of breakwater/sill at
the aforementioned property. Under the Coastal Area Management Act
(LAMA), the Coastal Resources Commission (CRC) has established Rules for
General Permits for these types of development that are found in 15A NCAC
07H .1200 and 07H.2100 (copies enclosed).
You notified the Division of Coastal Management of your objections to this
proposed development by mailing the signed riparian notification/waiver
form to our office. On the riparian form, you noted that you have objections
to the proposal, and do not wish to waive the 15'setback. Specific reasons
for your objections were not provided. The Division has reviewed the fact
that you object to the project, as well as all aspects of this development
proposal for consistency with the aforementioned Rules, which describe the
CRC's standards and guidelines for this type of development.

The proposed docking facility and breakwater/sill will be positioned such that
the structures will remain outside of the 15'riparian corridor. Aker
considering your objection to this proposed development, we have
determined that it Is consistent with the Rules of the CRC and the State's
Coastal Management Program, and that all pre -requisites have been
satisfied. Therefore, the Division of Coastal Management Issued General
Permit No. 71456A on April 25, 2018 (copy enclosed) for the proposed
development.
If you wish to appeal this permit decision, you must file a Third Party
Hearing Request Form with the Director of the Division of Coastal
Management within 20 days of the permit issuance date. If you choose to
pursue an appeal, please contact this office so that we can provide you with
the appropriate forms and addresses.
If you have any further questions regarding this matter, please do not hesitate
to contact Yvonne Carver, or me, at this office.
