Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

CROSS EASEMENT AGREEMENT
This Cross Easement Agreement (the "Agreemene) entered into this _ day of . 2014, by and between
Daniel Ward Russell and wife, Molly Ward Russell (hereinafter "Russell!) and J. Edward Etheridge and wife,
Genevah Etheridge (hereinafter "Etheridge").

THAT WHEREAS Russell is the owner of Lot 5, Square 145 as specifically described in that certain Deed
recorded in Book 1481, Page 458, Carteret County Registry and which property has an address of 1408 Patterson
Street, Morehead City, NC; and
WHEREAS, Etheridge is the owner of Lot 4, Square 145 as specifically described in that certain Deed
recorded in Book 541, Page 30, Carteret County Registry and which properly has an address of 1406 Patterson
Street, Morehead City, NC; and
WHEREAS, the castcrmnost property line of the Russell property is a common line width the westernmost
property line of Etheridge; and
WHEREAS, it is the desire and for the mutual benefit of both parties to have a dock with a hog slat walking
surface along with handrails on treated piling approximately 185feet from the bulkhead onto the properties of
Russell and Etheridge and extending approximately5 feet wide with approximately 2.5 feet on each parties property.
NOW THEREFORE, inconsideration of these recitals, and for other good and valuable consideration, the
parties hereafter agree as follows.
1. Each party grants to the other party to this instrument, a perpetual, non-exclusive appurtenant easement far
the construction of and the repair and maintenance of and the use of all portions of the dock and bulkhead
constructed on the properties of each including a strip of land 10 feet wide on each parties property for temporary
construction and future maintenance purposes.
2. Russell agrees to be responsible for the oversight and employment of a contractor for the dock
construction and for the initial payment of the construction.

3. Etheridge agrees to reimburse Russell for a portion of the total costs, the amount and terms of which are
represented by a Promissory Note of even date herewith.
4. The parties agree to each be 50% responsible for'the fixture maintenance and/or reconstruction of said
dock, but each shall be 100% indhidually responsible for his individual addition to the dock such as boat lifts and
dock extensions.
5. Except for the bulkhead and dock, no party to this agreement shall have the right to locate, construct or
install any improvements of any nature on another party's property without their prior written consent
6. Neither party shall construct or maintain any barriers or other structure which shall prevent or
unreasonably interfere with another party's use of the dock and/or easement area.
7. The rights granted herein are in the nature of an easement Each party shall retain fee simple title to his
property and all appurtenant right, subject only to the rights granted by this instrument Nothing in this instrument is
intended to, nor shall be construed to
a) Create any rights for the dock or easement area for the benefit of the general public; or
b) Effect a dedication for the general public or the dock and/or easement area.
Neither party shall dedicate or acquiesce in the dedication of the dock, bulkhead or easement area for any
govcmmcntal entity without the others consent; which consent may be arbitrarily refused.
8. All the provisions of this Agreement, including the benefits and burdens, shall continue to nun with the
respective properties and shall be binding upon and inure to the benefit of each party and their respective heir, legal
representatives, successors and assigns.
9. Each party warrants that he has good and indefeasible fee simple title to their respective properties (subject
to Deed of Trust and other matters of public record), that each has the right to grant the easements and rights
contemplated by this Agreement, and each will forever warrant and defend title for the same against the lawful
claims of all persons or entities whomsoever.
TO HAVE AND TO HOLD all and singular rights, privileges and easements aforesaid, in, along, upon and
through the properties to the respective properties.

Hey Heather -
Ward Russell and Ed Etheridge have agreed to share a dock on Patterson Street, Morehead. I have obtained the
signatures from the Town of Morehead (Mr. McCabe) on the West side and Mr. Smith (East Side) ,without waivers.
Please let me know if you need anything else or if we need to meet out there.
The barge is on site and we are ready to start as soon as you give us the green light!
