Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

Instructions
1. Send the Adjacent Riparian Property Owner Notification Form to the adjacent
property owners. Must be by certified mail (returned certified mail receipt). If no response
for 10 days after receipt of the letter (returned certified mail receipt date) it is assumed
that the adjacent property has "no objection.
2. Minor Permit -- limited to less than 1,000 cubic yards of spoils material. $400 for spoils
between 100 cubic yards and 1,000 cubic yards.
3. Can apply for permit after all Adiacent Riparian Property Owner Notification Forms have
been returned or 10 day period has expired.
4. Update the channel/depth drawing with depth readings.
5. Take all drawings to CAMA office to apply for the permit.

SECTION .1500 - GENERAL PERMIT FOR EXCAVATION WITHIN OR CONNECTING TO EXISTING
CANALS: CHANNELS: BASINS: OR DITCHES IN ESTUARINE WATERS: PUBLIC TRUST WATERS: AND
ESTUARINE SHORELINE AEC'S
15A NCAC 07H .1501 PURPOSE
This permit will allow excavation within existing canals, channels, basins and ditches in estuarine and public trust waters for
the purpose of maintaining previous water depths and creating new boat basins from non -wetland areas that will be used for
private, non-commercial activities. This general permit is being developed according to the procedures outlined in
Subchapter 77.1100, and will apply to the estuarine waters and public trust waters areas of environmental concern.

15A NCAC 07H .1502 APPROVAL PROCEDURES
(a) The applicant must contact the Division of Coastal Management and complete an application form requesting approval for
development. Applicants shall provide their name and address, the site location and the dimensions of the project area.
(b) The applicant must provide:
(1) confirmation that a written statement has been obtained signed by the adjacent riparian property owners
indicating that they have no objections to the proposed work; or
(2) confirmation that the adjacent riparian property owners have been notified by certified mail of the proposed
work. Such notice should instruct adjacent property owners to provide any comments on the proposed development
in writing for consideration by permitting officials to the Division of Coastal Management within ten days of receipt
of the notice, and, indicate that no response will be interpreted as no objection. DCM staff will review all comments
and determine, based on their relevance to the potential impacts of the proposed project, if the proposed project can
be approved by a General Permit. If DCM staff finds that the comments are worthy of more in-depth review, the
applicant will be notified that he must submit an application for a major development permit.
(c) No work shall begin until an onsite meeting is held with the applicant and a Division of Coastal Management

The applicant shall pay a permit fee of two hundred dollars ($200.00) for maintenance excavation of 100 cubic yards or less
or four hundred dollars ($400.00) for maintenance excavation of 100 to 1,000 cubic yards. Permit fees shall be paid by check
or money order payable to the Department.

15A NCAC 07H .1504 GENERAL CONDITIONS;
(a) Individuals shall allow authorized representatives of the Department of Environment and Naturalesources to make
periodic inspections at any time necessary to ensure that the activity being performed under authority of this general permit is
in accordance with the terms and conditions prescribed herein.
(b) This general permit will not be applicable to proposed maintenance excavation when the Department determines that the
proposed activity will adversely affect adjacent property.
(c) This permit will not be applicable to proposed construction where the Department has determined, based on an initial
review of the application, that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved
questions concerning the proposed activity's impact on adjoining properties or on water quality; air quality; coastal wetlands;
cultural or historic sites; wildlife; fisheries resources; or public trust rights.
(d) New basins within or with connections to primary nursery areas are not allowed.

(e) No new basins will be allowed that.result in closure of shellfish waters according to the closure policy of the Division of
Environmental Health.
(f) This permit does not eliminate the need to obtain any other required state, local, or federal authorization, nor, to abide by
regulations adopted by any federal or other state agency.
(g) Development carried out under this permit must be consistent with all local requirements, AEC rules, and local Land Use
Plans current at the time of authorization.

