The proposed project is located on Broad Creek at 219 Pearson Circle, Newport, in Carteret County, North Carolina. The Division has reviewed your concerns and objections to the proposed project. After reviewing the proposal along with your objections, the Division has determined that the proposed development complies with the rules of the Coastal Resources Commission in 15A NCAC 07H .1200. Therefore, the Division issued CAMA General Permit #66866-C to Mr. Thomas Smith on 05/02/2016 for the construction of extending the existing dock to a total of 133' from the NHW at the bulkhead, installing two (2) boatlifts, a 4' x 24' finger pier, and a partially covered 10' x 30' platform at the terminus of the pier that extends (L-shape) towards the north. All portions of the proposed development must be 15' or greater from the southern and northern riparian access lines. A copy of the permit is enclosed for your review. If you wish to contest the Division's decision to issue this permit, you may file a request for a Third Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days after the disputed permit decision is made. Johnson 237 Pearson Circle Newport, NC 28570 April 11, 2016 252-393-8467 Ms. Heather Styron NC Department of Environment and Natural Resources Division of Coastal Management 400 Commerce Avenue Morehead City, NC 28557 Dear Ms. Styron: APR 1 1 2016 ®CM- MHD CITY This letter is in reference to the request of Mr. Thomas Smith of 219 Pearson Circle in Newport on Broad Creek to extend his existing dock to 165', install a new bulkhead, relocate his existing finger pier and boat lift, and construct a 12' x 30' platform with roof with one new boat lift. As this proposal violates at least seven (7) regulations as set forth by the NC Department of Environment and Natural Resources, I oppose this request as stated below: 1. (Regulation 15A NCAC 07H 1205 b.) "Piers and docking facilities shall not extend beyond the established pier length along the same shoreline for similar use. This restriction shall not apply to piers and docking facilities 100 feet or less in length unless necessary to avoid interference with navigation or other uses of the waters by the public such as blocking established navigation routes or interfering with access to adjoining properties as determined by the Division of Coastal Management." This request would far exceed any other pier on the west bank of Broad Creek and the rules are very specific. Most of the docks on the west bank on Broad Creek are 50' or less in length --- not 165' in length as Mr. Smith proposes. 2. (Regulation 15A NCAC 07H.1204 a.) "Piers and docking facilities authorized by the general permit set forth in this Section shall be for the exclusive use of the land owner, or occupant and shall not be leased, rented, or used for any commercial purpose. Piers and docking facilities shall provide docking space for no more than two boats." (Regulation 15A NCAC 07H 1205 r.) RECENED MAY 0 4 2016 ®CM- MFID CITY J� N tree � Mr. Smith is allowed two recreational boats on his premises, however, often there are multiple large barges and commercial boats docked on his property in direct violation of regulations. Mr. Smith's son owns a construction company (Bogue Banks Marine Construction which is located U in Morehead City) and often stations his boats on this said property. 3. (Regulation 15A NCAC 07H.1204 c. and d.) "There shall be no interference with navigation or use of the waters by the public by the existence of piers aim docking facilities." X IV "The permit set forth in this Section shall not be applicable to proposed 0 < construction where the Department determines that the proposed activity witH endanger adjoining properties or significantly affect historic, cultural, scenic; conservation or recreation values). Broad Creek is a very small body of water and a pier of this length would interfere with navigational and recreational use. Individuals on jet skis or water ski's as well as all recreational boats would be put into harms way. Boats pulling small children on tubes or boards come very close to our dock and the proposal of a 165' dock is 85' longer or more than all of the other docks along the west side of Broad Creek. If someone swung wide and hit the proposed heavy metal lifts and dock a fatal outcome could very well occur. The length of the proposed dock is unnecessarily long; the depth of the water in Broad Creek is the same except along the shoreline. A 165' pier will interfere with public recreational use of these waters and pose an extreme safety hazard to the general public. 