In 1974, the North Carolina General Assembly passed the Coastal Area
jManagement Act and set the stage for guiding development in fragile
and productive areas that border the state's sounds and oceanfront. Along
with requiring special care by those who build and develop, the General
Assembly directed the Coastal Resources Commission (CRC) to imple-
ment clear regulations that minimize the burden on the applicant.
This application for a minor development permit under CAMA is part
of the Commission's effort to meet the spirit and intent of the General
Assembly. It has been designed to be straightforward and require no
more time or effort necessary from the applicant. Please go over this
folder with the Local Permit Officer (LPO) for the locality in which you
plan to build to be certain that you understand whatinformation he or
she needs.
Under CAMA regulations, the minor permit into be issued within 25
rdays once a complete application is in hand.Often less time is needed if
s z the project is simple. The process generally takes about 18 days. ,You
can speed the approval process by making certain that your application
< is complete and signed, that your drawing meets the specifications given
{ inside and that your application fee is attached.
Other permits are sometimes required for development in the coastal
area. While these are not CAMA-related, we urge you to check with the
Local Permit Officer to determine which of these you may need. A
listing is included on page 2 of this folder.

This matter was mediated on Aug st 5, 2008 in Beaufort, NC by Charles K. McCotter, Jr.,
Mediator. Present were Doug Smith representing the Owner and Les Sadler and Fred McClure
of the Beaufort Historic Preservation Commission and Marianna I=lollinshed and Robert
Campbell, Town of Beaufort Commissioners, representing the Mediation Team for the 'town of
Beaufort. This mediation was conducted pursuant to the Medication Protocol of July 25, 2008
and the `Rules Implementing Statewide Mediated Settlement Conferences in Superior Court
Civil Actions'. The Mediation Teams make the following Proposed Settlement of all issues
identified in the Mediation Protocol.
1. Recommend that the BHPC issue a Certificate of Appropriateness allowing Mr. Smith to
demolish the Carpenter Cottage and shall incorporate reasonably useable and salvageable
components in the new structure at 122 Front Street, or, in the alternative, move the
Carpenter Cottage at Mr. Smith's expense, to another location in Beaufort.
2. Recommend that the BHPC issue a Certificate of Appropriateness allowing Mr. Smith to
build a one and one-halfstory residence on the lot at 122 Front Street with the following
requirements:
a. The new structure shall be built on the existing footprint except that the entire
footprint may be moved to the south approximately 1.8 feet, so that the front
porch will not encroach the Front Street right-of-way as does the porch on the
existing structure. The Mediation Teams recommend that the Board of
Adjustment grant Mr. Smith. a variance to move the footprint approximately 1.8
feet south or that the Town of Beaufort grant an encroachment agreement to heir.
Smith for a porch encroaching 1.8 feet onto the Front Street right-of-way.
b. The front view of the new structure shall be as shown as the Front Elevation in the
attached Exhibit.
The rear view of the new structure shall be as shown as the Rear (south)
Elevation in the attached Exhibit, except that an 8 foot deep single story porch,
similar in width to the rear shed dormer, be permitted on the rear (south) side of
the structure. The Mediation Teams recommend that the Board of Adjustment
grant Mr. Smith an 8 foot variance on the south for the porch.
d. The new structure may have a chimney on the east side.
3. Tile Proposed Settlement shall be submitted for approval. as described in Paragraph 7 of
the Mediation Protocol with the additional recommendation that the Board of Adjustment
approve the necessary variances to effectuate this Proposed Settlement.

Before ordering any materials or doing any work, each
contractor shall verify all measurements and shall be
responsible* for the correction of some. No extra
charge or compensation will be allowed on account
of the drawings, any difference which may be found,
shall be submitted to the owner for consideration
before proceeding with the work. While every attempt

as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Doug Smith, authorizing development in the Estuarine Shoreline (AEC) at 122 Front St, in Beaufort; as
requested in'the permittee's application, dated 5/8/06. This permit, issued on 5/30/06, is subject to compliance. with the
application and site drawing (where consistent with the permit), all applicable regulations and special conditions and
notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may
cause the permit to be null and void.
This permit authorizes: Construction of new home in footprint of existing home
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 5/9/06.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change 'or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 252-808-2808 for a final inspection at
completion of work.
(Additional Permit Conditions on Page 2)
This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:

In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of NHW (Estuarine Shoreline
Area of Environmental Concern), in this case,1232 square feet is authorized.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of NHW. In this case,15A NCAC 07J
.0211 allows the structure to be built in the existing. footprint.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained one site by effective
sedimentation and erosion control measures:: Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between!the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) • Any proposed for grading within the 30' buffer from the NHW must be contoured to prevent additional stormwater
runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated
state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion..
(10) All work must be constructed in accordance with Certificate of Appropriateness from the Town of Beaufort Historic
Preservation Commission dated March 10,2005.

