Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

Dear Sir or Madam:
We are even more confused since receiving the revised proposal diagram from Shoreline
Marine Construction.
We were led to believe that the house is in contract and has not closed after meeting with
Mr. and Mrs. Dean. This is important, if given cart blanche, and they become unhappy, a
new owner might take advantage.
Before we sign off, we need some clarification again of the proposed parts. One of the
main reasons we are concerned is how is a 33 foot yacht/boat will affect our present view
plus another large boat. We enjoy our water view and don't want to lose any part of it.
Concerning the new drawing:
1. Although it says "replace" existing lift, we were told that it is not going to be done;
but, only the present lift repaired.
2. I think the word "replace" existing dock has been erased but just want to make sure.
3. Concerning the new lift being proposed, we were told that it would be for a 33 foot
yacht/boat but don't know if it could accommodate even a larger yacht/boat.

We are very much confused, need clarification and more information.
We just met with the real estate broker representing this property and were given mostly
conflicting answers or "I don't know." Before we sign off, we need some clarification of
the proposal parts. One of the main reasons we are concerned is how it will affect our
present water view. We enjoy our water view and don't want to lose any part of it.
Concerning the drawing:
1. Although it says "replace" existing lift, we were told it's not going to be done.
2. Although it says "replace" existing dock. We were again told, it's not going to be
done.
3. Concerning the proposed boat lift, although we were given a sheet with 8 different
sizes ranging from 4,500 lb. to 30,000 lb., she did not know which one was going to be
installed.

This letter is in response to your correspondence dated October 24, 2014, regarding your
comments and concerns about'the proposal by Mr. Roger Dean to replace the existing
pier, platform, and boatlift, and install an additional boatlift in Deer Creek, which is
contiguous to Bogue SoundJocated at 533 Neptune Drive, in Cape Carteret, Carteret
County.
The proposed project is to replace a 5' by 40' long pier with a 16' by 24' platform, replace
an existing on the north side of the platform, and add a new 13' by 13' boatlift to the south
side of the platform. The development is not to exceed 56' waterward from the existing
bulkhead and is not to encroach closer than 15' to the riparian access lines.
The Division has determined that the proposed development complies with the rules of the
Coastal Resources Commission in 15A NCAC 07H.1200. Therefore, the Division issued
CAMA General Permit #65278-C to Mr. Roger Dean on November 04, 2014. A copy of the
permit is enclosed for your review.
If you wish to contest the Division's decision to issue this permit, you may file a request for
a third party hearing. The Chairman of the Coastal Resources Commission may consider
the request for a hearing. The hearing request must be filed with the Director, Division of
Coastal Management, in writing and must be received within twenty (20) days after the
permit decision is made. The applicable forms and instructions are enclosed. Please

hereby requests permission from the Coastal Resources Commission (CRC) to file an appeal pursuant
to N.C.G.S. § 113A-121.1(b) and 15AN.C.A.C. 07J .0301. (Please attach a copy of the permit. Ifyou
cannot obtain a copy of the permit, please provide the name of the permittee, the project location, and
the permit number.) Requests are, reviewed and determined by the chairman of the CRC to determine
whether a hearing should be granted. 15A N.C.A.C. 07J .0301(b). Approval of a Third Party Hearing -
Request allows a petitioner to file a contested case petition with the Office of Administrative Hearings
within twenty (20) days of receipt of the CRC's Order. N.C.G.S. § 113A-121.1(b). Denial of a Third
Party Hearing Request is a final agency decision which may be appealed to Superior Court under
N.C.G.S. § 113A-121.1(b) and Chapter 15013, Article 4.
For this application to be complete, the Petitioner must address each of the three factors listed below.
The CRC's chairman's decision to grant a hearing will be based on -whether the Petitioner:
(1) Has alleged that the decision is contrary to a statute or rule [N.C.G.S. § 113A-121.1(b)(1)];
(Please cite the statute or regulation allegedly violated by the permit decision.)
(2) Is directly affected by the decision [N.C.G.S. § 113A-121.1(b)(2)]; and
