The initial letter was written on January 14, 2008, with a follow-up letter written on January 22, 2008. The request for canal widening and improvements to an existing boat basin was made by T.D. Eure on behalf of the applicant. The NC Division of Coastal Management has considered your objections to the proposed development, and has reviewed those objections with the rules and regulations of the Coastal Resources Commission. The Division has determined that the proposed development is consistent with the rules of the CRC, and is in keeping with the intent of those rules. Therefore, General Permit #52195 was written to Bogue Front LLC on 1/30/08. If you choose to appeal the decision made by the Division, you may do so within 20 days of the date of the permit. These babies have also been found in the canal entrance 2 - Re my NOTE on page 2 of the 1/14 letter.. It was in the early 1980's before I began seeing pelicans, ospreys and mussels; therefore, I have concluded that our anti -pollution efforts have been and are achieving positive results. The marsh grass and sea grass in front of our home and in front of Bogue Front LCC (formally Hoadley) (300 feet total) is the home and feeding grounds to pelicans, cranes, ducks, and herons. The mouth of the subject canal which is almost closed except at high tide has been a marvelous breding ground for minnows and other sea life. I am very concerned about the effect that this dredging and increased canal and boat basin usage will have on the environment of this habitat. I am therefore requesting that the CA_MA treatment of this application be upgraded from a minor to a MAJOR review process. The subject Basin was originally designed to service 4 docks for 4 families; it is proposed that this be increased to 8 docks to service a new subdivision and at least 2 of the houses that abut the subject area. I have further talked with the Marine Fisheries, regulation department and have been advised that we are now in a conditionally approved closed area. Further, I have been advised that the dredging and increased boating activity will probably cause us to become permanently closed to shell fishing. NOTE : 35 years ago Marine Fisheries explained to me. It " used to be" they closed only small sections of Bogue Sound when the cuneiform bacterial p..z count became to high; however, this was logistically too expensive for testing and difficult to regulate the numerous small sections. If I remember correctly prior to this change the waters were only closed 200 feet of either side of the canals. Now this conditionally approved closed covers the area from Florida Park to Gull Harbor. If CAMA does not see fit to stop the expansion of this boat basin ( I understand that it takes 10 boat slips to constitute a marina) or even if it just allows dredging to the original size, I would request that instead of the planned clam- shell/ bucket dredging and spoils dumping. via dump truck into an area almost immediately adjacent to the boat basin, that the dredging be done by suction pipeline into the new proposed spoils area. This would cut down appreciably on the silt, mud, Ect, Stirred up and dumped into Bogue Sound. I would further request that curtains be used across the canal entrance into Bogue Sound and again curtains be used around the to be dredged area in Bogue sound proper. NOTE : Some night time " kick -back dredging" was done and reported to Marine Fisheries the summer of 2006. As a result the shore line in front of our house which is 175 feet from the canal is still 6-8" deep in mud instead of its normal 2-3". Our crab grass is still not well recovered. Now I have a VERY major complaint. Attached herewith are the document, map, and copy of the envelope in which these items arrived. This is everything that was mailed to me. Nowhere was I advised that this was an official notification from CAMA. Nowhere was I advised that I only had 30 days (I have just today learned that for a general (minor) permit the time is only 10 days ) to respond. Even though I have had several phone conversations initiated by me with CAMA and with the construction company in response to what I assumed was preliminary paperwork with some agency, at no time did anyone tell me that this was the official CAMA notification and all that I would receive or that i only had 30 days ( or 10 days) to respond. I signed for the certified letter on 12/23/07. I have just been advised today that CAMA feels that as soon as i saw Riparian property on the form ( not even a form number) that I should have known it was from CAMA. I am the general public and had no knowledge that this was from CAMA. It came from TD Eure construction. I feel that I or anyone else in my position should be given much more complete initial inf* 14 Mb I. As the canal will be widened ( new work) and the number of boat slips will be increased from 3 to 8 with the possibility of more later, why wasn't this considered major to begin with? I reinterate my earlier request that CAMA upgrade this review process from minor to major. II. That the type of dredging be shifted from clamshell and dumptruck to pipeline / suction. With the use of the afore mentioned curtins. III. Eure on behalf of the applicant. The NC Division of Coastal Management has considered your objections to the proposed development, and has reviewed those objections with the rules and regulations of the Coastal Resources Commission. The Division has determined that the proposed development is consistent with the rules of the CRC, and is in keeping with the intent of those rules. Therefore, General Permit #52195 was written to Bogue Front LLC on 1/30/08. If you choose to appeal the decision made by the Division, you may do so within 20 days of the date of the permit.
