This permit authorizes: Construction of a 6' wide wooden boardwalk along Harbor Dr. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on 6/13/07. (2) All construction must conform to the N.C. Building Code requirements and all other local, Sta`, d Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (7) Any proposed for grading within the 30' buffer from the NHW must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. The contract covers the following: Sidewalk along SR 1297 in Morchead City tirom Lanid's End Road to NC 24. APPROVED SUBJECT TO SPECIAL PROVISIONS: 1) The encroaching party shall notify the District Engineer's office [telephone no.(252) 514-4716] prior to beginning construction and upon completion of construction. 2) NCDOT does not guarantee the right of way on this road, nor will it be responsible for any claim for damages brought about by any property owner by reason of this installation. 3) The encroaching parry is required to contact the appropriate Utility Companies involved and make satisfactory arrangements to adjust the utilities in conflict with the proposed work prior to beginning construction. 4) The encroaching party shall contact the North Carolina One Call Center at 1-80M32- 4949 and make satisfactory arrangements to adjust the utilities in conflict with the proposed work prior to construction 5) The Contractor shall not begin the construction until after the traffic control and erosion control devices have been installed to the satisfaction of the District Engineer. 6) Trenching, bore pits and/or other excavations shall not be left open or unsafe overnight. All material to a depth of 8 inches below the finished surface of the subgrade shall be compacted to a density equal to 100% of that obtained by compacting a sample of the material in accordance with AASHTO T99 as modified by the Department. The Contractor shall dry or add moisture to the subgrade when required to provide a uniformly compacted and acceptable subgrade. All material placed in a maxfi um of 6" lifts, 8) All earth areas disturbed shall be graded, dressed, seeded, mulched, and tacked with liquid asphalt or other approved means within 10 days of completion of work in any area. 9) All erosion control devices and measures shall be constructed, installed, maintained, and removed by the Encroacher in accordance with all applicable Federal, State, and local laws, regulations, ordinances, and policies. All earth areas disturbed shall be re- graded, and seeded in accordance with NCDOT Standards and Specifications. 10) All workmanship and materials shall conform to North Carolina Department of Transportation Standards and Specifications manual, 11) The encroaching party shall comply with all applicable federal, state and local environmental regulations, and shall obtain all necessary federal, state and local environmental permits, including but not limited to, those related to sediment control, storm water, wetland, streams, endangered species and historical sites. 12) All existing structures, drainage or otherwise, Iocated inside the Right of Way that are affected by this work shall .be restored to meet the NC. D. Q. T. Standards and Specifications as directed by the District Engineer. 13) All driveways altered during construction shall be returned to a state comparable with the condition of the driveways prior to construction. N-C.DOT accepts no responsibility for the existing driveways. All traffic signal or detection cables must be located prior to excavation. 20) Excavation material shall not be placed on pavement. Drainage structures shall not be blocked with excavation materials. 21) All soils located inside the Right of Way shall be considered a type "C" soiI. When any installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part agrees to ramovs and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the party of the first part. That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by the Division Engineer of the party of the first part That the party of the second part agrees to have available at the encroaching site, at all times during construction, a copy of this .agreement showing evidence of approval by the party of the first part. Drainage structures or bridges if affected by encroachment. 7. Typical section indicating the pavement design and width, and the slopes, widths and details for either a curb and gutter or a shoulder and ditch section, whichever Is applicable. 8. Horizontal alignment indicating general curve data, where applicable. 9. Vertical alignment indicated by percent grade, P.I. station and vertical curve length, where applicable. 10. Amount of material to be removed and/or placed on NCDOT right of way, if applicable. 11. The Town is required to obtain a CAMA permit prior to construction. In order to obtain a CAMA permit the Town is required to provide written notice of the proposed project to adjoining riparian property owners. The purpose of this letter is to provide notice of the project in accordance with the CAMA requirements.
