General Statutes and Division of Coastal Management Major Development Permit approval
procedures require that riparian landowners with property adjoining a proposed development in
an Area of Environmental Concern (AEC) be given ten (10) days in which to comment on the
proposed development. This form allows the adjacent riparian landowner to express either: (1)
that he objects to the project; or, (2) that he does not object and desires to waive his/her right to
the 10-day period so that the processing of the application can progress more rapidly. Of course,
the adjacent riparian landowner need not sign this form at all if he/she so chooses.

North Carolina Department of Transportation's plans for installing ITS along 1-140 in New Hanover
and Brunswick Counties. I am further aware that this work will occur in one or more Areas of
Environmental Concern and therefore will require authorization from the Division of Coastal
Management in accordance with the Coastal Area Management Act (CAMA).

construction of I-140 (Wilmington Bypass) between I-40 and US 17, Brunswick
and New Hanover Counties, Federal Aid Project NHP-0040(058), TIP R-2633D.

Please find enclosed the North Carolina Division of Coastal Management Major Permit Form
(MP-1) and utility plans for the above referenced project. The North Carolina Department of
Transportation (NCDOT), Division of Highways proposes to install Intelligent Transportation
Systems (ITS) infrastructure along I-140 (Wilmington Bypass) between I-40 and US 17 in
Brunswick and New Hanover Counties. All work will occur within NCDOT right-of-way
(ROW) acquired as part of R-2633 Sections A, B, and C. Final Environmental Impact
Statements were completed in November 1997 (R-2633C) and April 2007 (R-2633A/B). R-
2633C (I-40 to US 421) is already constructed, while R-2633A/B (US 421 to US 17) is either
already constructed or in the process of being constructed.
ITS infrastructure includes conduit, cable, closed circuit TV, and associated cabinets and
junction boxes. Cable will be installed via directional bore along the road corridor, or run
through new or existing conduit attached to bridges, including those over the Northeast Cape
Fear and Cape Fear Rivers. While all work will occur within previously acquired ROW, it was
assumed that all land disturbance will occur in wetland areas. Therefore, there will be a total of
0.03 acre (1,296 sq. ft.) of permanent wetland impacts due to ITS installation.
The proposed let date for the project is April 18, 2018 with a review date of February 28, 2018.

Regulatory Approvals
Section 404 Permit: Written approval is required for these activities and application for a Section
404 Nationwide 12 permit will be made via electronic PCN.
Section 401 Permit: Written approval is not required for these activities; therefore NCDOT will
proceed under the General Conditions of the Section 401 General Certification No. 4133 from
the North Carolina Department of Environmental Quality, Division of Water Resources.
CAMA: NCDOT requests that the proposed utility work associated with this project be
authorized under a Coastal Area Management Act General Permit. The adjacent riparian
landowner return receipts are included with this application. Authorization to debit the $400
Permit Application Fee from WBS Element 34491.3.23 is hereby given.

General Statutes and Division of Coastal Management Major Development Permit approval
procedures require that riparian landowners with property adjoining a proposed development in
an Area of Environmental Concern (AEC) be given ten (10) days in which to comment on the
proposed development. This form allows the adjacent riparian landowner to express either: (1)
that he objects to the project; or, (2) that he does not object and desires to waive his/her right to
the 10-day period so that the processing of the application can progress more rapidly. Of course,
the adjacent riparian landowner need not sign this form at all if he/she so chooses.
1, , am an adjacent riparian property owner and am aware of the
North Carolina Department of Transportation's plans for installing ITS along 1-140 in New Hanover
and Brunswick Counties. I am further aware that this work will occur in one or more Areas of
Environmental Concern and therefore will require authorization from the Division of Coastal
Management in accordance with the Coastal Area Management Act (CAMA).
I have no objection to the project as presently proposed and
hereby waive that right of objection as provided in General Statute 113-229

Transportation Systems (ITS) along I-140 in Brunswick and New Hanover Counties. The proposed
project involves the placement of cable in existing conduit along the underside of the I-140 bridge over
the Cape Fear River. This project crosses an Area of Environmental Concern, as defined by the North
Carolina Division of Coastal Management (DCM), and must be approved by the DCM under provisions
of the Coastal Area Management Act (CAMA). One of the prerequisites to this approval is that adjacent
riparian landowners be given an opportunity to comment on the proposal. A vicinity map and site
drawings are enclosed for your review.
The attached form is submitted to ensure that you have an opportunity to comment on the proposal. The
work planned is depicted in the attached drawing. If you have no objections to the proposal, please return
the form with your response within 10 days to this office. If you do have objections to the project, please
