BUFFER AUTHORIZATION CERTIFICATE FOR SHORELINE STABILIZATION
A riparian buffer authorization is required for shoreline stabilization activities within the Neuse and Tar -Pamlico River
basins per Division of Water Resources (DWR) regulations 15A NCAC 02B. 0233 and 0259. The Division of Coastal
Management (DCM) through a Memorandum of Understanding with the Division of Water Resources (DWR) has
reviewed your project proposal and has determined that the project as proposed complies with the aforementioned
regulations.
Those activities covered by your Coastal Area Management Act (CAMA) permit have received Buffer Authorization
provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to
comply with this Buffer Authorization may subject the property owner and the party (contractor) performing the
construction and/or land clearing to a civil penalty by DWR of up to $25,000 per day per violation.
i. Impacts: Impacts to woody vegetation from clearing and filling in Zone 1(begins at the most landward of either
normal water line (NWL) or normal high water line (NHWL) and extends 30 feet landward) shall be minimized to
what must be impacted for the sound installation of the shoreline stabilization project. Unnecessary clearing and
filling in the buffer is a violation of the riparian buffer rules.
2. Clearing & Grading: Clearing and grading of Zone 2 (begins at the landward edge of Zone 1 and extends 20 feet
landward) is allowed provided that it is re -vegetated immediately and Zone 1 is not compromised, which includes
maintaining diffused (non-channelized) flow of storm water runoff through the buffer.
3. Construction Corridors: Construction corridors are allowed for shoreline stabilization projects, but they must be
satisfactorily restored as described in condition 5 below.
4. Potential Overwash: For vertical shoreline stabilization projects (bulkheads) only;.sites where wave overwash is
expected to be severe, the first ten (10) feet landward (unless specifically authorized otherwise by DCM) from the
structure may be maintained as a stable lawn in order to provide for structural stability.
s. Temporary Stabilization: Immediately post- construction, bare soils must be stabilized as quickly as possible by
providing a temporary ground cover. Newly seeded areas should be protected with mulch and/or erosion matting.
This ground cover is a temporary measure used to address erosion until site restoration can be accomplished.
6. Site Restoration: At minimum, pre -project site conditions must be re-established. A site that was wooded prior to
this shoreline stabilization project must be restored with woody vegetation at a stem density of 260 stems per acre.
Non wooded sites may be re -vegetated with woody vegetation. Restoration must be com! leted by the first
subsequent planting season (November 1 through
Mar ) after com letion%fthe bulkhead.

7. Project Drawing: The drawing on the CAMA General Permit is considered the project drawing of your property
indicating the location of the shoreline stabilization structure and any associated clearing, grading, and construction'
corridors. This drawing will be used to aid in compliance and monitoring efforts.

I met with Mr. Sam Jarvis on August 2, 2017. We met on his client's 6.17 acre parcel off Woodstock Road near Belhaven,
NC. This was a site that you had met Raleigh and Mr. Jarvis on several months ago. The site was visited after a heavy rain
event, and as a result it was difficult to determine if 404 wetlands would be impacted for the proposed bulkhead project.
After field verifying the proposed bulkhead area, I've determined that no 404 wetlands will be impacted by the proposed
bulkhead operation. The areas that we looked at directly beyond the shoreline did not display the 3 criteria required to
make the area a jurisdictional wetland.
I've attached a map of the areas that we looked at.

Is this acceptable to you as an acknowledgement from the eastern Riparian owner that the project is
acceptable to him, and that he has been notified? They have a maintenance agreement for the road
and we have a Contractor, Davis Hauling, engaged to prep the bad places in the road for the heavy
loads and to repair any damages sustained during construction. All the expenses for this will be paid
by Investment Group Holdings, LLC.. By copy of this email, I have asked the Manager for the
Investment Group Holdings to provide to Mr. McCann that the cost of any road repair associated with
the proposed construction will not be considered as a joint cost but a cost specifically associated with
the bulkhead project.
I have met with the Dean family, owners of the Riparian tract west of the project, and Billy Deans
should be attaining his Mother's signature today. She has indicated to me that she is in agreement
with the planned construction. Please let me know if this is acceptable for your requirements for the
Bath Properties, LLC site. Thanks.

I tried to get a larger sheet size to scan along with the smaller sheets all in one run. The
map did not do as I wanted so I am sending the map in another scan.. This is a general
permit for up to 500 feet of bulkhead. The area of the bulkhead is marked in red on the
drawing and a tax map, cross section, and signature forms are also included. The
purpose for the signature forms is to show CAMA you have been notified of the planed
work and whether you approve or object to the proposed work. If you would please sign
and date the two forms and email back to me, I will get them to CAMA. The Contractor
plans to start this as his next job. Let me know if you have any questions.

Mr Edwards.
Thank you for coming out this past week. by the end of this week, I will have most of the area around the pond
seeded. There is one area I need to build up, and should have that done and grass planted by the end of next week. I
am burning off the brush, stumps and trees in the area adjacent to that area of the pond, and should have that seeded
as well as that is the area I am using to pull from to build up low area beside the pond. Basically, I'm trying to get it
sloped so that the water goes evenly over the slope instead of one spot. The area behind the pond is a little different,
and very saturated. Most of the water stays in place, or drains to the back of my property, and then flows around to the
front. I have been able to slow -the flow of water from the back and have been able to seed and put down an erosion
control mat as it flows. It rained here sunday, and no water escaped my pond and went to the river. Is still have about 6
inched for the pond to rise.
The State is coming out next week to re -work the culvert that goes under the road. basically they will be cutting
about 3-5 feet the pipe off on my side and will be reworking/ reseeding both areas. by them moving the pipe, it actually
gives me the ability to build up the berm and make it wider so it will not fail. I do plan on putting an over flow pipe on
the berm to control erosion, and a pump on the pond so I can drain it as needed before major storms come. I also
checked the river, and did not see any sign of sedimentation run off from this past weekends rain.
One last question. You gave me a map of my property permitting information regarding the area you believe has
been disturbed. The acreage of those three lots came up to 1.4 acres. It's my understanding that your claim is that all
of that has been disturbed. As I see it, there is somewhere between 1/2 and 2/3's of an acre that has not been
disturbed as there are trees visible on the lots. I may be close to an acre of disturbed earth, but I don't think an actual
measurement would go over. although it would probably be fairly close. If I can get the disturbed land corrected and
seeded, or acceptable mitigated, is it necessary to have a permit.
