in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management'
Issued to the Town of .Morehead .City, authorizing development in the Estuarine Shoreline (AEC). at. Harbor. Dr,_ in
Morehead City, as requested in the permittee's application, dated 1/26/07. This permit, issued on 6/25/07, is subject to
compliance with the application and site drawing (where consistent with the permit), all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment
or civil action, or may.cause the permit to be null and void.
This permit authorizes: Construction of a 6' wide wooden boardwalk along Harbor Dr.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 6/13/07.
(2) All construction must conform to the N.C. Building Code requirements and all other local, Sta`, d Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (252) 808-2808 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
DECEMBER 31, 2010
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of NHW. No portion of the roof overhang
shall encroach into the 30 ft. buffer. In this case a 6' wide wooden boardwalk is allowed in the buffer
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(7) Any proposed for grading within the 30' buffer from the NHW must be contoured to prevent additional stormwater
runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated
state.
(8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

Notice is hereby given that the town of Morehead City has applied to the Department of
Environment and Natural Resources for a CAMA Minor Development permit.. The town is
requesting to construct a 6' wide boardwalk. The property is located on Harbor Dr. in Morehead
City, NC, Carteret Co.
Persons desiring to inspect the application, or to comment thereon, are directed to contact

SUBJECT: Encroachment Contract- Carteret County (16-t
Attached hereto, for your files, is a copy of the Right of Way Encroachment Contract,
which has been properly executed. The contract covers the following:
Sidewalk along SR 1297 in Morchead City tirom Lanid's End Road to NC 24.
APPROVED SUBJECT TO SPECIAL PROVISIONS:
1) The encroaching party shall notify the District Engineer's office [telephone no.(252)
514-4716] prior to beginning construction and upon completion of construction.
2) NCDOT does not guarantee the right of way on this road, nor will it be responsible
for any claim for damages brought about by any property owner by reason of this
installation.
3) The encroaching parry is required to contact the appropriate Utility Companies
involved and make satisfactory arrangements to adjust the utilities in conflict with the
proposed work prior to beginning construction.
4) The encroaching party shall contact the North Carolina One Call Center at 1-80M32-
4949 and make satisfactory arrangements to adjust the utilities in conflict with the
proposed work prior to construction
5) The Contractor shall not begin the construction until after the traffic control and
erosion control devices have been installed to the satisfaction of the District Engineer.
6) Trenching, bore pits and/or other excavations shall not be left open or unsafe
overnight. The Contractor shall comply with all OSHA requirements and provide a
competent person on site to supervise excavation at all times.

7) All fill areas/backfill shall be compacted to 95% density in accordance with
AASHTO T99 as modified by the NCDOT. All material to a depth of 8 inches below
the finished surface of the subgrade shall be compacted to a density equal to 100% of
that obtained by compacting a sample of the material in accordance with AASHTO
T99 as modified by the Department. The Contractor shall dry or add moisture to the
subgrade when required to provide a uniformly compacted and acceptable subgrade.

8) All earth areas disturbed shall be graded, dressed, seeded, mulched, and tacked with
liquid asphalt or other approved means within 10 days of completion of work in any
area.
9) All erosion control devices and measures shall be constructed, installed, maintained,
and removed by the Encroacher in accordance with all applicable Federal, State, and
local laws, regulations, ordinances, and policies. All earth areas disturbed shall be re-
graded, and seeded in accordance with NCDOT Standards and Specifications.
10) All workmanship and materials shall conform to North Carolina Department of
Transportation Standards and Specifications manual,
11) The encroaching party shall comply with all applicable federal, state and local
environmental regulations, and shall obtain all necessary federal, state and local
environmental permits, including but not limited to, those related to sediment control,
storm water, wetland, streams, endangered species and historical sites.
12) All existing structures, drainage or otherwise, Iocated inside the Right of Way that are
affected by this work shall .be restored to meet the NC. D. Q. T. Standards and
Specifications as directed by the District Engineer.
13) All driveways altered during construction shall be returned to a state comparable with
the condition of the driveways prior to construction. N-C.DOT accepts no
responsibility for the existing driveways. It shall be the Encroacher's obligation to
maintain access to homes and businesses at all times.
14) Traffic Control Devices shall be in accordance with the manual on Uniform Traffic
Control Devices and amendments or supplements thereto.
15) Two way traffic shall be maintained at all times.
16) Any work requiring equipment or personnel within 5 feet of the edge of the travel
lane shall require a lane closure with appropriate tapers.
17) During non -working hours, equipment shall be parked as close to right of way lines
as possible and be properly barricaded in order to not have any equipment obstruction
within the Clear Recovery Area.

