This permit, issued on 4/11/07, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of boardwalk and viewing platform (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on 9/20/06. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 252-808-2808 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2010 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan "and all applicable ordinances. (6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of NHW. The proposed unenclosed decking is allowed. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the NHW must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. MoWTW*W0rVD0M CAMAMINOR DEVELOPMENT PERMIT In 1974, the North Carolina General Assembly passed the Coastal Area Management Act and set the stage for guiding development in fragile and productive areas that border the state's sounds and oceanfront. Along with requiring special care by those who build and develop, the General As- sembly directed the Coastal Resources Commission (CRC) to implement clear regulations that minimize the burden on the applicant. This application for a minor development permit under CAIIIA is part of the Commission's effort to meet the spirit and intent of the General As- sembly. It has been designed to be straightforward and require no more time or effort necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand what information he or she needs. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in hand. Often less time is needed if the project is simple. The process generally takes about 18 days. You can speed the approval process by making certain that your application is com- plete and signed, that your drawing meets the specifications given inside and that your application fee is attached. Other permits are sometimes required for development in the coastal area. While these are not CAMA-related, we urge you to check with the Local Permit Officer to determine which of these you may need. A listing is in - eluded on page 2 of this folder. Instead, it was determined that permitting for part of boardwalk could be accomplished through issuance of a CAMA General Permit while the platform and the remainder of the boardwalk could be permitted through a CAMA Minor Development Permit. We are, therefore, writing on behalf of the Town of Beaufort and their partner, the North Carolina National Estuarine Research Reserve, to request that your office issue the necessary permits so that construction of the boardwalk and observation platform can proceed. To that end, we have enclosed the following items: • two checks each in the amount of $100.00 made payable to the "NC Div of Coastal Mgmt• to cover the application fees for the General Permit and the Minor Permit; • a completed " Application for CAMA Minor Development Permit" bearing the dated original signature of the Beaufort Town Manager; • a copy of a December 15, 2005 letter by Rebecca Ellin of the North Carolina National Estuarine Research Reserve giving the Town of Beaufort permission to act as an applicant for the permit to construct the boardwalk and platform; • a copy of a June 5, 1987 letter by James S. The lands dedicated to the North Carolina National Estuarine Research Reserve pursuant to this instrument may be removed from dedication upon the approval of the Governor and council of,State. 7. The Custodian may erect and maintain a permanent plaque or other appropriate marker at a prominent location on the within described premises bearing the following statement: "This Area is Dedicated as a State Nature Preserve." Director Division of Water Quality murcAlmad 0ity The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major Permit Application for Rachel Carson Reserve Boardwald on August 18, 2006. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements.
