In earlier years, the channel was maintained by a dredge which pumped the spoils to the marina property and then the spoils were hauled away by truck. However, in more recent years, a grab dredge has been utilized with the spoils being dumped on a barge and then transported to the marina property. As a result, I believe that my riparian rights have been adversely affected by sediment spill, which has resulted in the accumulation of mud and silt in front of my property. It has become increasingly difficult to walk in the water without getting stuck in this mud and silt. I would emphasize that the amount of undesirable mud and silt is reduced as the distance is increased to the east and away from the marina channel. In my opinion, the sediment is being transported by wind and tides during the grab dredging process and a method of sediment containment should be employed to mitigate this very unacceptable result. I also believe that this sediment spillage may be environmentally harmful to the substrate on either side of the channel. I am requesting an assessment of the impact of sediment spill during the maintenance of the Gull Harbor Marina channel. If a method of containment can be employed that will reduce the sediment spill to an acceptable level, I will be happy to withdraw my objection. The proposed project is located within a man-made canal and basin, contiguous with Bogue Sound at Gull Harbor Subdivision, Newport, in, Carteret County, North Carolina. The Division has reviewed your concerns and objections to the proposed project. After reviewing the proposal along with your objections, the Division has determined that the proposed development Complies with the rules of the Coastal Resources Commission in 15A NCAC 07H .1500. Therefore, the Division issued CAMA General Permit #63805-C to Gull Harbor Marina on April 23, 2014 for maintenance excavation/dredging. A copy of the permit is enclosed for your review: If you wish to contest the. Division's decision to issue this permit, you may file a request for a Third Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. Subject: Gull Harbor Dredging General Permit Good Morning Heather, My name is Will Wallin and I am the fellow that spoke with you a while back about acquiring the permit to dredge our marina. You were very helpful and I was hoping you could help us with some more information. We have contacted our riparian neighbors and attempted to have them sign off on the releases to no avail. One of our neighbors was asked to leave our marina last year after trespassing and swore that he would never sign a riparian consent form again. He has also stated that our previous dredging has harmed his property but has no evidence to support his claim. Our second neighbor sued us, lost and was ordered to remand a riparian case by the NC Court of Appeals in Raleigh and has been unresponsive as well. After unsuccessful personal contacts, we have sent them the Certified mail versions of the riparian forms. Our local neighbors have cost us hundreds of thousands of dollars in legal fees.