18) All roadway signs that are removed due to construction shall be reinstalled as soon as
possible.
19) Excavation within 500 feet of a signalized intersection will require notification by the
party of the second part to the Division Traffic Engineer at telephone number (252)
830-3490. All traffic signal or detection cables must be located prior to excavation.
20) Excavation material shall not be placed on pavement. Drainage structures shall not be
blocked with excavation materials.
21) All soils located inside the Right of Way shall be considered a type "C" soiI. All
trenching, shoring and excavation shall follow the OSHA guidelines for this type of
soil.
22) Any drop off greater than 2" from the edge of pavement shall be made safe by using a
6:1 slope or flatter or a width of 6 feet
23) Any damage to the control of access fencing shall be repaired the same day.
24) Proper grading to facilitate drainage shall be done at the end of each day's activities
25)An executed copy of this encroachment agreement, contract, and plans shall be
present at the construction site at all them during construction. tf safety or traffic
conditions warrant such action, NCDOT reserves the right to further limit, restrict,
or suspend operations within the right of way.

RIGHT OF WAY ENCROACHMENT AGREEMENT
FOR NON -UTILITY ENCROACHMENTS ON
PRIMARY AND SECONDARY HIGHWAYS
THIS AGREEMENT, made and entered into this the _0-111 day of && , 20 07 , by and between the Department
of Transportation, party of the first part; and Town of Morehead City party of the second part,
WITNESSETH
THAT WHEREAS, the party of the second part desires to encroach an the right of way of the public road designated as
Route(s) NCSR 1297 - Harbor Drive , located between NC Highway 24 and Land's End Road
with the construction and/or erection of: Approximately 1,650 square yards of 5 ft. wide sidewalk along the east side of
Harbor Drive and approximately 455 LF of 6 ft. wide wooden sidewalk along the east side of Harbor Drive.
WHEREAS, it is to the material advantage of the parry of the second part to effect this encroachment, and the party of
the first part In the exercise of authority conferred upon It by statute, is willing to permit the encroachment within the limits of the
right of way as indicated, subject to the conditions of this agreement;
NOW, THEREFORE, IT IS AGREED that the party of the first part hereby grants to the party of the second part the right
and privilege to make this encroachment as shown on attached plan sheet(s), specifications and special provisions which are
made a part hereof upon the following conditions, to wit:
That the said party of the second part binds and obligates himself to install and maintain the encroaching facility in such safe and
proper condition that it will not interfere with or endanger travel upon said highway, nor obstruct nor interfere with the proper
maintenance thereof, to reimburse the party of the first part for the cost incurred for any repairs or maintenance to its roadways and
structures necessary due to the installation and eudstence of the facilities of the party of the second part, and if at any time the party of
the first part shall require the removal of or changes in the location of the said facilities, that the said party of the second part binds
himself, his successors and assigns, to promptly remove or alter the said facilities, in order to conform to the said requirement, without
any cost to the party of the first part.
That the party of the second part agrees to provide during construction and any subsequent maintenance proper signs, signal
lights, flagmen and other warning devices for the protection of traffic in conformance with the latest Manual on Uniform Traffic Control
Devicas f2r Streets and Highways and Amendments or Supplements thereto. Information as to the above rules and regulations may be
obtained from the Division Engineer of ft party of the first part.
That the party of the second part hereby agrees to indemntty and save hamdess the party of the first part from all damages and
claims for damage that may arise by reason of the installation and maintenance of this encroachment.
It is dearly understood by the party of the second part that the party of the first part will assume no responsibility for any damage
that may be caused to such facilities, within the highway rights of way limits, in carrying out its construction and maintenance
operations.
That the party of the second part agrees to restore all areas disturbed during installation and maintenance to the satisfaction of
the Division Engineer of the party of the first part. The party of the second part agrees to exarc(se every reasonable precaution during
construction and maintenance to prevent eroding of soil; silting or pollution of rivers, streams, lakes, reservoirs, other water
Impoundments, ground surfaces or other property; or pollution of the air. There shall be compliance with applicable rules and
regulations of the North Carolina Division of Environmental Management, North Carolina Sedimentation Control Commission, and with
ordinances and regulations of various counties, munlclpailtles and other official agencies relating to pollution prevention and control.
When any installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part
agrees to ramovs and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the
party of the first part.
That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by
the Division Engineer of the party of the first part
That the party of the second part agrees to have available at the encroaching site, at all times during construction, a copy of this
.agreement showing evidence of approval by the party of the first part. The party of the first part reserves the right to stop all work
unless•avidence•otapprovat-can'b:e'shoam---
Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the second
part agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has been
completed. Unless specifically requested by the party of the first part, written notice of completion of work on highway projects under
constructiori will not be required.
That in the case of noncompliance with the terms of this agreement by the party of the second part, the party of the first part
reserves the right to stop all work until the facility has been brought into compliance or removed from the right of way at no cost to the
party of the first part.
That it is agreed by both parties that this agreement shalt become void if actual construction of the work contemplated herein is
not begun within one (1) year from the date of authorization by the party of the first part unless written waiver is secured by the party of
the second part from tho parry or the first pert.

