Traditionally we do require state permits before local permits are issued. It appears he needs to ask for his variance from us then get his CAMA permit after it meets our regulations. That puts a large burden on your (CAMA's) shoulders- how are you all supposed to know all of the local regulations where you write permits? That lot and an number of other ones aver very narrow and reach the minimum lot width standard (100' in R-20) fairly far into the property and close to the water. Attached is an example (the correct 100' foot line is beyond the trees). I am interpreting our zoning code definitions that no structure is permitted unless is located at or beyond the 100' building line. I am seeking your opinion so that I may be consistent. We have consistently required and allowed a lot to have the minimum width at some point on a lot (think trestle walk) even though it may not be at the roadway. Our definition of lot width is: Lot width - The distance between side lot lines measured at the building setback line. Although this definition does not specifically state that the minimum lot width is measured at the building setback line I think that is the intent. Here is the kicker: our definitions of building setback line is: Building setback line.- A line establishing the minimum allowable distance between the nearest portion of any building, excluding the outermost three (3) feet of any uncovered porches, decks, steps, chimneys, eaves, gutters, and similar fixtures, and the street right-of-way line when measured perpendicularly thereto. Therefore no structure may be built between the building setback line (measured at the lot width) and the street. Additionally, our definition building line is specific in that not structure may be constructed between this line and the street: Building, line - A line located a minimum horizontal distance from the right-of-way line of a street or road parallel thereto, between which and the right-of-way line no building or parts of buildings may be erected, altered, or maintained except as otherwise provided herein. The weakness here is that nowhere does the code specifically state that the building setback line or building line shall be measured from the point on the lot where the lot reaches the required minimum width as defined by the zoning district. Yard setbacks are clearly measured from the street ROW, so that is not an issue. I have one party who will be requesting a variance based on this interpretation and another who is seeking a CAMA permit that does not meet the criteria. I hope I am clear with my interpretation and please let me know if you agree with my logic as I know this will result in an appeal to the BOA. In issuing permits and approving subdivisions I have always required a building to be behind the minimum lot with building line.
