Dear Mr. Carey:
After reviewing your application in. conjunction with the development standards required by the Coastal Area
Management Act (CAMA) and our locally adopted Land Use Plan and Ordinances, it is my determination that a minor permit
may not be granted for the project which you have proposed.
This decision is based on my findings that your request violates NCGS 113A-120(a)(1) which requires that all
applications be denied which are inconsistent with CAMA guidelines concerning coastal wetlands. You have applied to
construct a second retaining wall landward of the high water mark and to backfill between the two retaining walls. Upon a site
inspection by a Local Permit Officer from the Town of Morehead City along with an officer from the state CAMA office, it was
determined that the area on the water side of the current retaining wall is considered to be coastal wetlands per 15A NCAC
07H.0205(a). Minor Permits may not be issued for development in coastal wetlands. It may be possible to obtain a Major
CAMA Permit from the state CAMA office for this project. Please contact Heather Styron, pisiet-t� o Ina or, Division of
Coastal Management, 400 Commerce Avenue, Morehead City, NC 28557, phone 252-808-2808 if you I o inquire about
such a permit.
Should you wish to appeal my decision to the Coastal Resource Commission or request a variance from that group,
please contact me so I can provide you with the proper forms and any other information you may require. The Division of
Coastal Management in Raleigh must receive appeal notices within twenty (20) days of the date of this left r in order to be