INSTRUCTIONS
When the applicant is a corporation or a municipality, this agreement must have the corporate seat and
be attested by the corporation secretary or by the empowered city official, unless a waiver of corporate
seal and attestation by the secretary or by the empowered City official is on file in the Raleigh office of
the Manager of Right of Way. • In the space provided In this agreement for execution, the name of the
corporation or municipality shall be typed above the name, and title of all persons signing the agreement
should be typed directly below their signature.
When the applicant Is not a corporation, then his signature must be witnessed by one person. The
address should be Included in this agreement and the names of all persons signing the agreement
should be typed directly below their signature.
This agreement must be accompanied, in the form of an attachment, by plans or drawings showing the
following applicable information:
1. All roadways and ramps.
2. Right of way lines and where applicable, the control of access lines.
3. Location of the proposed encroachment.
4. Length and type of encroachment.
5. Location by highway survey station number. If station number cannot be obtained, location
should be shown by distance from some identifiable point, such as a bridge, road,
intersection, etc. (To assist in preparation of the encroachment plan, the Department's
roadway plans may be seen at the various Highway Division Offices, or at the Raleigh
office.)
6. Drainage structures or bridges if affected by encroachment.
7. Typical section indicating the pavement design and width, and the slopes, widths and
details for either a curb and gutter or a shoulder and ditch section, whichever Is applicable.
8. Horizontal alignment indicating general curve data, where applicable.
9. Vertical alignment indicated by percent grade, P.I. station and vertical curve length, where
applicable.
10. Amount of material to be removed and/or placed on NCDOT right of way, if applicable.
11. Cross -sections of all grading operations, indicating slope ratio and reference by station
where applicable.
12. All pertinent drainage structures proposed. Include all hydraulic data, pipe sizes, structure
details and other related Information.
13. Erosion and sediment control.
14. Any special provisions or specifications as to the performance of the work or the method of
construction that may be required by the Department must be shown on a separate sheet
attached to encroachment agreement provided that such Information cannot be shown on
plans or drawings.
15. The Department's Division Engineer should be given notice by the applicant prior to actual
starting of installation included in this agreement.
16. Method of handling traffic during construction where applicable.
17. Scale of plans, north arrow, etc.

The Town of Morehead City plans to construct a new sidewalk located along the eastern
right. of way of Harbor Dr in the vicinity of Peletier Creek. The Town is required to
obtain a CAMA permit prior to construction.
In order to obtain a CAMA permit the Town is required to provide written notice of the
proposed project to adjoining riparian property owners. The purpose of this letter is to
provide notice of the project in accordance with the CAMA requirements.
Proposed improvements that will require a CAMA. permit will be the installation of
approximately 465' of a ground level wooden walkway at the point where Spooner's
Creek runs up to Harbor Dr.
Property owners desiring to comment on the proposed work must do so in writing within
thirty (30) days of receipt of this notice. No response will be interpreted as no objection.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may be susceptible to
erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular hazard problems associ-
ated with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing tech-
niques.
PERMISSION TO ENTER ON LAND:
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer and his agents to
enter on the aforementioned lands in connection with evaluating information related to this permit application.
This application includes: general information (this form), a site drawing as described on the back of this application, the
ownership statement, the AEC hazard notice where necessary, a check for $100.00 made payable to the locality, and any infor-
mation as may be provided orally by the applicant. The details of the application as described by these sources are incorporated
without reference in any permit which may be issued. Deviation from these details will constitute a violation of any permit. Any
person developing in an AEC without permit is subject to civil, criminal and administrative action.
