DAVIS Director Donald Skakle PO Box 423 Hatteras, NC 27943 Dear Mr. Skakle: NORTH CAROLINA Environmental Quality August 13, 2018 Re: Objection to the Issuance of CAMA General Permit No. 71598A for a boatlift and dock Development Project, at 57187 Midgett Way, Dare County This letter is in response to your objection as an adjacent riparian property owner to a permit request from Quible and Associates, an agent for Donald Oden Jr. for the installation of a boatlift and construction of a pier at 57187 Midgett Way, Dare County. I was on site to evaluate the permit applicant's request on Tuesday August 2, 2018. The permit applicant has requested a permit to construct a 6 foot by 32-foot pier with a 6 foot by 18 foot "L" end platform and install a 12 foot by 12 foot elevator boat lift. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1200 (copy enclosed). You have notified the Division of Coastal Management of your objections to this proposed development by mail. Your objections to this proposed development related to erosion occurring on your property due to the bulkhead. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRCs standards and guidelines for this type of development. Our review of the proposed development has found it to be consistent with these Rules. The applicant has not requested any work associated with the bulkhead. The proposed development is for a boatlift that will be 15 feet off the riparian line and a pier that will be 127 feet away from your property. With these setbacks the proposed activity will be compliant with the current rules and regulations. If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the Division of Coastal Management within 20 days of the permit issuance date.
