Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . Sony for the slight delay in response to this letter. We were at our coastal property and only received it on our return to Kemersville, NC. We DO OBJECT to a boat lift being placed within our scenic view on the property owned by Mitchell Moore and located at 513 Bogue Sound Dr. Emerald Isle, NC. I have responded in writing to Mr. Moore via e-mail with these same statements about two weeks ago. I have talked to Mr. Moore on the telephone and he stated to me that he isn't at his coastal property all that often and this coincides with what I have seen myself over the last year. We spend all the time we can manage at our Emerald Isle home. I have been a property owner at Emerald Isle since the 1980's and only last year bought a much more expensive property with water access and a view of the Sound. We do not want that view interrupted by an unnecessary boat lift, in front of us on our own property or to the right or left of us. We have a public boat ramp on our own street, Bogue Sound Drive, located only about 4 houses down from Mr. Moore's property. With the convenience of this on our street we don't see why someone needs to 'garage' their boat within view of our screened in porch. We would like the view preserved as natural as possible. If there are any questions please do call us. We dislike having to be disagreeable neighbors but we dislike even more having the view we paid so much for destroyed. Skvarla, III Governor Secretary April 16, 2014 Mr. Curtis Mays Ms. Margaret Ray 1740 Tredegar Rd Kernersville, NC 27284 Dear Ms. Ray and Mr. Mays: This letter is in response to your letter dated 04/03/2014 to the Division of Coastal Management through Mr. Ryan Davenport. regarding your objections to the proposed boatlift project by Mr. Mitchell Moore. The proposed project is located on a man-made canal, contiguous with Bogue Sound at 5130 Bogue Sound Drive, Emerald Isle, in Carteret County, North Carolina. The Division has reviewed your concerns and objections to the proposed project. After. reviewing the proposal along with your objections, the Division has determined that the proposed development complies with the rules of the Coastal Resources Commission in 15A NCAC 07H .1200. Therefore, the Division issued CAMA General Permit #63599-C to Mr. Mitchell Moore on April 16, 2014 for the construction of a boatlift. A copy of the permit is enclosed for your review. If you wish to contest the Division's decision to issue this permit, you may file a request for a Third Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days after the disputed permit decision is made.
