Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

Good morning Mr. Rudolph,
My supervisor and I made a site visit to your property yesterday for your general permit request. Our inspection
revealed that you have three existing slips currently (2 wet slips and one single pole davit lift which is considered a slip).
I received the Riparian forms from the Town of Morehead City however, we do not have a general permit that will allow
for the proposed configuration. See below for explanation:
We have two section of DCM rules that we use when dealing with piers and slips for general permits. They are sections
15A NCAC 07H 1200 and 07h 2000. The 07H 1200 section allows for the permitting of docking facilities with a maximum
of 2 slips. You are currently at 3 so I cannot use this section of our rules for your project which leaves me with one other
option within the general permit process (07H 2O00 section). The 07H 2O00 section of the rules allows for the
eeEonfiguration of existing docking facilities within the same footprint without an increase in the number of existing
slips. In your case the existing footprint would be considered the most waterward edge of your platform and back
towards the shore. The configuration that you are now proposing with the boatlift on the outside of the existing
platform would be outside of the existing docking facility footprint and would add an additional fourth slip to your
existing three. I can't issue a permit using this option either with your current proposal.
Your options:
• If you want to keep the current proposal as well as all of your existing slips then you will need to apply thru our
major permit process which is a more detailed and longer process.
• If you want to continue with the general permit process than you have the option to do the following;
1. Obtain a waiver from the Town of Morehead to install the boatlift in the wet slip to the west or
Place the boatlift within the wet slip to the east or
remove two existing slip areas (leaves one existing) for the placement of the boatlift as you currently
have shown. If you do this it would meet the 07H 1200 general permit rules. The deletion of two existing
slips would entail removal of the existing tie pilings for both wet slip areas or removal of tie pilings for
one wet slip area and removal of the single pole davit lift.
