Dear Mr. Whichard:
I have reviewed the information submitted to this office in your letter concerning the necessary filing of an application
for a minor development permit under the Coastal Area Management Act. After speaking with Rich Weaver,
Assistant Major Permits Coordinator for the Morehead City Division of Coastal Management, I have determined that
the activity you propose is exempt from needing a minor development permit because it falls under the LAMA repair
and maintenance rules under 15A NCAC 07K.0209 (c) and Rule 07J.0210,
Exemption Criteria:
1. The repair must not disturb a land area of greater than 200 square feet.
2. The repair must not involve filling, excavation, or the alteration of sand dunes or beach.
3. The repair must not involve removal, damage, or destruction of threatened or endangered animal or plant
species.
4. The repair must not alter naturally or artificially created surface drainage channels.
5. The repair must be consistent with all applicable use standards and local land use plans in effect at the time
the exemption is granted.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State,
Federal or Local authorization. No building permit is required by the Town of Morehead City for this project. This
exemption expires 90 days from the date of the letter.

On September 28' the CJNC Tnstitate ofMari n4 Science; had and Overflow event in one
of our earthen experimental ponds. This overflow event ate away a section of the dike
between the pond and the seawall measuring S'X3'X2'- We would like to repair the
breach using rock and rip wrap.

Subject: berm repair at IMS
Hey Jeannie, it was nice talking with you this morning. T stopped by
TMS on Thursday October 4th to take a look at their request to repair a
high -ground berm wall, surrounding a research pond, that developed a
minor breach. The area in need of repair is no more than about 2 feet
wide by 1 foot deep by 6 feet long. The repair is on high -ground but
does fall within the AEC, howevar t believe an Exemption is in order
under our repair and maintenance rules. rve consulted with other staff
members here at the office and they agree that an exemption is in order_