15A NCAC 07H .1505 SPECIFIC CONDITIONS
Proposed maintenance excavation must meet each of the following specific conditions to be eligible for authorization by this
general permit.
(1) New basins will be allowed only when they are located entirely in highground and join existing man-made
canals or basins.
(2) New basins will be no larger than 50' in either length or width and no deeper than the waters they join.
(3) New basins must be for the private non-commercial use of the land owner.
(4) Maintenance excavation must involve the removal of no more than 1,000 cubic yards of material as part of
a single and complete project.
(5) All excavated material must be placed entirely on high ground above the mean high tide or ordinary high
water line, and above any marsh or other wetland.
(6) All spoil material must be stabilized or retained so as to prevent any excavated material from re-entering
the surrounding waters, marsh or other wetlands.
(7) The proposed project must not involve the excavation of any marsh, submerged aquatic vegetation, or other
wetlands.
(8) Maintenance excavation must not exceed the original dimensions of the canal, channel, basin or ditch and
in no case be deeper than 6 feet below mean low water or ordinary low water, nor deeper than connecting
channels.
(9) No excavation may occur during times designated by the N.C. Division of Coastal Management for
protection of fish, shellfish or wildlife resources.
(10) No maintenance excavation may take place within prime shellfish areas as designated by the N.C. Division
of Marine Fisheries.
(11) Proposed excavation must not promote or provide the opportunity for a change in existing land use at the
time of project review.
(12) New basins and canals must maintain required setbacks between septic tank systems and surface waters.

Directions For Filling Out A CAMA MINOR Permit
Please fill out the application completely including applicant's signature on the second
page. Be sure to complete the "statement of ownership" and the "adjacent property
owners". Your Local Permit Officer can assist you in preparing your application and project
drawings. Once the application and drawing(s) are complete, follow the instructions below:

1. A letter stating you have applied for a CAMA permit and are required to notify them
of your intended project. (Attached please find an example of this letter)

This process usually takes approximately two (2) weeks from the date that we receive your
complete application. A review period of 25 days is provided by law and an additional 25-
day period can be imposed when such time is necessary to complete the review of the
proposed project. Under those circumstances, you will be notified of the need for an
extended review period. If you have any questions about the Minor Permit application, your
project drawing(s), or any other aspect of the N. C. Coastal Area Management Act (CAMA),
please contact the LOCAL GOVERNMENT CAMA Local Permit Program Office.

PROJECT DRAWINGS
1. All drawings should be drawn to scale (ie. 1"=20', 1"=30') and include the following information:
- Name, project address, date and drawing scale (title box).
- Property dimensions and names of adjacent property owners indicated
Dimensions and location of all exist* and proposed structures, driveways, and sewage
disposal system (attach ImproverTl6rits Permit, if applicable). Decks labeled as covered or
uncovered and dimensions shown.
- Adjacent water body labeled and Normal High Water (NHW) or Normal Water Level (NWL)
contour shown.
- Marsh and/or wetland areas labeled (wetland delineation documentation from USACOE
Army Corps of Engineers must be included with the application, if applicable).
- All areas of ground disturbance and/or landscaping shown.
2. If your project is in the Ocean Hazard Area, your application must include an AEC Hazard Notice.,
signed by the property owner. Additional information for project drawings in the Ocean Hazard
Area AECs includes:
- Show all dunes and dune system contours, labeling the dune crest and both the landward
and oceanward dune toes. Also, include spot elevations on the highest portion of the
dunes.
- The first line of stable, natural vegetation as flagged by the LPO and the applicable setback
from the vegetation line. Contact the Local Permit Officer to stake the vegetation line for
you if necessary.
- Cross-sectional/Elevation drawings showing the number of floors and the roof and deck
profiles of the proposed structure(s). Additional drawing(s) for each floor plan may be
necessary.
- List the Total Enclosed Floor Area. Total Enclosed Floor Area is the combined
square -footage of all heated or air conditioned living space.
3. Additional information for project drawings in the Coastal Shoreline AECs:
- Dimensions of the footprint/roofline of all structures (outside walls + roof
overhang extended to the ground).
- Dimensions of all decks, labeled either covered or open (all elevated decks with
concrete below them at ground level are considered impervious).
- Normal high water (NHW) or normal water level (NWL) contour.
- Show the applicable Area of Environmental Concern (AEC); 75 feet landward of
normal high water (NHW) or normal water level (NWL) for Estuarine Shoreline
AEC (Coastal or Joint Waters); or 575 feet landward of normal high water (NHW)
or normal water level (NWL), if adjacent to Outstanding Resource Waters; or 30
feet landward of normal high water (NHW) or normal water level (NWL), if
adjacent to Public Trust Shoreline (Inland Waters).
- List the total amount (sqft) of impervious surface that will be created from your
proposed development.
- Show the 30-ft. buffer landward of normal high water (NHW) or normal water
level (NWL)

