In an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Travis and Mary Day, authorizing development in the Estuarine Shoreline (AEC) at 708 Bay Street, in
Morehead City, Carteret County, North ::arolina 28557, as requested in the permittee's application dated March_18,
2009,' and in the modification request datf -d May 26, 2009. This permit modification, issued on June 3, 2009i is subject
to compliance with the application, modification request, and revised site drawings (where consistent with the permit), all
applicable regulations and special condilions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: the construction of a n aw single-family dwelling, porches, decks, and associated landscaping including fill
dirt and the construction of a retaining wall on the east side of the property.
(1) All proposed development and associated construction must be done in accordance with the revised permitted work plat
drawings dated received on March -I 3, 2009, and the revised work plat drawings dated received on May 26, 2009.

This permit action may be appealed by the permittee ,x Other qualified persons
within twenty (20) days of the issuing date. From ui-: date of an appeal, any
worK conducted under this permit must cease until thr appeal is resolved. This
permit must be on the project site and accessible to it a permit officer when the
project is inspected for compliance. Any maintenance work or pr�ect
modification not covered under this permit, requira further written permit
approval. All work must cease when this permit expires on:

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of the Normal High Water
Level (Estuarine Shoreline Area of environmental Concern).
(6) Unless specifically allowed in 15A NCAC 07H.0209(d)(10), and shown on the permitted plan drawing, all
developmenticonstruction shall be Ic cated a distance of 30 feet landward of Normal High Water Level. No portion of
the roof overhang shall encroach int) the 30-foot buffer.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth (silt
fence) must be properly installed bemeen the land disturbing activity and the adjacent marsh or water areas, until
such time as the area has been properly stabilized with a vegetative cover. Silt fence shall be installed such that it
is properly toed -in to the soil (see attached diagram). Sedimentation and erosion control measures shall be properly
maintained throughout the construa ion period.
(8) The silt fence must be inspected prior to the commencement of construction.
(9) This permit does not authorize devE lopment within any wetlands or open water areas.
(10) Pursuant to 15A NCAC, Subchapiar 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.

Mean High Wate -Analysis, 708 Bay Street Morehead City, NC
Introduction
Chris Freeman and David Bernstein were contracted by Travis and Mary Day to provide a tidal
datum survey of their 708 Bay `treet property in Morehead City, North Carolina. Precise
measurements of an areas ticlat datum's require either the use of the nearest tidal benchmark
with the appropriate transformations or the use of a tidal datum model. All methods of
calculation are based on 19 years of tidal observation (the Present Epoch'is 1983 to 2001) for a
particular area and then model ad for the particular area of interest.
In this particular case the nearest bench mark with the tidal datum transformations was the
Coast and Geodetic Survey (CG,;) mark X 112 (PID EA4107). While calculations made from this
mark, which is less than 2 milea from the property, are likely very accurate for the upper Calico
Creek regions we went a step further and used the joint NOAA's (National Geodetic Survey,
Office of Coast Survey and the -.enter for Operational Oceanographic Projects and Services)
VDatum tool that calculated th : Mean High Water (MHW) contour at the property itself.
VDatum was designed to vertically transform geospatial data among a variety of tidal,
orthometric and ellipsoidal vertical datum's allowing users to convert their data, in this case
NAVD 88, from different horizrntal/vertical references into a tidal datum for any shoreline or
bathymetric dataset that is wirnin the VDatum model grid boundary.
Methods
The MHW contour was calculal ed for the Day property using the VDatum tool and verified
using CGS mark X 122. The MI- W value is 0.3577m (NAVD88) for the property using the Present
tidal Epoch. A real-time kinematic Global Positioning Systems (RTK-GPS) base was established
on the mark IMS-Base at the U NC Chapel Hill Institute of Marine Science. iMS-Base was
established in 2005 for hydros *aphis survey operations for the North Carolina Division of
Coastal Management and the US Army Corps of Engineers Wilmington District using a least
squares network adjustment aad followed by a full site calibration (end of document). The
base has since undergone a vertical adjustment from NGVD 29 to NAVD 88 using the National
Geodetic Survey utility VertCOA. A similar site calibration followed this adjustment and vertical
deviation averages calculated back to 0.013 m (1.3 cm) or 0.042 ft.
An RTK-GPS rover (Trimble 57C 0 w/ Zepher L1/L2 antenna) was used to locate the MHW
contour at the property location. A leveled 2 m rod assembly with a foot base was used to
locate several MHW points on the property and precisely delineate the contour. Once the shot
was taken the foot base was removed and a stake driven directly over the point. Finally a
Ramset nail was placed on the SE corner of the property and surveyed to NAD 83 NAVD 88
coordinates to assist with any additional survey operations the property owner requires.

Pursuant to NCGS I I3A-119(b), Town of Morehead City, a locality authorized to issue
LAMA permits in Areas of Envy onmental Concern, hereby gives NOTICE that on March 18,

Dear Ms. Kedzierski:
I have reviewed the informatia;,q submitted to this office in your inquiry concerning the necessary filing of
an application for a CAMA Minor Development Permit under the Coastal Area Management Act. After making
a site inspection on 117109,1 have datermined that the activity you propose is exempt from needing a LAMA
Minor Development Permit, as long as it remains consistent with your project drawing, submitted on January
7, 2009,and it also meets the cond.t ons specified below. If you plans should change and your project will no
longer meet these conditions, plea;: contact me before proceeding.
SINGLE FAMILY RESIDENCES Y1 THIN THE ESTAURINE SHORELINE AREA OF ENVIRONMENTAL
CONCERN EXEMPTED
1. All development : hall be located at least 40 feet of the mean high water mark or normal
water level, and mall not exceed a 30% impervious coverage, within 75 feet of the mean
high water mark c r normal water level.
2. No ground disturt ante or land disturbing activity shall occur within 40 feet of the mean high
water mark or normal water level.
I The development shall be consistent with all other applicable CAMA permit standards,
North Carolina Bt ilding Code standards, local ordinances and local land use plans in effect
at the time the ex.mption is granted.
This exemption to CAMA pernt't requirements does not alleviate the necessity of your obtaining any other
State, Federal or Local authorixabw. This exemption expires one (1) year from the date of the letter.
