Dear Ms. Martin:
On behalf of the Ballast Point Villas Unit Owners Association (BPVUOA), I am replying to your
letter regarding the pier including mooring posts and boat lift which Frank and Deborah Sheppard
wish to install by initially making such application to the North Carolina Division of Coastal
Management. Mr. and Mrs. Sheppard own Village Landings Lot 83, which is adjacent on their
southern side to property owned by the BPVUOA.
Per the NC Division of Coastal Management form submitted to the BPVUOA, I call your attention
to the two sections that must be initialed on behalf of our Association. The BPVUOA (1) does
have objections to this proposal and (2) does not wish to waive the 15-foot setback requirement.
The Sheppards' pier currently runs 53 feet eastward from their bulkhead and does not have any
mooring posts. The BPVUOA believes the current plan length including mooring posts is
excessive.
On behalf of our Association, I call your attention to the current piers extending into Roanoke
Sound on the eastern frontage of the Pirate's Cove community. The next very long pier north of
the Sheppards is located at Ballast Point Village Landings Lot 61. This is 22 lots north of the
Sheppards' lot. This pier is 85 feet in length some of which accounts for the shallowness near the
shore. To the south of the Sheppards' lot on the eastern frontage in Pirate's Cove, there are no
piers, only standard Pirate's Cove common docks. It is obvious that the proposed pier length and
additional mooring posts are not in keeping with the current eastern frontage.
Additionally and on behalf of the BPVUOA, I note that our owners enjoy simple water "toys" such
as paddle boards, kayaks and wave runners, which they keep on sight in our buildings. For the
most part, our owners enjoy usage of their "toys" close to land. The requested pier and mooring
posts would require our owners, their families and guests to venture farther from shore in order to
boat to the north of our property along the Roanoke Sound shoreline. Such movement would
place them much closer to the Roanoke Sound channel and therefore the wake of larger craft
journeying under the Baum Bridge to Manteo Harbor and beyond.
In conclusion and again on behalf of the BPVUOA, I suggest that a simple replacement of the
Sheppards' current pier at its current length would be the most appropriate action to take.

Re: Objection to the Issuance of CAMA General Permit No. 71565A for
a pier, platform and boatlift Development Project, at 83 Ballast
Point Drive, Dare County
Dear Mrs. Porterfield:
This letter is in response to your objection as an adjacent riparian property owner to a
permit request from Lyn Small Inc., an agent for Frank and Deborah Sheppard for the
construction of a pier, platform and boatlift at 83 Ballast Point Drive, Dare County. I
was on site Friday July 20th to evaluate the permit applicant's request.
The permit applicants have requested a permit to construct a 90 foot pier with a 20 foot
by 20 foot platform, 4 mooring pilings and a 12 foot by 13 foot boatlift. Under the
Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has
established Rules for General Permits for this type of development that are found in 15A
NCAC 07H .1200 (copy enclosed).
You have notified the Division of Coastal Management of your objections to this
proposed development by letter of objection. Your objections to this proposed
development related to the proposed length of the pier. The Division has reviewed your
objections, along with all aspects of this development proposal for consistency with the
aforementioned Rules, which describe the CRC's standards and guidelines for this type
of development. Our review of the proposed development has found it to be
inconsistent with these Rules.
Do to the inconsistency with the rules the proposed pier has been shorted to keep it at
the 100-foot length that is allowed through the general permit rules. Also, no part of
the docking facility shall be built within the 15-foot riparian corridor.

After having given careful consideration to your objections to this proposed
development, we have determined that with this modification it is consistent with the
Rules of the CRC and the State's Coastal Management Program, and that all pre-
requisites have been satisfied. Therefore, the Division of Coastal Management issued
General Permit No. 71565A on August 29, 2018 (copy enclosed) for the proposed
development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request
Form with the Director of the Division of Coastal Management within 20 days of the
permit issuance date. If you choose to pursue an appeal, please contact this office so
that we can provide you with the appropriate forms and addresses.
