DEVELOPMENT
PERMIT
In 1974, the North Carolina General Assembly passed the Coastal Area
Management Act and set the stage for guiding development in fragile and
productive areas that border the state's sounds and oceanfront. Along with
requiring special care by those who build and develop, the General As-
sembly directed the Coastal Resources Commission (CRC) to implement
clear regulations that minimize the burden on the applicant.
This application for a minor development permit under CAIIIA is part of
the Commission's effort to meet the spirit and intent of the General As-
sembly. It has been designed to be straightforward and require no more
time or effort necessary from the applicant. Please go over this folder with
the Local Permit Officer (LPO) for the locality in which you plan to build to
be certain that you understand what information he or she needs.
Under CAMA regulations, the minor permit is to be issued within 25 days
once a complete application is in hand. Often less time is needed if the
project is simple. The process generally takes about 18 days. You can
speed the approval process by making certain that your application is com-
plete and signed, that your drawing meets the specifications given inside
and that your application fee is attached.
Other permits are sometimes required for development in the coastal area.
While these are not CAMA-related, we urge you to check with the Local
Permit Officer to determine which of these you may need. A listing is in -
eluded on page 2 of this folder.
We'appreciate"your cooperation with the North Carolina Coastal Manage-
ment Program and your willingness to build in a way that protects the
resources of our beautiful and productive coast.

You may recall during our meeting in your office on August 24, 2006 that it was decided that
the filing of a CAMA Major Development Permit would not be necessary for the boardwalk and
observation platform proposed for construction at the Rachel Carson Reserve. Instead, it was
determined that permitting for part of boardwalk could be accomplished through issuance of a
CAMA General Permit while the platform and the remainder of the boardwalk could be
permitted through a CAMA Minor Development Permit. We are, therefore, writing on behalf of
the Town of Beaufort and their partner, the North Carolina National Estuarine Research
Reserve, to request that your office issue the necessary permits so that construction of the
boardwalk and observation platform can proceed. To that end, we have enclosed the
following items:
• two checks each in the amount of $100.00 made payable to the "NC Div of Coastal
Mgmt• to cover the application fees for the General Permit and the Minor Permit;
• a completed " Application for CAMA Minor Development Permit" bearing the dated
original signature of the Beaufort Town Manager;
• a copy of a December 15, 2005 letter by Rebecca Ellin of the North Carolina National
Estuarine Research Reserve giving the Town of Beaufort permission to act as an
applicant for the permit to construct the boardwalk and platform;
• a copy of a June 5, 1987 letter by James S. Lofton, Secretary of Administration for the
N.C. Department of Administration to Mr. S. Thomas Rhodes, Secretary of the N.C.
Department of Natural Resources and Community Development that allocates the
Rachel Carson Reserve to the Department of Natural Resources and Community

copy of which we provided to your office when we filed a CAMA Major Development

You will note from examination of the enclosed Application that there is no list of adjacent
waterfront landowners. Such a list is not given in the Application because we understand that
the Rachel Carson Reserve is located on an island owned in totality by the State of North

Again, we respectfully request that your agency issue the appropriate permits allowing
construction of the proposed boardwalk and observation platforms. As such, please do not

The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major Permit
Application for Rachel Carson Reserve Boardwald on August 18, 2006. Staff review of the plans and
specifications has determined that the development activities proposed at this time will not pose a threat to
surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and
approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this
letter, we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is
also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements.
You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. Please
note that the stormwater rules require the Division to permit the common plan of development, therefore, any
future development on the property, regardless of whether a CAMA Major permit is also required, will require a
Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any
construction.

Because the project has no proposed BUA, it qualifies for an exemption under the.
stormwater rules. The $420.00 application fee will be returned to the Town of.
Beaufort with their exemption letter.

Dear Ms. Ellen:
Morehead City DC.M
This letter is being sent on behalf of Mr. Chris Frabotta,
Navigation Project Manager, who is currently.stationed in
Washington, DC.
• After reviewing the plans you provided, your proposal to
construct a wooden walkway on a disposal area within the U.S.
Army Corps of Engineers Right -of -Way at Taylors Creek has been
approved. This wooden walkway should not be permanently
attached to any other structures because in the course of
operating and maintaining the Federal Navigation Channels we may
need to use the disposal area and would require you to remove
the portion that is within.the Right -of -Way at no cost to the
Government.
Please let me know if you have any questions or further
concerns. You may contact me.at (910) 2.51-4822. Also, please
provide us with an as -built survey of all construction of the
walkway within the Right -of -Way.
Sincerely,
Roger D. Bullock
Chief, Navigation Branch
