Newport., N.C., as requested in the permittee's application, dated May 1$. 2005. This permit, Issued on Lum
1. 2005 Is subject to compliance with the application and site drawing (where consistent with the permit), all
applicable regulations and special conditions and notes set forth below. Any violation of these terms may
subject permittee to a tine, Imprisonment or civil action, or may cause the permit to be null and void.
ThLr permit authorizes
(I) Construct a concrete footer covered with landscape wall of interlocking block at 205 Sea Trace Lane, Newport; North
Carolina within'15' of the NHW of Rogue Sound in the AEC area of environmental concern.
(2) The amount of impervious surface areas shall not exceed 30% of the lot area within the 75, area of environmental
concern (AEC).
(3) A 30' bufrer zone; must be placed between all impervious areas and surface waters (wetlands).
(4) All proposed development and associated construction must he done In accordance with the permitted work plat
drnwings(s) dated received May 18, 2005.
(5) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal
regulations, applicable local ordinances and FEMA Flood Regulations.
(6) Any change or changes in the plans for development, construction, or land use activides will require a re-evaluation and
modification of this permit
(7) Pursuant to 15 N.CA.C., Subchapter 7J.0406(B), this permit may not be assigned, transferred, sold, or otherwise
disposed of to a third party.
This permit action may be appealed by the permittee or other
qualified persons Within twenty (20) days of the issuing date, from
the date of an appeal, any wort'; conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and awesslble to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this pe rrnit expires on December 31,
2008 L
In issuing this permit it is agreed that this project Is consistent with
the local Land Use Plan and all applicable ordinances,
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner: is aware that the proposed development is planned for an area which may be susceptible to
erosion and/or flooding. I acknowledge thdr dic local permit officer has explained to me the particular hazard problems associ-
atcd with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing tech-
niques.
PERMISSION TO ENTER ON LAND:
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer and his agents to
enter on the aforementioned lands in connection with evaluating information related to this permit application.
This application includes: general nformation (this form), a site drawing as described on the back of this application, the
ownership statement, the AEC hazard notice where necessary, a check for $ 100.00 made payable to the locality, and any infor-
mation as may be provided orally lyy the applicant. The details of the application as described by these sources are incorporated
without reference in any permit which may be issued. Deviation from these details will constitute a violation of any permit. Any

PROPOSED PROJECT AT 205 SEA TRACE LANE; NEWPORT, NC 28570
Kenneth D. Link and Shelia (Garner.) Link as part of the development of the property at 205 Sea
Trace Lane in Newport, NC plan to place a landscaping wall approximately 2.5 feet above the
current grade approximately 2 feet inside the current north/south property lines between their
property and that of ]Getty Geiges and Mary Ann Liles (Jones). The area behind the landscaping
wall, would back filled with dirt and graded gradually back to the existing grade at the house
being currently constructed on the property.
The landscape wall would be approximately 10 feet above the current high time Line on the north
side of Bogue Sound adjacent to their property. The construction of the landscape will not
infringe on the marsh grass area, will not touch the adjacent properties and is designed to provide
proper drainage without causing flooding to adjacent properties. The area will be graded so as to
allow for proper drainage from the lot at 205 Sea Trace into the sound without impacting the
adjacent properties.
The purpose of the landscaping is to provide beautification from both the water and land sides of
the property.
