Does the proposed project constitute major or minor development? This is critical since you only have the authority to issue minor permits (G.S. 113A-118(b) and G.S. 113A-121). A Major Permit is required when a project: l . Occupies 20 acres of AECs; 2. Has a structure or structures in excess of 60,000 square feet of ground area on a single parcel of land in an AEC; or, 3. Requires licensing, approval, certification, or, authorization from the N.C. Environmental Management Commission, the N.C. Department of Human Resources, the N.C. Department of Environment and Natural Resources, the N.C. Department of Administration, the N.C. Mining Commission, the N.C. Pesticides Board, the N.C. Sedimentation Control Board, or any Federal agency or authority. The permit requirements of these agencies are listed in your notebook under the Program Coordination Section 3. When you are not sure if one of these agencies is affected, contact your. DCM Field Consultant. Now that you have determined that the proposed project is minor development, that the project is -located in an AEC and is not exempt from the. permit requirements, then a CAMA Minor Permit must be processed to authorize the work [(G.S. 113A-118) of CAMA]. Although the actual procedures to follow in processing the permit are given in your local government's approved Implementation and Enforcement Plans (I&E), the most current guidelines are in 15 NCAC 7I, "Secretary's Grant Criteria For Local Implementation and Enforcement Programs Under the Coastal Area Management Act" which are located in Section 3 of your LPO manual. �7 THE CAMA MINOR PERMIT PROCESS PRE -APPLICATIONS MEETINGS — Site meetings prior to the submission of a CAMA Minor Permit application are very helpful in ensuring a smooth and expeditious permit process. The LPO (not the surveyor, contractor, consultant or architect) is the only person authorized to determine the first line of stable, natural vegetation (FLSNV), normal high water (NHW) or normal water (NWL), as well as, the limits of coastal wetlands. These lines mustbe established and flagged prior to the development of the project drawings. A pre -application site meeting is also a good time to alert the applicant to any potential problems that might slow down the permit process, such as, a wetland delineation from the US Army Corps of Engineers, an Improvements Permit from the local Health Department or any other information that would be required with the CAMA Minor Permit application. COMPLETE PERMIT APPLICATION - The permit process begins when the applicant has submitted a complete Minor Permit application and a check for $100.00 (15 NCAC 7I.0406). A complete CAMA Minor Permit application consists of the following items: 1. Application Form — all blanks filled in, signed and dated by the applicant or agent, and if the site is located in an. Ocean Hazard AEC, a completed AEC Hazard form signed by the property owner. 2. Application Fee - $100.00 3. Documentation of notification of adjacent property owners (copies of letters/mail receipts if . applicable). 4. ,Other information deemed necessary for review (15A NCAC 7J.0204(b)(7) such as; a copy of a 4 Zoning Certification, if applicable, a copy of the Improvements Permit for installation of a septic system, if applicable, a copy of the property survey, if needed, or a copy of an approved wetland delineation, if applicable. 5. Project Drawings a. All drawings should include the following information - Name and project address (title box) - Property dimensions and names of adjacent property owners indicated Dimensions and location of all existing and proposed structures, driveways, and sewage disposal system. Decks labeled as covered or uncovered and dimensions shown. Adjacent water body labeled and Normal High Water (NHW) or Normal Water Level (NWL) contour shown. Marsh and/or wetland areas labeled [wetland delineation documentation from the US Army Corps of Engineers (USACOE) included with application, if applicable]. All areas of ground disturbance and/or landscaping shown. b. Additional information for project drawings in the Ocean Hazard Area AECs - All dunes and dune system contours, labeling the dune crest and both the landward and the oceanward dune toes. The applicant's mailing address is entered here. If an agent is utilized to apply for the permit, their contact information is entered in the Authorized Agent section. Location of Project is the address of property where the work is to take place: the 911 address, subdivision and lot number, State or County road, etc. Description of Project should include all land clearing, demolition, construction, and landscaping activities that are proposed to complete the project. It is better to go over -board -here, than -to omit something that would necessitate having to modify or re- apply for another permit to complete the development. Size of Lot/Parcel can be listed as square feet or acres, or both. Check the applicable Proposed Use, residential (single-family or multi -family), commercial, or other. Total Enclosed Floor Area is the combined square - footage of all of the floors, plus any roof covered porches/decks. If the project is not in the -Ocean Hazard Area, then insert N/A and go to the next section and determine in which Coastal Shoreline AEC the project is located. The applicant should insert the amount of impervious coverage that is allocated to their lot under the State Stormwater Permit. This number is usually found on the property deed or subdivision covenants. Typically, any subdivision that was developed after January 1,1988, will have a State Stormwater Man. On the second page of the application, the section entitled Statement of Ownership is completed by the applicant using information from the property deed. The applicant must check -one of the three options and fill in the appropriate information. Make sure that adjacent riparian property owners have been listed in the Notification of Adjacent Property Owners section and that they have been contacted by the applicant;either in person or by certified mail. An example of a notification package cover letter and adjacent riparian property owners notification.form are shown following the example Minor Permit application, and they are included in your Forms and Documents CD. Copies of the completed letters and certified mail receipts, if required, should accompany the application. Should the' applicant tell you this has been done, and later an adjacent riparian property owner files an appeal. of the permit because they were not notified, the work will have to be stopped until the appeal process has been completed. It is far easier for all parties if proper notice is given before the permit is issued. Finally, have the applicant/agent must sign and date the application at the bottom of the page.