FILLING OUT THE APPLICATION FORM
The shaded area at the top of the first page is completed by the Local Permit Officer.
The LPO will assign a permit application number and check the AEC in which the
property is located.
In the general information section, the applicant and future permittee is always the
Land Owner, although an agent, such as a contractor or realtor, may obtain the
permit for the property owner. The applicant's mailing address is entered here. If an
agent is utilized to apply for the permit, their contact information is entered in the
Authorized Agent section. Location of Project is the address of property where
the work is to take place (the 911 address, subdivision and lot number, State or
County road, etc.). Description of Project should include all land clearing,
demolition, construction, and landscaping activities that are proposed to complete
the project. It is better to go over -board here, than to omit something that would
necessitate having to modify or re -apply for another permit to complete the
development. Size of Lot/Parcel can be listed as square feet or acres, or both.
Check the applicable Proposed Use, residential (single-family or multi -family),
commercial, or other. The Total Enclosed Floor Area of a Buildina in the Ocean
Hazard AEC section is only completed for those projects that are located in one or
more of the Ocean Erodible, High Hazard Flood, Inlet Hazard or Unvegetated Beach
AECs. Total Enclosed Floor Area is the combined square -footage of all heated or air
conditioned living space. If the project is not in the Ocean Hazard Area, then insert
N/A and go to the next section and determine in which Coastal Shoreline AEC the
project is located. The Size of Building Footprint and Other Impervious
Surfaces/Built-Upon Surfaces in the Coastal Shoreline AEC is calculated by
totaling all of the impervious surfaces within the applicable distance (30 ft., 75 ft. or
575 ft.) from Normal High Water (NHW) or Normal Water Level (NWL). Sometimes
the impervious surfaces that are allowed on an individual lot are further limited by the
conditions of the subdivision's State Stormwater Management Permit. The
applicant should insert the amount of impervious coverage that is allocated to their
lot under their subdivision's State Stormwater Permit. This number is usually found
on the property deed or subdivision covenants. Typically, any subdivision that was
developed after January 1, 1988, will have a State Stormwater Plan.
On the second page of the application, the section entitled Statement of Ownership
is completed by the applicant using information from the property deed. The
applicant must check one of the three options and fill in the appropriate information.
Make sure that adjacent riparian property owners have been listed in the
Notification of Adjacent Property Owners section and that they have been
contacted by the applicant, either in person or by certified mail. Copies of the
completed letters and certified mail receipts, if required, should accompany the
application. Finally, the applicantlagent must sign and date the application at
the bottom of the page.

Coastal Management DEVELOPMENT
ENVIRONMENTAL QUALITY PERMIT
In 1974, the North Carolina General Assembly passed the Coastal Area Management Act
(CAMA) and set the stage for guiding development in fragile and productive areas that
border the state's sounds and oceanfront. Along with requiring special care by those who
build and develop, the General Assembly directed the Coastal Resources Commission
(CRC) to implement clear regulations that minimize the burden on the applicant.
This application for a minor development permit under CAMA is part of the
Commission's effort to meet the spirit and intent of the General Assembly. It has been
designed to be straightforward and require no more time or effort than necessary from
the applicant. Please go over this folder with the Local Permit Officer (LPO) for the
locality in which you plan to build to be certain that you understand what information he
or she needs before you apply.
Under CAMA regulations, the minor permit is to be issued within 25 days once a
complete application is in hand. Often less time is needed if the project is simple. The
process generally takes about IS days. You can speed the approval process by making
certain that your application is complete and signed, that your drawing meets the
specifications given inside and that your application fee is attached.
Other permits are sometimes required for development in the coastal area. While these
are not CAMA-related, we urge you to check with the Local Permit Officer to determine
which of these you may need. A list is included on page two of this folder.
