My intention is that the new dock will not prevent the use of the existing old dock structure that exists below the high water line. This requires a waiver from the 15' buffer from the DOT, who is my adjacent neighbor on both sides. I forwarded the enclosed letter to David Livingston and his Department did agree to the buffer waiver as is demonstrated by the enclosed signed waiver form. If I understand correctly, the enclosed map, the waiver letter and the check make my application complete. If I am in error about this, please be in touch. In a meeting with Roy Brownlow of NC Coastal Management, it was determined that the DOT is my adjacent neighbor and has riparian corridors on both the left and the right side of my riparian corridor. In reviewing the attached documents, please note the "existing dock by others". This is an old dilapidated dock that does not come up to the high tide line but that the owner still uses. Roy assured me that it would not be legal to rebuild it since the owner has no riparian rights, but no one has the authority to tear it down since the owner has used it for so long. In order to construct my dock and still leave the old dock owner the ability to use his dock, I need to construct within the normal 15' setback of my riparian line. Would you please review my plans and if acceptable to the DOT, please sign the Adjacent Riparian Owner Statement AND check the Waiver Section. If the plan is not acceptable to the DOT, please do call me so we can discuss the objections and possibilities. Thank you in advance for your time in this matter.
