Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistentwith the North Carolina Coastal Management Program.

Let me start by saying I have been in your office and called several times before this letter.
Starting in April when I made my first complaint about the pier was out of bounds. Nobody from
your office has never contacted me, it was me who had to pursue this matter. I'm saddened by
the people in Carteret County on how they treat respectable citizens in a manner of it's not what
you know, it's who you know.
As you well know this permit was obtained by fraudulent paper work. I told you in April before all
pier posts were set that I thought it was over the riparian line. Lot 9 is the property of Bogue
Sound Shores home owners. And by law this permit needed all home owners signatures. Not
someone who doesn't even live here, so that threw the red flag right from the start.
So now because of your office, we had a riparian survey done. I feel I was correct all along and
this water is not navigable within a 100 feet or more of this pier So now here we are with a bad
(incorrect) permit that does not have the pier in its original location and we also have a pier with
no permit and there are no modification to the permit that was given to me on 4/21 /14.We the
people of Bogue Sound Shores request to have this pier removed from our riparian rights and
placed where the permit states.

This letter is in response to your e-mail correspondence dated 07/27/2014 to me on behalf of the
Division of Coastal Management regarding your objections to the authorized pier and covered platform by
Mr. John McKay. The authorized project is located on Bogue Sound, adjacent to Gales Creek at 111
Edgewater Drive, Newport, in Carteret County, North Carolina.
The Division has reviewed your concerns and objections to this project. After reviewing and
inspecting the authorized development along with your objections, the Division has determined that the
authorized development complies with the rules of the Coastal Resources Commission in 15A NCAC 07H
.1200. The Division issued CAMA General Permit #63383-C to Mr. John McKay on March 17, 2014 for the
construction of a 6' x 120' pier with a covered 15' x 26' platform. A copy of the permit is enclosed.
If you wish to contest the Division's determination to authorize this permit, you may file a request for
a Third Party Hearing. The Chairman of the Coastal Resources Commission will consider the request for a
hearing. The hearing request must be filed with the Director, Division of Coastal Management, on the
