In an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Preston S. & Hallock C. Howard, authorizing development in the Estuarine Shoreline (AEC) at 301 Old
Causeway Rd., in Atlantic Beach, N.C., as requested in the permittee's application, dated 11/02/05. This permit, issued
on November 30, 2005, is subject to compliance with the application and site drawing (where consistent with the permit),
all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes the construction of a single family dwelling located more than 30' landward of the normal high water mark.
This permit is authorized under CAMA's section 15A NCAC07J.0211, Nonconforming Development.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings
received on November 10, 2005.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (252) 726-4456 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
DECEMBER 31, 2008
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The amount of impervious surface area within the 75 foot Area of Environmental Concern is less than the existing
nonconforming structure and is also located outside of the 30 foot buffer.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of the normal high water mark.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) Any proposed grading within the 30' buffer from the normal high water mark must be contoured to prevent additional
stormWater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

The N.C. Division of Coastal Management hereby acknowledges receipt of your application for
State approval for minor development of your property located at 301 Old Causeway Rd. in
Atlantic Beach in Carteret County. It was received complete on November 10, 2005 and appears
to be adequate for processing at this time. The deadline for making a permit decision is
December 5, 2005.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a Notice of Permit Filing postcard which must be
posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be notified.

Pursuant to NCGS 113A-119(b), the Town of Atlantic Beach, a locality authorized to issue
CAMA Permits in areas of environmental concern, hereby gives notice that on November
10, 2005 Preston & Hallock Howard applied for a CANIA Permit to construct a single
family dwelling located at 301 Old Causeway Rd. in Atlantic Beach, NC. The application
may be inspected at the address below. Public comments received by November 24,
2005 will be considered. Later comments will be accepted and considered up to the time
of permit decision. Project modifications may occur based on —further —review —and

Thank you for meeting with me Wednesday November 2, 2005 to review the Site Plan
for the Howard's property. I've made the following notes regarding our discussion:
1)We are applying for a CAMA permit for Lot 70, Block 20, Atlantic Beach Isles under
the Coastal Area Management Act Section 15A NCAC 07J .0211, "NON-
CONFORMING DEVELOPMENT." Prior to our meeting I reviewed the same site plan
with Mr. Mark Hardeman of the NCDENR Division of Coastal Management. It was his
opinion that our project met the requirements of the Non -Conforming Development
section.
2)The footprint of proposed new house is smaller than the original, meets all of the
Town's setback requirements, and has less non -pervious surface within the AEC than the
original house (this information is noted on the Application for CAMA permit).
3)Due to the corner configuration of the lot, only one neighbor meets the notification
requirement. The Howards have certified that this neighbor has been contacted and
informed of their plans.

may need to be addressed.