We hereby certify that we own property at 117 Front St., Beaufort, NC.
We object to the replacement of a low single story structure at 122 Front St., with a multiple story
structure of undisclosed height or style. The existing structure is the only non-commercial
structure on the waterside of Front Street in the down town area and by itself is out of character
with the surrounding structures. In addition it blocks the natural views of the harbor. A new two-
story structure will be even more out of character and increasingly block the view of the harbor.
Related to this matter is the fact that Warren Sanchez, who also owns property at 117 Front St., is
out of the country until early June. It would be a courtesy to extend the comment period until
June 15, so that Mr. Sanchez has an opportunity to respond as well.

Objections to proposed construction at 122 Front St. N ` �-9 C—
1) Construction as proposed will be equivalent in height to a 3-story building, much larger than
the existing historic structure. .
2) Height as proposed is not compatible with the open space character of the area on both sides
of the existing historic building.
3) Height as proposed will result in loss of view from our unit and the new units to be developed
by Mr. Smith. Why not work with the existing building?
4) No justification has been given for demolition of existing historic structure.

Dear Mr. Lederer:
This correspondence is in reference to your May 15, 2006 letter of objection to the proposal of
Mr. Doug Smith, adjacent to Taylor's Creek, located at 122 Front Street, Beaufort, Carteret
County, NC. The applicant's proposal was for the replacement and vertical expansion of a
residential structure.
It appears that your concerns deal with allowances/restrictions under the building, zoning, and
historic district regulations of the Town of Beaufort. None of the listed concerns fall into the
development category and regulations of the Coastal Area Management Act.
DCM reviewed the application along with the pertinent rules of the Coastal Resources
Commission in conjunction with your objections and determined that the project is consistent
with the Commission's rules. Therefore, the DCM issued CAMA Minor Permit #14-06 to Mr
Smith on May 30, 2006, authorizing the residence as proposed.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the

Dear Ms. Cramer:
This correspondence is in reference to your June 01, 2006 letter of objection to the proposal of
Mr. Doug Smith, adjacent to Taylor's Creek, located at 122 Front Street, Beaufort, Carteret
County, NC. The applicant's proposal was for the replacement and vertical expansion of a
residential structure.
It appears that your concerns deal with allowances/restrictions under the building, zoning, and
historic district regulations of the Town of Beaufort. None of the listed concerns fall into the
development category and regulations of the Coastal Area Management Act.
DCM reviewed the application along with the pertinent rules of the Coastal Resources
Commission in conjunction with your objections and determined that the project is consistent
with the Commission's rules. Therefore, the DCM issued CAMA Minor Permit #14-06 to Mr.
Smith on May 30, 2006, authorizing the residence as proposed.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request with the
Director of the Division of Coastal Management, Mr. Charles S. Jones, Department of
Environment and Natural Resources within 20 days of the permit decision. A copy must also be
sent to the Attorney General's Office, Environmental Division. If you wish to appeal, please

In an area of environment concern pursuant to Section 113A-318 of the
General Statutes, "Coastal Area Management"
Issued to Doug Smith, authorizing development in the Estuarine Shoreline (AEC) at 122 Front St, in Beaufort, as
requested in the permittee's application, dated 5/8/06. This permit, issued on 5/30/06, is subject to compliance.with the
application and site drawing (where consistent with the permit), all applicable regulations and special. conditions --and
notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may
cause the permit to be null and void.
This permit authorizes: Construction of new home in footprint of existing home
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 5/9/06.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federat regulations,
applicable local. ordinances and FEMA Flood Regulations:
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall, -be posted or available on site. Contact this office at 252-808-2808 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project Ryan Davenport
