Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

FOR PIER AND DOCKING FACILITIES ACCESS WAY

A riparian buffer authorization is required for pier, and docking facilities -a c-c-es-ways through the Tar -Pamlico &
Neuse River Riparian buffer per Division of Water Resources (DWR) regulations 15A NCAC 0213.0233 & .0259. The
Division of Coastal Management (DCM), through a Memorandum of Understanding with the Division of Water -
Resources (DWR) has reviewed your project proposal and has determined that the project as proposed complies
with the aforementioned regulations.
Those activities covered by your Coastal Area Management Act (CAMA) permit have received Buffer Authorization
as long as the project is constructed in a manner that continues to meet all of the.conditions listed below. Failure to
comply with this Buffer Authorization may subject the property owner & the party (contractor) performing the
construction Wor land clearing to a civil penalty by DWR of up to $25,000 per day per violation.
1. Crossing is Perpendicular: Pier and docking facility access way must.cross the 50 ft. riparian buffer
perpendicularly (which is defined as between 75 and 105 degrees) unless otherwise approved by DCM. The
alignment shall minimize the removal of woody vegetation to the greatest extent practicable.
2. Pervious Materials: All reasonable measures shall be taken to ensure the access way is made of pervious
materials like open -slatted wood or composite, mulch, or grass to meet the intent of the rules to the
maximum extent practicable.
3. Access Width: The width of the pier or docking facility access way shall be limited to six (6) feet.
4. Project Drawing: The drawing on the CAMA General Permit is considered the project drawing of your
property indicating the relative location of the pier or docking facility and any requested access way. This
drawing will be used to aid in compliance and monitoring efforts.

THIRD PARTY APPEALS
Other directly affected people, such as neighbors or other affected parties, may request a hearing on the permit decision.
This petition for a third -party hearing must be received by the director of DCM within 20 days of the permit decision. Within
15 days of receiving the request, the chairman of the CRC will decide if a petitioner is entitled to a third -party hearing. To get
a hearing, a petitioner must [113A 121.1(b)]:
• Allege that the permit decision is contrary to a statute or rule.
• Show that the petitioner is directly affected by the permit decision.
Demonstrate that the appeal is not frivolous.
If the CRC chairman grants a hearing, you may file a Petition for a Contested Case Hearing in the Office of Administrative
Hearings. You must carefully follow detailed procedures and forms required by the state Administrative Procedure Act.
Further information on filing appeals is available from the Office of Administrative Hearings or DCM. Parties to the hearing
may be represented by attorneys, or may represent themselves. After the hearing, the judge issues a decision. Contested
cases that commence after Jan.1, 2012 will no longer be returned to the CRC for a final agency decision. The
Administrative Law Judge's decision will be.the final decision.
You may appeal the Administrative Law Judge's final decision to Superior Court within 30 days of the decision.
Note: The CRC is not allowed to discuss specific appeals or other contested cases before it makes a decision. Do not
attempt to contact CRC members to discuss your case.

I do hope that you received this e-mail below upon your return to the office today. I am not sure whether your receive
messages if an automatic response is sent out that you are not in the office, so just to make sure as I feel it is very
important.
I do apologize if you did receive it upon opening your e-mails. Speaking with Bobby Smith, he said that he would be in
contact with you today. I hope that this can be resolved amicably.
Dear Mr. Connell,
This note is in reference to the dock and boat lift that Dempster Wheeler at 150 Martin Creek Drive Beaufort is
planning on having constructed in Martin Creek. I know that you have spoken to Gary Cannon who is VERY
concerned. We did receive a letter dated January 5th and I, as well as several other members of the Association
did NOT give our approval to this project as we feel that it will have a negative impact on some people on the
other side of the Creek. These people did not receive anv letter informing them of the proposed construction It is
a narrow creek and some have fishing boats and sailboats that would have a difficult time being able to turn
around in these waters. These families have been in the Community a long time (many 50+ years) and we as
newcomers have a responsibility to respect them and their livelihoods. After all many benefit from what they do
as we are fortunate to have excellent seafood.
I respectfully urge you to revisit the situation and greatly involve all parties that are affected

I have learned that a permit has been issued for a dock across from my property in South River, NC. This is at a narrow
channel with limited depth. I am concerned that I won't be able to transit the area with our boats. I am on jury duty the first
week of February. How can I participate in the appeal? Can you send me a nautical chart that shows accessibility after the
proposed project?
