This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

Thank you for your prompt and thorough response and explanation. I am familiar with the difference
between the property line and the riparian boundary as you explained; and based on my familiarity with the
configuration of the site and the assumption of at least 22' from the property line, I was estimating that the 15'
from the riparian boundary would not be a problem.
As indicated in my submittal, I do not want to waive the 15' from riparian boundary requirement;
however, if you confirm that is protected, I do not object to the installation of the Kuhns' boatlift as it is
diagrammed, assuming it is located at least 22' from the property line.

Good Morning Mr. Gallop,
I am the DCM field Rep. for this area of Carteret County and have been asked by the DCM director to respond to your
email and help you with any questions or concerns you may have for your neighbors proposed project. I have reviewed
the attached drawing and you are correct that it does appear they are showing 22' from the property stake. DCM's

general permit for the construction of piers: docks and boathouses in estuarine and public trust waters (includes boatlift
.installation) addresses this type of development and specifically addresses distances to riparian corridors. The rules state
that a minimumof 15' shall be met from riparian corridors. The riparian corridor is not a property line however there
are,instances where due to the channel alignment etc. it can be shown as a property line extension. Most of the time
along manmade canals the riparian corridors would be shown as property line extensions, however they can be different
et the terminus of the canal . After reviewing aerial photography and the drawing I believe that he is indeed showing a
minimum of 22' from the common property corner (stake). This does not necessary mean 22' from the riparian corridor.
Once I receive the development proposal from your neighbor I will conduct a site visit as well as sit down with my
supervisor to determine the riparian corridors within this area of the canal due to the unique situation of it being within
the vicinity of the terminus of the canal. Due to the fact you do have concerns/objections we will thoroughly evaluate
the proposal and ensure that it meets all the criteria within 15AC NCAC 07H .1200 pier rules. I will make a note about
your concerns with the project and once I receive the proposal from your neighbor I will contact you with our findings
before a permit is issued. I hope this helps and please feel free to contact me at anytime. See below for the section of
the 7H.1200 rules which addresses riparian corridors. If you need to speak with me please contact me @ 252-808-2808

(q) Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum setback
of 15 feet between any part of the pier and docking facility and the adjacent property lines extended into the water at the
points that they intersect the shoreline. The minimum setbacks provided in the rule may be waived by the written agreement
of the adjacent riparian owner(s), or when two adjoining riparian owners are co -applicants. Should the adjacent property be
sold before construction of the pier commences, the applicant shall obtain a written agreement with the new owner waiving
the minimum setback and submit it to the Division of Coastal Management prior to initiating any development of the pier or
docking facility. The line of division of areas of riparian access shall be established by drawing a line along the channel or
deep water in front of the property, then drawing a line perpendicular to the line of the channel so that it intersects with the
shore at the point the upland property line meets the water's edge. Application of this Rule may be aided by reference to the
approved diagram in Paragraph (t) of this Rule illustrating the rule as applied to various shoreline configurations. Copies of
the diagram may be obtained from the Division of Coastal Management. When shoreline configuration is such that a
perpendicular alignment cannot be achieved, the pier or docking facility shall be aligned to meet the intent of this Rule to the
maximum extent practicable.
