(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. All fencing is not to exceed 4' high within 25' of normal high water. This project is located within the Beaufort Historic District, therefore a Certificate of Appropriateness must be issued by the Beaufort Historic Preservation Commission indicating compliance with the Historic Preservation Guidelines before work may begin. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) . A copy of this permit shall be posted or available on site. Contact this office at (252) 808-2808 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2010 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. The DCM reviewed the application along with the pertinent rules of the Coastal Resources Commission in conjunction with your objections and determined that the project is consistent with the Commission's rules. Therefore, the DCM issued CAMA Minor Permit #13-07 to Mr. Rumfelt on September 28, 2007, authorizing the fencing as proposed. If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the Director of the Division of Coastal Management, Mr. James Gregson, Department of Environment and Natural Resources, within 20 days of the permit decision. It would block the view of others from Taylor's Creek and Carrot Island. It would possibly create a precedent that would allow every other person on Front Street who claims that property across the street from their house to also start building fences and the whole waterfront would be a series of unsightly fences or similar structures. It would take away the public right to have access to the shore that has always been a part of living in Beaufort. I also question the effect that a structure like this would have on the delicate nature and balance of the nearby marshes that have been fiercely protected in so many other coastal areas. The fence that is already in place is in the water since high tide comes to the sea wall in that area. How can the marsh be protected there with a fence and fence posts in the sand? Please do not allow this permit. Kathleen Hamilton Beaufort Resident SEP 2'7 2007 Morehead City DCM 9/26/2007 To Whom It My Concern: I would like to make a complaint against the obstructive fence on the shore down from Gordon Street, Beaufort. The fence that was built is making our beautiful waterfront look chopped up by dividing property lines. The Beaufort waterfront has very few fence -like structures up in the position that this one has been placed. It looks unnatural for our shoreline to Taylor's Creek and takes away from the quaint Beaufort charm that has set our waterfront apart from so many other seaside towns. That is what makes Beaufort so different from the rest because very little construction has taken place on the area past the seawall to the waterline. Once you allow this to be permitted along our shoreline then everyone else on Front Street will start constructing fences. These structures will make the fairly undeveloped waterfront turn into a highly developed place that will take away from the naturally beautiful view we share overlooking Taylor's Creek and Carrot Island. I object to this construction. This allowance will open the door for every other citizen with water front property to build structures to obstruct views and possibly harm the delicate marshes that they are running into. I hope you do not allow the existing fence and the fence this person has applied for to be constructed.