4. (Regulation 15A NCAC 07H 1205 p.) "Piers and docking facilities shall in no case extend more than 1/4 the width of a natural water body . . ." In addition to the proposed pier not in keeping with the existing piers in the creek it might very well exceed the 1 /4 width of the natural water requirement, at least as far as the visible eye can discern. 5. (Regulation 15A NCAC 07H 1205 q.) "Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum setback of 15 feet between any part of the pier and docking facility and the adjacent property lines extended into the water at the points that they intersect the shoreline." If the intent of the homeowner is to build this pier in order to rent space to large rigs, this applicant should be made aware that it is against Carteret County zoning regulations to have commercial use in a residential area. As stated in #2, there are often commercial barges and boats on Mr. Smith's property. 7. On the first application, Mr. Smith's proposal indicated a 60' wide lot. On this, the second proposal, the lot is listed as 60' 22". County surveys on Deeds are not fluid. If there are any inaccuracies, it would be in a few inches, not almost two feet. In the Deed Book on 219 Pearson Circle, #1485, page 128, the lot is listed at 60'. 8. Several years ago, Mr. Smith approached my husband to request the purchase of one foot of our property. We declined this offer as we did not want to cut off our 60' lot. If Mr. Smith acquired 22" from the lot on the other side of his property, this transaction is not recorded in the Deed Book. Therefore, as Mr. Smith was denied an additional foot of property years ago and this new proposal indicates an added 22" that is not legally recorded in the Deed Book, I respectfully submit my concerns and questions on this particular matter. Thank you for your consideration of my opposition to this proposed pier and lifts. All of us on Pearson Circle live in close proximity to one another and all of us want to safely enjoy Broad Creek and live within the guidelines of Carteret County. Johnson 237 Pearson Circle Newport, NC 28570 September 25, 2015 252-393-8467 Ms. Heather Styron NC Department of Environment and Natural Resources Division of Coastal Management 400 Commerce Avenue Morehead City, NC 28557 Dear Ms. Styron: This letter is in reference to the request of Mr. Thomas Smith of 219 Pearson Circle in Newport on Broad Creek to extend his existing dock to 160', install a new bulkhead, relocate his existing pier and boat lift, and construct a 12' x 16' platform with roof with one new boat lift. I oppose this request for the following reasons: 1. "Piers and docking facilities shall not extend beyond the established pier length along the same shoreline for similar use." This request would far exceed any other pier on the west bank of Broad Creek. 2. Broad Creek is a very small body of water and a pier of this length would interfere with navigation and recreational use. Individuals on jet skis or water ski's as well as all recreational boats would be put into harms way. Boats pulling small children on tubes or boards come very close to our dock and the proposal of a 160' dock is 85' longer or more than all of the other docks along the west side of Broad Creek. If someone swung wide and hit the proposed heavy metal lifts and dock a fatal outcome could very well Sr occur. The length of the proposed dock is unnecessarily long; the depth of the water inc 21� 201g Broad Creek is the same except along the shoreline. 3. "Piers and docking facilities shall in no case extend more than 1 /4 the width of a natural water body ..." In addition to the proposed pier not in keeping with the existing piers in the creek it might very well exceed the 1 /4 width of the natural water requirement, at least as far as the visible eye can discern. 4. "Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum setback of 15 feet between any part of the pier and docking facility and the adjacent property lines extended into the water at the points that they intersect the shoreline." I hereby request that the Division of Coastal Management ensure that there is no infringement in any way with my riparian property rights. a t,.^^ MAY 0 4 2016 ®C M- �,V "j...Ij ' 5: If the intent of the homeowner is to build this pier in order to rent space to large rigs, this applicant should be made aware that it is against Carteret County zoning regulations to have commercial use in a residential area. Mr. Smith and I have been good neighbors for over 20 years. My opposition is in no way personal. It is strictly a legal and safety issue. I thank you for your consideration of my opposition to this proposed pier and lifts. All of us on Pearson Circle live in close proximity to one another and all of us want to safely enjoy Broad Creek and live within the guidelines of Carteret County.
